AN ORDINANCE OF THE CITY OF TIBURON PROHIE::-
ING THE OBSTRUCTION OR DIVERSION OF WATET
COURSE~
The City Council of the City of Tiouron Goes ordain a:

Section 1. It shall be unlawful for any person to Gum~
or place, or to permit to be dumped or placed, deposted, maJc:-
tained or accumulated in any natural water course on public c:-
private property any debris, garbage, rubbish, trash, brus-:..
timber, dirt, fill, rocks, waste piles, or any other commodit;
whatsoever which obstructs, prevents, diverts, or tends to 0[-
struct, prevent or divert the normal, natural or ordinary fJ.O'i
of water in such water course; provided, however, that nothin~
contained herein shall be deemed to prohibit the improvement OY
realignment on private property of any natural water course so
as not to obstruct, prevent or divert the natural flow of water
in such water course at .its point of entry onto or exi!" from
such private property.
Section 2. Any violation of this ordinance shall con-
stitute a m~sdemeanor and any person violating the same shall,
upon conviction thereof, be subject to a fine not to exceed
Five Hundred Dollars ($500.00) or by six (6) months imprisonment
in the County Jailor by both such fine and imprisonment.
Section 3. This Ordinance is required for the immediate
preservation of the public peace, safety, general welfare and
convenience of the City of Tiburon and its residents, and the
following is a statement of facts constituting such emergency:
The City has recently become incorporated and finds it
necessary for public safety and health to make provisions pro-
hibiting the obstruction or diversion of water courses, and at
the present time no such provisions have been made.
Section 4. This Ordinance shall become effective imme-
diate ly.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tiburon on the 23rd day of June, 1964,
by the following vote:
