~S, the Public Employees' Retirement Law permits the participation
of public agencies and their employees in the Public Employees' Rettrement System
by the execution of a contract, and sets forth the procedure by which said "public
agencies my elect to subject themselves and their employees to amendments to
said law; and
WHBBEAS, ODe of the steps required in the procedure to amend this con-
tract is the adoption by the legislative body of the public agency of a resolution
giving DOtice of its intention to approve an amendment to said contract, which
resolution shall contain a SUUllDilry of the changes proposed in said contJ:8et; and
plan;
WHElPAS, attached is a summary of the major provilfions of the proposed
NOW, 'JBDB1P0RE, BE IT RESOLVED, that the City Council of the City of
Tiburon gives, and it does hereby give, notice of intention to approve an amend-
ment to contract between said City Council and the Board of Administration of the
Public Employees' Retirement System, a copy of said amendment: and a s~ry of the
major provisions of the proposed changes being attached hereto, marked Ezhibits
.~ U and "B" and by this reference made a part hereof.

AMENDMENT TO CONTRACT BE~'EEN THE
BOARD OF ADMINISTRATION

Tbe Board of Administration, Public Employees' Retirement System, hereiDatter
referred to as Board, and the CITY COUNCIL of the CITY OF TIBJRON, hereinafter
referred to as Public Agency, having entered into a contract under date of Pebruary
8, 1967, effective February 1, 1967, and as amended effective,June ;0; 1972, and
as provided by Chapters 170 and ;16, Statutes of 19n, which provide tor parti.ci..
pation of Public Agency in said System, Board and Public Agency hereby agree as .
follows:
A. The following paragraph shall be added to said contract:
7 (b) Section 21380-7 (providing for allowances tor ~V{)r~ of
miscellaneous and/or local safety members covered upder 'tht
program upon death before retirement).
B. Paragraphs 8 (a) and 8 (b) shall be stricken from said oontract and lU
following paragraphs subs'l.i l.utcd therefor:
8. Public Agency shall contribute to said Retirement System as foU-.
a. With respect to miscellaneous members, the public agency shall
contribute the following percentages of monthly salaries 881"ll8t
as miscellaneous members of said System:
(1) 0.31 percent until June 30, 1990 on a.ccount of the liab1U_
for prior servic';.': benefits.

b. With respect to local safety members, the public Bgcney shall

Surv.vors of members who elect coverage under the PERS survivor program and
whoa. de th occurs before retirement will receive a monthly life income as follows:
Widow and two or more depend~nt children $430

Conditions:
1. A deJ"" ..o..lent child is one under the age of 18 and ur.marriec, ~r a disabled
c~111d of any age who has been continuously di.sabled since ,-lge 18. (For
pUrposes of the 1959 Survivor allowance, a person shall be considered
under the age of 18 if he is an unmarried, full-time student between the
ages of 18 and 22.)
2. A widow ceases to b~ eligible for a benefit upon her remarriage.
3. A widower ~~ll be ~ligible for a benefit the same as a widow provided he
was dependent upon the deceased member for at least one-half of his support.
lt~ A widow (or widower) f<'ust be married to mel1ber prier to the occurrence of
the injury or onset of the illness which resulted in death.
5. The basic death benefit currently includec in your retirement prog:-am pro-
vides that should a member die prior to his retirement, his b~neficiary
would be paid the membe;'s accumulated contributions plu3 an additional
amount equal to one-month's s21ary for each .......... o:iervice, up to a max-
imum of six month~. The Rh~" _~~~t~ will be payable in addition
to any basic ~._...\:.l.vor may be entitled to receive.
6. :~ a member is covered under both the PERS '1959 Survivor Benefit described
above and the survivor benefits as provided in Section 21365.5 (1957
Survivors Benefit) of the Retirement Law, the survivor will be paid bote
banefits.
?, Section 21383 - If su:-vi VOl" is entitled to special death benefit and at
the same time is entitled to receive a survivor allowance, the survivor
allowance payable in any month shull be reduced by the amount of the
special death benefit allowance.
COST TO THE EMPLOYEE
4$4 ~~ Each, employee will contribute 12.00 a month in addition to his normal ~etire-
ment contributions. He will continue to ~y this additional amount until either
termination of employment or retirement and under no circumstances will these
.contributions b(~ refundable.
EFFECTIVE DATE
These survivor benefits will become effective on (Date).
All present rr.embers of the System will he given the opportunity by written ballot
to select this survivor coverage. Persons who choose coverage will remain covered
until they tenllinate their employment o~. retire.
For agencies not covered under Social Security all future employees would be
mandatorilJ covered under this program~ For agencies who are covered under Social
Security all future emplC';lpC', 8. '-' .oandatorily covered under Social Security and,
therefore, are not eli6ibie for the PERS survivor benefits.
EXAMPLE
Under the PERS survivor program, if a member passes away before retirement
leRving a widow and four children, the widow would receive a monthly income of 1430
until such time as the three oldest children have passes age 18 (so that s~e now
only has one child under the age of 18) at which time her benefi.t would be reduced
to $360~ The $360 would continue to be paid until the last child passes the age of
18 at which time the paJ~ent would cease until the widow reaches the age of 62.
She would then receive $180 a month for the remainder of her lifetime. The widow
ceases to be eligible for her benefit when she remarries although benefits would
continue to any remaining children under the age of 18.,
For purposes of the 1959 Survivor allowance, a person shall be considered
under the age of 18 if he is an unmarried, full-time student between the ages of
18 and 22.
