ORDINANCE NO. 253 N. S.
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF
TIBURON APPROVING THE MASTER PLAN FOR
TIBURON BOULEVARD FROM BEACH ROAD TO MAR WEST
BE IT ORDAINED by the Town Council of the Town of Tiburon as follows:
Section 1. Findings.
1. The Town Engineer has prepared a Master Plan for Tiburon Boulevard
proposing improvements from Beach Road to Mar West.
2. The Master Plan consists of plans prepared by the Town Engineer
identified as Tiburon Boulevard Downtiown Master Plan "B", revised October 1,
1981 .
3. Article 8, Categorical Exemptions of the California Environmental
Quality Act provides in Section 15101 (C) that the operation, repair,
maintenance or minor alterations of existing public structures including
existing highways and streets is categorically exempt and therefore will not
have a significant effect on the environment.
4. The Planning Commission has reviewed the Master Plan, has held a
public hearing and recommended approval of the Tiburon Boulevard Master Plan
to the Town Council.
5. The Town Council has held a public hearing on the Master Plan and has
considered the recommendations of the Planning Commission and the public.
6. The Town Council has made findings required by Section 10-10 (E) of the
Zoning Ordinance relating to Master Plans.
Section 2. Approval.
The Master Plan described above is approved subject to the conditions
set forth herein.
A. A Precise Development Plan will be prepared for review and approval by
the Planning Commission and Town Council.
B. The Precise Plan contain a total of 44 parking spaces which is the
number of parking spaces presently existing.
Section 3. Separability.
If any section, sentence, subsection, clause or phrase of this Ordinance
is for any reason held to be invalid or unconstitutional by a decision of a
court of competent jurisdiction, such decision shall not affect the validity of
the remaining portions of the Ordinance. The Town Council of the Town of
Tiburon hereby declares that it would have passed this Ordinance, any section,
subsection, sentence, clause or phrase thereof, irrespective of the fact that
anyone or more other sections, subsections, sentences, clauses or phrases may
be declared invalid or unconstitutional.

Section 4. Effective date.
This Ordinance shall take effect and be in force thirty (30) days after
the date of passage and before the expiration of fifteen (15) days after its
passage, the same shall be published with the names of the members voting for
and against the same at least once in a newspaper of general circulation,
published in the Town of Tiburon.
