ORDINANCE NO. -2tW ~l. S.
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF
TIBURON APPROVING A MASTER PLAN FOR TIBURON
WEST OFFICE BUILDINGS
BE IT ORDAINED by the Town Council of the Town of Tiburon as follows:
Section 1. Findings.
A. A Master Plan has been submitted by Ron Nunn Associates, Inc. for the
development of 64,874 sq. ft$ of land at the intersection of Mar West and
Tiburon Boulevard.
B. The Master Plan is described as follows:
1. Maps entitled Sheet 1, Tiburon West Offices (illustrative site plan)
Sheet 2, Tiburon West Offices (schematic site plan), Sheet 3,
Tiburon West Office Buildings (floor plans and elevations) all
dated January 28, 1981.
2. Geotechnical investigation Tiburon West Office Buildings, Tiburon
California prepared by Don Hillebrandt Associates, Geotechnical
Consultants, dated December 11, 1980 (project 225-8).
3. Drainage and utility information identified as Tiburon West Master
Plan, prepared by Kenneth A. Frost, consisting of 2 page text, one
page hydrologic study, small drawing identified drainage and utility
plan, and large map identified topographic map.
4. Written information prepared by Ron Nunn Associates identified as
I'Master Plan approval submittal, Tiburon West Office Buildings,1I
consisting of two pages, IIRevisions to Final Environmental Impact
Report for Tiburon West Office projectll, consisting of three pages.
C. An Environmental Impact Report was prepared by Larry Seeman Associates
for a previous project on part of the site presently under consideration for
Master Plan approval.
D. The Planning Commission finds that the original E.I.R. prepared and
certified for the project is sufficient and no additional E.I.R. need be
prepared pursuant to Section 15067 of the California Environmental Quality Act.
E. The Master Plan application was complete on January 5, 1981.
F. The Planning Commission has held a duly noticed public hearing for the
purpose of reviewing the application and receiving comments and recommendations
from the public.
G. The Cornm-ission finds that the facts presented establish that the require-
ments of Subsections A through H of Section 10-10 (E) of the Tiburon Zoning
Ordinance have been satisfied.
H. The Commission finds that the Master Plan as amended and conditioned
herein conforms to the Town's General Plan as well as with other applicable
regulations.

Section 2. ~~~.
The Master Plan described above is approved subject to the conditions
set forth herein.
Section 3. Conditions.
1. Applicant submit a Precise Plan in compliance with applicable provisions
of the Zoning Ordinance.
2. Applicant comply with all applicable subdivision regulations.
3. Applicant comply with all conditions and requirements of the Town
Engineer including but not limited to those outlined in Ilis letter to the
Director of Community Development dated December 29, 1980.
4. Applicant comply with the recommednations outlined in the geotechnical
investigation of Don Hillebrandt Associates in report dated December 11, 1980
except as may be modified by the Town Engineer.
5. All utilities shall be placed underground and service shall be
guaranteed by the agency providing the utilities in writing prior to the
recordation of the Final Map.
6. Applicant satisfy all requirements of the Tiburon Fire Protection
District.
7. Applicant submit all proposed deed and title restrictions to the
Department of Community Development for approval by the Town Attorney prior
to the filing of the final Map.
8. Applicant shall comply with all appropriate mitigation measures as
contained in the E.I.R. prepared by Larry Seeman and Associates, dated
September, 1979 (#78-046) except as may be modified by the Town Engineer or
Tm,,'r. Council during consideration of the Precise Plan.
9. During Precise Plan review, the parking standards for the project may
be modified to provide up at 50% of the required parking spaces to be available
for compact cars if the modification will provide for additional landscaping and
screening of the development.
Section 4!- Sep?rab_ility.
If any section, subsection, sentence, clause or phrase of this Ordinance
is for any reason held to be invalid or unconstitutional by a decision of a court
of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The Town Council of the Town of Tiburon
declares that it would have passed this Ordinance, any section, subsection, sentence
or clause or phrase thereof, irrespective of the fact that anyone or more other
sections, subsections, sentences, clauses or phrases may be declared invalid or
unconstitutional.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Tiburon on March 4, 1981, by the following vote:
