ORDINANCE NO. 246 N.S.
AN ORDINANCE OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON APPROVING THE MASTER/PRECISE
PLAN AND TENTATIVE SUBDIVISION ~~P FOR THE
TOWN OF TIBURON ON REED RANCH ROAD
BE IT ORDAINED by the Town Council of the Town of Tiburon
as follows:
Section 1. Findings.
A. The Planning Commission has received and considered
the Master/Precise Plan and Tentative Map submitted by the
Town of Tiburon, to subdivide a 60 acre parcel into two
residential parcels and one open space parcel on Reed Ranch
Road.
B. The Planning Commission has found that the use is
in conformance with the intent of the General Plan of the
Town of Tiburon.
C. The Planning Commission has made a-firmative findings
consistent with the standards required in Section 10-4 of the
Tiburon Zoning Ordinance dealing with the RPD-l (Residential
Planned Development and Open Space Zone).
D. The Planning Commission has found this subdivision to
be categorically exempt from the California Environmental
Quality Act per Section 15115, Class 15; Minor Land Division.
1. Applicant comply with all applicable sudvision
regulations.
2. All utilities to be underground and service be
guaranteed by the agencies providing the utilities
in writing prior to recordation of the Final Map.
3. Applicant satisfy the requirements of the Tiburon
Fire Protection District as may be required by
the District.
4. Applicant submit all proposed deed and title restriction
including scenic easements and offers of dedication
to the Department of Community Development for review
and approval by the Town Attorney prior to filing of
the Final Map.
5. No building or grading permits be issued for the
construction of any structures until the structures
have received site plan and architectural review
by the Board of Adjustments and Review.
6. All requirements and standards including, but not
limited to, drainage, grading, soils and traffic
shall be subject to review and approval by the Town
Engineer.
7. All construction shall be contained within the area
identified as "building envelope" on the Tentative
Map, and a note to that effect shall be placed on
the Final Map.
8. Any surplus funds derived from this subdivision will
be redeposited in the Town1s restricted Open Space
Fund, and will not be used for general operating
expenses.
Section 2. Separability.
If any section, sentence, subsection, clause or phrase
of this Ordinance is for any reason held to be invalid or
unconstitutional by a decision of a Court of competent
jurisdiction, such decision shall not affect the validity of
the remaining portions of the Ordinance. The Town Council of
the Town of Tiburon hereby declares that it would have passed
this Ordinance, any section, subsection, sentence, clause or phrase
thereof, irrespective of the fact that anyone or more other
sections, subsections, sentences, clauses, or phrases may be
declared invalid or unconstitutional.
Section 3. Effective Date.
This Ordinance shall take effect and be in force thrity (30)
days after the date of passage and before the expiration of
fifteen (15) days after its passage, the same shall be published
with the names of the members voting for and against the same.

in the Town of Tiburon.
PASSED AND ADOPTED at a regular meeting of the Town
Council of the Town of Tiburon on July 1, 1981, by the
following Vote:
