RESOLUTION NO. 528
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TIBURON SUB~lITTING AN
APPLICATION FOR STATE AID UNDER THE
EHERGENCY FLOOD RELIEF LAn SECTIONS
51!150-5~164 OF GOVEffiFlENT CODE
:mEREAS, the Emergency Flood Relief Law, Sections 54150, et.seq.,
of the Government Code, authorizes State aid to repair or restore storm
damage or destruction to public real property having a general public
and state interest, subject to the appropriation of the necessary funds
by the State Legislature; and
; !HE REAS , during the period from January 12, 1973 to January 18,
1973 there occurred storm and flood damage or destruction estim~ted
at $ 24,947.78 to public real property having a general public and
State interest, hereinafter described, lying within the boundaries of
the City of Tiburon;
NOH, THEREFORE, BE IT RESOLVED:that application is hereby !:lade
to the State of California for state assistance under said law to
repair and restore the public real property described in Exhibit "A"
attached hereto and by this reference Made a part hereof.
BE IT FURTHER RESOLVED THAT:in consideration of the application
the City of Tiburon agrees to indemnify, defend and save harmless the
State, its officers, agents and employees from any and all claims and
losses accruing or resulting by reason of or in connection '1ith said
work, the application for state assistance or action of any type taken
with regard to the same, including but not limited to claims based upon
tort and claims based upon contract.
BE IT FURTHER RESOLVED THAT:Robert L. Kleinert, Assistant City
~lanager is designated as the applicant's duly authorized representgtive
in all matters arising under this application, exclusive of the po'~er
to execute, on behalf of applicant, the agreement with the appropriate
State Department for the performance of the ~.1Ork.
PASSED NlD ADOPTED at a regular meeting of the City Council of
the City of Tiburon held on April 9th , 1973, by the follow.ing
vote:
