RESOLUTION NO.-1QL
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
FINDING TlUIT A STRUCTURE LOCATED AT 7 CORTE LAS CASAS
IS A PUBLIC NUISANCE AND ORDERING ITS ABATEHENT.
WHEREAS: that certain structure located in the easterly sideyard on
property at 7 Corte Las Casas, more p~rticularly described as lot 12, Reed1and
Woods Subdivision; appears to constit..,:~ a public nuisance; and
WHEREAS: said structure was erected without a building permit as
~equired by 13-1 of the Tiburon City Code, and
WHEREAS: said structure was located in the required sideyard as shown
on that certain plot plan marked Exhibit 27222-1 dated January 22, 1973 and is
in violation of Section lO-3-n of Ordinance No.9 N.S., the Zoning Ordinance of
the City; and
WHEREAS: notice was duly given and the property posted in accordance
with Section 24-3 of the Tiburon City Code; and
WHEREAS: the construction is found to be in violation of the provisions
and requirements of the Ordinance No. 9 N.S. and is therefore construed to be a
public nuisance as setforth in Section 27 (D) of said ordinance;
Nrn~ THEREFOP~ BE IT RESOLVED that the City Council of the City of Tiburon
does declare the structure to be a public nuisance and does hereby order its
abatement by its demolition or relocation as determined by the City Manager in
accordance with the provisions as set forth in Section 24-5 of the Tiburon City
Code, and does order that the costs of abatement shall be assessed upon the
property on which the structure is located. and shall constitute a lien upon the
property until paid.
PASSED AND ADOPTED at a regular meeting of the City Council held on
January 22nd
