ORDINANCE NO. ~.S.
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF
TIBURON AMENDING THE CIBRIAN MASTER PLAN FOR THE
DEVELOPMENT OF 18 ACRES OF LAND OFF TAYLOR ROAD
AND PARADISE DRIVE
The Town Council of the Town of Tiburon does ordain as follows:
Section 1. Findings.
A. Chahrestani Trust acting through its representative Abbass Barzgar
(Applicant) has prepared a Master Plan for the development of approximately
18.5 acres of land off Taylor Road and Paradise Drive.
B. The Town Council has approved the Master Plan through the adoption
of Ordinance No. 228 N.S.
c. The Town Council finds that an amendment to the Master Plan is
appropriate.
D. The applicant has proposed to resolve an existing problem with the
water pressure system not only on the applicant's property but within the
existing neighborhood.
E. The Town Council finds that upgrading the water pressure will add
to the health, safety and welfare of the residents in the area.
F. The applicant has represented that they will construct or have
constructed a 100,000 gallon water tank and piping system to the satisfaction
of the Marin Municipal Water District.
G. Based on the input from public hearings, the Town Council has been
convinced that the subdivision will not have an adverse traffic impact on the
intersection of Paradise Drive and Taylor Road so long as the conditions of
approval contained in the original Ordinance and as modified herein are
satisfied.

BE IT ORDAINED by the Town Council of the Town of Tiburon that Ordinance
No. 228 N.S., Section 2, Approval, be amended as follows:
A. Condition F shall be deleted and replaced with the following Condition
F:
Applicant shall construct to the standards of the Marin Municipal
Water District, a lOO,OOO gallon water tank and piping system as
generally identified on drawings prepared by the Marin Municipal
Water District which will be sufficient to serve the domestic and
fire fighting needs of the neighborhood. The location of the water
tank shall be in conformity with the requirements of the Marin
Municipal Water District and the Town of Tiburon.
1. In the event that physical construction of the water tank is
delayed and recordation of the Final Map is requested, the
following will satisfy the requirements of Condition F.

a. Applicant post cash, bond or other
instrument satisfactory to the 'fown and Water District
to guarantee the construction of the water tank; and
b. Applicant construct the necessary improvements to
guarantee adequate water pressure as set forth in
the letter from Ronald Theison, Acting Marin Municipal
Water District General Manager, to the Town Engineer,
dated June 25, 1980.
B. Conditions M and N shall be deleted.
PASSED AND ADOPTED at an adjourned meeti ng of the Town Counci 1 of the
Town of Tiburon on May 11 , 1981 by the following vote;
