A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
GRANTING AN EXTENSION TO USE PERMIT TO Ml\IN'ltdN AND
OPERA TB A PARKING LOT AT 1691 TIBURON BOULEVARD
WHEREAS: The NORTHWESTERN m.CIFIC RAILR()\D, did, on the 20th day of June,
1968, apply to the City Council of the City of Tiburon, for a Temporary Use Permit to
establish, maintain and operate a parking lot on property situated at 1691 Tiburon
Boulevard as provided for by Section 10-10 of Ordinance No. 9 N.S. of the City of
Tiburon; and
WHEREAS: The City Council of the City of TiburoD making findings therefore,
did grant a temporary Use Permit for a period of one year, subject to certain con-
ditions as set forth in Use Permit No. T-I; and
WHEREAS: The City Council baving received petitions therefore, did on
AU2Ust 21. 1972 grant an extension of one year for the Use Permit, subject to the
original conditions adding the following:
1. That all conditions of the Permit heretobefore set forth shall be, and
are, in full force and effect.
2. That the parking rate schedule shall be as follows:
MOnday through Friday - 25C - 12 hours
Mbnday through Friday - $5.00- monthly
Sa turday & Sunday 75C - 12 hours
WHEREAS: The NORTHWESTERN PACIFIC RAILR()\D, on the 25th day of June, 1973,
did apply for an extension for the above Use Permit No. T-l; and
WHEREAS: The City Council did, on the ~day of Julx , 1973, did hear
and consider said application in accordance with applicable ordinances and statutes.
NOW, THEREFORE, BE IT RESOLVED 'mAT THIS COUNCIL FINDS:
1. The granting of an extension for a Temporary Use Permit for a period of
one year to the said applicant, for a parking lot in that certain portion of the PD
zone described in the application on file herein would not be detrimental to the health,
safety, peace, morals, comfort or general welfare of persons or property in the City of
Tiburon, and is required by the public necessity and welfare; and
BE IT FURTHER RESOLVED AND ORDERED THAT: Based upon the findings hereinabove
set forth, the extensions prayed for is granted on the following conditions:
1. That all conditions of the Permit heretobefore set forth shall be, and
are, in full force and effect.
2. That the fencing along Tiburon Boulevard be replaced and/or repaired
to restore it to its original condition.
3. That wheel blocks be placed in the parking spaces adjacent to the fence,
to protect the fence from damage by p~rking automobiles,
and shall, therefore, issue as provided for by the Ordinance of the Cit,y of Tiburon and
shall be effective July 9. 1973 for a period of one year from said date, subject, how-
ever, to cancellation on failure of applicant to abide by any of the aforementioned
conditions.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tiburon held on Julv 9th , 1973, by the following vote:
