ORDINANCE NO. ll89, AS AMENDED, ENTITLED THI
"BUILDING ORDINANCE", AND DECLARING THIS O~-
DINANCE AN EMERGENCY MEASURE TO TAKE EFFEC~
IMMEDIATELY.
The City Council of the City of Tiburon does ordain as
follows:
Section 1. INCORPORATION BY REFERENCE: Ordinance No.
ll89, of Marin County, Calltornla, as amended to date of the
introduction hereof excepting, however, Section 8:00 of said
Ordinance, known as the "Building Ordinance", is hereby
adopted by reference as an ordinance of the City of Tiburon.
Three certified copies of said County Ordinance are on file
with the City Clerk. Three certified copies of the following
codes which are adopted by reference by said County Ordinance,
and by this City Ordinance, shall be kept on fire for use and ex-
amination by the public in the office of the City Clerk of
Tiburon.
(A) Uniform Building Code, 1964 Ejition, published by
the International Conference of Building Officials
(B) Uniform Plumbing Code, 1961 Edition, published by
the Western Plumbing Officials Association
(C) National E~ectrical Code, 1962 Edition, published
by the National Board of Fire Underwriters
(D) The Fire Prevention Code, 1962 Edition, published
by the National Board of Fire Underwriters.
Ordinance No. 1358 of Marin County, California, amending
the said National Electrical Code, 1962 Edition, is hereby
adopted by reference as an ordinance of the City of Tiburon.
Three certified copies of said county ordinance No. 1358 are
on file with the city clerk.
Section 2. DEFINITIONS:
(A) "County"-and "County of Marin" shall mean "City"
and "City of Tiburon", respectively. .
(B) "Board of Supervisors" and "Marin County Board of
Supervisors" shall mean "City Council" and "Tiburon City
Council", respectively.
(C) "Unincorporated area of the County of Marin" shall
raec:.n "Incorporated area of the City of Tiburon".
(D) "Uniform Building Code, 1961 Edition" shall mean
"Uniform Building Code, 1964 Edition".
(E) All other references to Boards, Departments, officer~
agents or employees of the County of Marin shall be construe~
to refer to their counterparts performing the same or simile:
functions for the City of Tiburon, including any county boarac
etc., so functioning DY arrangement between the County and th~
City,
Section 3. PENALTIES FOR V IOLATIOl:,.
(A) Any person, tlrm or corporatlon violating any of tD~
provisions of this ordinance shall be deemed guilty of a separat:::
offense for each and every day or portion thereof during whic:
any violation of the provisions of this ordinance is committe~
continued or permitted anG upon such conviction of any suc~
violation such person shall be punishable by a fine of not mor~
than $500.00 or by imprisonment for not more than six montns
or by both such fine and imprisonment.
(B) For purposes of uniformity, this section shall D~
deemed to supercede any of the penalties provided in th~
respective codes referred to in this ordinanc~,
Section 4. NOT RETROACTIVE: This Ordinance is no~
retroactive and shall not lnvalldate or render unlawful any ac~
covered by this City Ordinance which had been previously approvec
and authorized under said Ordinance No. 1189 of the County of
Marin, as amended, prior to the incorporation of Tiburon, nor
shall it reject, revoke, or invalidate any licenses, inspections:
permits, recommendations, confirmations, authorizations, or
approvals heretofore obtained under such Ordinances and regu-
lations applicable thereto. In all cases, however, conditionE
and limitations previously imposed under such Ordinances anc
regulations shall continue in full force and effect. Any
procedures heretofore commenced under said Ordinances and regu-
lations applicable thereto shall be completed pursuant to
the comparable provisions of this City Ordinance as though com-
menced hereunder from their inception, and any portions of such
procedures which were completed prior to the effective date of
this Ordinance shall be considered compliance with the com-
parable procedures specified herein, provided, that any action
thereunder to be taken by the Marin County Board of Supervisors
shall be taken hereafter by the Tiburon City Council.
Section 5. ENACTMENT: This ordinance is hereby declared
to be temporary and an urgency measure, to take effect immediately
upon its adoption, such urgency being the immediate need within
the rapidly growing and changing area of the newly incorporated
city for application of comprehensive building regulations, which
will continue in effect and preserve the continuity of those
previously applicable to the area under County administration
until the City Council has had the opportunity to study, prepare
and adopt comprehensive regulations of their own. Said Council
intends to conduct studies as soon as possible, and within a
reasonable time, for the purpose of the adoption of such new
regulations"but in the interim such continuity of regulation
is deemed by the Council necessary for the immediate preservation
of the public peace, health and safety. This ordinance shall
be posted in three public places within the City as designated
by Council resolution.
PASSED and ADOPTED at a meeting of the City Council of
the City of Tiburon on the 23rd day of June, 1964 by the fol-
