AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF TIBURON APPROVING THE MASTER PLAN FOR 21
MAIN STREET
ORDINANCE NO.
Be it ordained by the Town Council of the Town of Tiburon
as follows:
Section 1 Findings
a. A Master/Precise Plan has been submitted by Milton
McDonogh for the construction of four portable units
(6 ft. x 8 ft.) to be used as a ticket office and
three storage structures located on the dock at 21
Main Street.
b. The proposal does not have a significant effect on
the environment and therefore is categorically exempted
under Section 15111 of the California Environmental
Quality Act of 1970.
c. The Planning Commission has held a duly noticed public
hearing for the purpose of reviewing the application
and receiving comments and recommendations from the
public and has recommended approval of the Master Plan
to the Town Council.
d. The Town Council has held a duly noticed public hearing
for the purpose of reviewing the application and receiving
public comments and the recommendation of the Planning
Commission.
e. The Master/Precise Plan as conditioned herein satisfies
the requirements of Section 10-10 of the Tiburon Zoning
Ordinance.
f. The Master/Precise Plan as conditioned herein conforms
to the Town's Downtown Plan and General Plan.
Section 2 Approval
A. The Master Plan is approved on the following terms
and conditions as modified herein:
1. The two portable structures be allowed for construction,
one to be used as a ticket booth and neither structure
to exceed 8 feet in total height. The booths should be
located in an area which would minimize the blocking of
waterfront views.
2. That structures for storage should be located adjacent to
the railing on the west side facing the professional
offices. Such structures should not exceed the height
of the railing (approximately 4+ ft.) and should incorporate
bench seating into the design.
3. That the structures include safety features preventing free

movement and are constructed to the satisfaction of the
Town's Building Official.
4. That design plans and location for the portable ticket
booth and storage structures are reviewed and approved
by the Board of Adjustments and Review.
5. That the applicant submit the required information, site
plan and design drawings to B.C.D.C. for review and approval.
6. A gate shall be installed in the fence between the ferry
dock and Sabella's to ensure pedestrian passage along the
waterfront and the gate shall be kept open during the hours
of 10:00 AM and 5:00 PM, minimum.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Tiburon on April 15 , 1981, by the following
vote:
