A RESOLUTION OF T!!E CITY COUNCIL OF THE CITY OF TlBURON
GRANTING A USE PERMIT UNDER SECTION 3 OF ORDIli\NCE 87 N.S.
OF THE CITY OF T!BtmON
WHEREAS: Berman Ruth did apply for a Use Permit under provisions of Section 3
of Ordinance 87 N.S. of the City of Tiburon; and
~~AS: s~id City Council did on tile 28th day of June, 1973, did bear and
consider said applic:ltion in accord;:nce 19ith applicable ordinances and statutes; aDd
lGl, THE!tEFORE, BZ IT RESOLVED THAT TF..IS CITY COUNCIL finds:
A. The establishment, t!l3intenance 0:': conduction of the proposed use will, under
the circumstances of the pa,=ticular case, not be detrimental to the health, safety,
morals, comfort, convenience or welfare of persons reRiding in the neighborhood of
such proposed use;
B. The granting of a permit would not adversely affect the Open Space plan and
Zoning Ordinance of the City now u~der consideration.
AND BE IT FtrlTHER P.ESOr..~},ZD AND OP..Il-r.:P3D the t based upon the findings hereinbefore
s~t forth, the permit prayed for is granted on the condition that the processing of
all plans and applications shall be done under the provisions of Ordinance No. 123 N.S.
applicable to the subject prcperty as if it were zoned P~D-2.
PASSED AND ADOPTED at an ~2~rned mep.tin~ of the City Council of the City of
Tiburon held on Jtme 28th, 1973, by the following vote:
