AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF TIBURON APPROVING THE MASTER PLAN FOR THE DEVELOPMENT OF 7.8 ACRES OFF OWLSWOOD ROAD, ASSESSOR'S PARCEL NO. 59-121-03 BE IT ORDAINED by the Town Council of the Town of Tiburon, as follows: Section 1. Findings. A. Jeremy Littman has submitted a Master Plan for the development of 7.8 acres off Owlswood Road in the Town of Tiburon. B .-- The Master Plan is more particularly described and is herein defined as follows: (1) Map entitled, "Master Plan Littman Property by E.H. Hille Architects, Inc., dated 4/21/80, last revision 9/19/80/ C. The Planning Commission (Commission) has reviewed the environmental impact of the project and has found that the project will not have a significant effect on the environment and has recommended a Negative Declaration of Environmental Impact. D. The Commission has held duly noticed Public Hearings for the purpose of reviewing comments and recommendations from the Public and has recommended approval of the Master Plan and Precise Plan. E. The Town Council (Council) has reviewed the environmental impact of the project and finds that the development will not have a significant impact on the environmentt and adopts a Negative Declaration of Environmental Impact. F. The Council has held dult noticed Public Hearings for the purpose of reviewing the Master Plan and recommendations of theCommission and to receive comments and recommendations from the public. G. Council finds that the requiremen-s of subsection 1 through 5 of Section 10.4 of the Tiburon Zoning Ordinance have been satisfied. H. The Council finds that the Master Plan, as amended and conditioned herein, conforms to the Town's General Plan as well as other applicable regulations. Section 2. Approval. The Master Plan described above is approved, subject to the conditions set forth herein. Section 3. Conditions. 1. A Tentative and Final Subdivision Map shall be submitted In accordance with the requirements of the Town Engineer. 2. The applicant shall comply with all conditions and requirements of the Tiburon Fire District. 3. The applicant shall comply with all conditions and requirements of the Town Engineer. 4. All utilities serving the development shall be under- grounded. 5. All utilities shall be guaranteed by the serving district or company in writing prior to the recordation of the Final Map. 6. Each dwelling within the development shall be subject to site plan and architectural approval in accordance with Section 11 of the Zoning Ordinance. 7. The maximum square footage of each dwelling including garages shall be limited as follows: 1. Parcel "B" - 4,832 sq. ft. 2. Parcel "c" - 3,400 sq. ft. 3. Parcel "D" - 4,300 sq.ft. 8. The maximum height of all structures shall not exceed the maximum elevations shown on the approved Precise Plan without specific approval of the Board of Adjustments and Review based on findings by the Board that a higher elevation is justified. 9. Applicant shall offer a pedestrian easement 10 feet in width from Tiburon Boulevard over Owlswood Road and across Parcel "A", the exact alighment to be det~rrnined at the Tentative Map stage. 10. Parcel "A" shall not be subdivided in the future. Applicant shall submit the necessary deed restrictions prohibiting future subdivision to the Town Attorney for review and approval. The documents shall be recorded prior to or concurrent with the filing of the Final Map. 11. The approved pedestrian easement shall be graded and cleared prior to issuance of an occupancy permit for the first residence constructed. 12. Prior to issuance of an occupancy permit for Parcel "C", applicant shall plant large trees or other suitable landscaping along the western property line to maximize privacy of the Smith and Thea residences. :13. Any new retaining wall within this development shall be poured, textured, colored concrete and follow the natural contour of the land and is subject to Design Review and Town Engineer approval. 14. The fence along the Thea property may increase in height without a variance, subject to Board of Design Review approval.
