RESOLUTION NO. 515
A ~SOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIllUrrON DENYING A USE PERMIT UNDETI. SECTION 3
OF OrJHNANCE 87 N. S. OF THE CITY OF TIBURON
{JHEREAS: Richard 13. Ham did apply for a Use Permit unde4 provisions of
Section 3 of Ordinance 37 N.S. of the Cit7 of Tiburon, and
WHEREAS: said City Council did on the 12th day of March, 1973, hear
and consider said application in accordance with applicable ordinancez and
statutes, and
{1.HEREAS: the Planning Commission is holding public hearines to adopt
and Open Space plan and Open Space zoning ordinance.
NOl:l, THEREFORE, DE IT RESOLVED THAT THIS CITY COUNC IL find~:
A. The e~tablishment, maintenance or conduction of the proposed use
vill, under the circumstances of the particular case, be detrimental to the health,
safety, morals, comfort, convenience or welfare of persons residing in the neighbor-
hood of such proposed use;
B. The gr3nting of a permit could adversely affect the Open Space plan
and zoning ordinance of the City now under consideration.
AND BE IT FURTHER P.ESOLVED AND ORDERED that based upon the findings
hereinbefore set forth, the permit prayed for is denied. without prejudice.

of the City of Tiburon held on
March 12th, 1973, by the following vote:
