HomeMy WebLinkAboutTC Res 1973-06-11 (3) RESOLUTION NO. 540 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON APPROVING THE TENTATIVE SUBDIVISION MAP FOR THE RO-IC DEVELOPMENT KNcx.rn AS PARADISE ESTATES. WHEREAS: Pacific Land Projects has submitted ~ tentative map for the subdivision known as Paradise Estates, and WHEREAS: said map is in compliance with the !'!a:;t:cr Plan approv(>d by the Planning Commission and City Council of the City of Tiburon , and WHEREAS: the map has been reviewed by various public agcllcics, staff, and the Subdivision Review Committee, and WHEREAS: th~ map appears to meet the applica.ble requirement.s of the Ordinances of the City of Tiburon, with the addition of cl~rt:ain conditions. WHEREAS : Paradise Estates. the Planning Crnmnission has accepted the Tentative Map of NOW, THEREFORE BE IT RESOLVED: 'The City Council of the City of Tiburon does hereby approve the Tentative Map of Paradise Est:ltt::S subject to the follow" ing conditions: 1. Dedication of the roadways, and its ~provcment to City standards. 2. Fire Protec tion as required by the Tiburon Fire Protect ion Dis tric t. 3. Public Utility easements as shown on the Tentative Map. 4. The recommendations as to Slope Stabilization as contained in the Cooper, Clark & Assiciates report dat0d April 10, 1973. Said re- port shall be considered an addendum to this Tentative Map~ 5. Erosion control and landscaping to be included as 1mprov~ment plans with Final Map. 6. The recommendations of Marin County Department of Public Works in letter dated June 1, 1973. 7. Provide for the dedication of Parcel B to the City, Parcel A to remain in common open space for. the benefit of the property owners. 8. The Marin Municipal Water District is to certify the adequacy of the water pressure as necessary for fire protection and domestic supply. 9. The accompanying data statement describing the conditio~ of the Tentative Map be accepted as a condition of approval by th~ City Attorney. 10. Approval of the conditions, covenants, and deed restrictions inclu- ding open-space maintenance contracts, including provisions ~llowing the City to enforce open space maintenance and also including a pro- hibition against construction or maintenance of fencing along common area, to be approved by the City Attorney. ll. In-lieu Park & Recreation fee in accordance with Section l4-50 of t~~ City Code.
