A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
ADOPTING AN OPEN Sm.CE ELEMENT AS PART OF THE GENERAL PIAN
OF THE CITY OF TIBURON.
WHEREAS: Sections 65202 and 65560 of the Government Code of the State
of California require that all general law cities prepare and adopt an Open
Space Element as part of their General Plan; and
WHEREAS: the Planning Commission has held public hearings in accordance
with Section 65350 of the Government Code to consider said Open Space Element and
has recommended its adoption and,
WHEREAS: this Council has held a public hearing as required by law, and
has had the benefit of public discussion, and
NOW, THEREFORE, BE IT RESOLVED that the Tiburon Open Space Element, con-
sisting of the attached map labeled "Tiburon Open Space Element", da ted March 2l,
1973, and the text contained in the attached document entitled "Tiburon Open
Space Element Text II ,
draft dated Yprch 21, 1973, is hereby adopted as
part of the General Plan of the City of Tiburon.

OPEN SPACE ELENENT TEXT
PREAMBLE
'!he attached map, entitled "Tiburon Open Space Element", illustrates the land
uses included in the Open Space Element of the Tiburon General Plan. The Open
Space Element has been adopted in order to provide for the long-range preser-
vation and conservation of opeL Gpace land on the Tiburon Peninsula.
Factors that have influenced the formu~ation of the Open Space Element and its
specific recommendations are the increased demand for parks and recreational
facilities; topography, soil, and drainage problems which are intensified by
development; and the desire to preserve as may reasonably be possible, the unique
and desirable aspects of wildlife and vegetation associations.
In order to implement the Open Space Element, precise zoning should be adopted
for all the areas affected to encourage the preservation of ridges, natural
neighborhood separators, and landmarks of exceptional natural beauty. Zoning
regulations should also require that careful consideration be given to geologi-
cal and topographical features of the terrain to be developed in relation to the
number, size and placement of structures within the Conservation Zone.
In addition, the County of Marin has been petitioned to adopt the indicated areas
on the said map within its jurisdiction as part of the Marin County Open Space
Element. Further amendments to the Marin County General Plan which may increase
residential densities should not be permitted within the Conservation Zone that
lies within the sphere of influence of the City of Tiburon.
OBJECTIVES
The principal objectives of the Open Space Element are as follows:
1. The enhqncement and permanent protection of the environmental quality
of Tiburon.
2. The implementation of regional and countywide open space plans for
the benefit of present and future inhabitants.
3. The preservation of significant amounts of land both quantitatively
and qualitatively as visual, recreational, and ecological resources.
PRINCIPLES
The Open Space Element has been designed to: (1) Identify and implement the major
functions and amenities of open space planning without unnecessarily or unreason-
ably interfering with the private use of property. (2) Give high priority to those
lands unsuitable for development for inclusion within those areas to be devoted
to permanent open space. (3) Give consideration to aesthetic and recreational
factors. (4) The Open Space Element as a device for identifying and maintaining
neighborhood and community separators.

STANMRDS
Development shall be planned and controlled to insure maximum preservation of
open space. Natural features, including lands too steep for development, geologi-
cally unstable areas, wooded canyons, areas containing significant native flora
and fauna, rock outcroppings, view sites, areas suitable for active or quiet recre-
ation, and watersheds and watercourses, shall be identified and preserved to the
maximum extent possible. Ridgelines shall be preserved through siting and building
location controls to minimize visual impact and to allow access along corridors.
PROPOSALS
The Open Space Element is b~sed upon a system of interrelated open space lands
of the Tiburon Peninsula encompassing ridges, the waterfront, and connecting open
space corridors. Distinctive areas or features wuch as Ring r~untain and the
Tiburon Ridge, along with open waterfront along Richardson Bay and the Downtown
Waterfront, are included.
CONCLUSIONS AND RECOMMENMTIONS
The Open Space Element is consistent with the requirements of State Law (Sections
65302 and 65560 of the Government Code) with the Regional Open Space Plan, San
Francisco Bay Region (Association of Bay Area Governments) and with the County-wide
Plan proposed by the ~~rin City-County Planning Council.
The adoption of the Open Space Element requires implementation through municipal
action and the initiation of development policies and open space regulations.
Careful consideration should be given to insure that new zoning regulations pro-
vide for such alterations of present densities and uses of land as may be appro-
priate to carry out the purposes and requirements of this Open Space Element.
Where goals cannot be achieved by other means, acquisition of public open space
lands shall proceed according to priorities as may be established.
DESCRIPTION OF OPEN SPACE ELEMENT MAP
A. Land Use
Developed or Committed to Development: Areas in which building is to be
permitted consistent with open. space principles and controlled through site plan
and architectural approval and~or Design Review approval.
Planned Development and Open Space: A Conserva tion Zone in which land is
to be preserved as open space in either public or private ownership with develop-
ment to be controlled by approval of precise development plans promoting the
preservation of open space. De7elopment will be permitted where it is demon-
strated that all consideration is made to minimize negative impact on environment,
provide for public safety in regard to topography, soils, drainage) and where the
uses intended are in accord with the Tiburon General Plan and its Open Space Element.
Natural Preserve: General areas recommended to be kept, if possible, in a
natural state, free of structures, for enjoyment of the community in a manner
consistent with local stand~rds. Included as well are public areas that serve

as preserves for ~ildlife and native vegetation.
Park Areas: E:cisting and proposed public parks and open space preserves.
Play~rounds: Existing and proposed playground and other developed open
space for the use of the public.
Private Recreation Facilities: Private and quasi-public facilities recog-
nized as permanent recreational land and facilities.
B. Circulation
The circulation network and the trails system are for illustrative purposes
only.
