HomeMy WebLinkAboutTC Ord 1964-09-14 ORDINANCE NO. yV' AN EMERGENCY INTERIM ORDINANCE OF THE CITY OF TIBURON EFFECTIVE IMMEDIATELY AND REGULATING THE USE OF LAND AND BUILDINGS, PROVIDING FOR THE ISSUANCE OF PERMITS, PROVIDING FOR ENFORC~lENT, AND PROVIDING PENALTIES FOR VIOLATIONS The City Council of the City of Tiburon does ordain as follows: Section 1. INTERIM ZONING ORDINANCE. Under the authority of the provisions of Section 65806 of the Government Code of the State of California, there is hereby adopted a temporary interim zoning ordinance governing the use of all land and buildings in the City of Tiburon except those certain portions of the City presently zoned in classifications "R_lll and llA_2". Section 2. URGENCY MEASURE. This ordinance is an urgency measure and is hereby declared to be of a temporary nature. The City has only recently been incorporated and the City Council finds that adequate and comprehensive zoning ordinance laws, regulations, and a general plan, are needed in those certain areas of the City affected by this ordinance; that said adequate and comprehensive laws, regulations and plans do not now exist. The City Council further finds that such zoning laws, regulations and plans are necessary to provide the control necessary for proper planning and to prohibit the use of land, buildings and structures in a manner contrary to the public peace, health, safety and general welfare of the residents of the City; that a comprehensive study of the entire situation with respect to said portion of the City is necessary. The City Council further finds that the City Planning Commission intends, in good faith, to conduct studies, and hold hearings, within a reasonable time, for the purpose of recommending to the City Council the adoption of a new zoning ordinance and amended general plan for the areas of the City affected by this ordinance. The City Council -1- further finds that preparation of said adequate and comprehensive zoning laws, rules, regulations and plans will require a period of time of sufficient duration that the public peace, health, safety and general welfare would be threatened without the en- actment of this interim ordinance. Section 3. USE PEru~IT REQUIRED. No new use of land, buildings, or structures shall hereafter be established during the term of this interim ordinance in any portion of the City of Tiburon, excepting however those certain areas of the City presently zoned in classification "R_l" and "A_2", without a use permit having been issued therefor 'lnder this ordinance. Section 4. APPLICATION FOR PERMIT. A use permit shall not be issued pursuant to the provisions of this ordinance until the issuance of said permit has been approved by the City Plan- ning Commission and the City Council. Section 5. PERMIT ISSUED BY DEPARTMENT OF LANDS AND IM- PROVEMENTS. All use permits hereunder shall be issued by the City of Tiburon, Department of Lands and Improvements. Section 6. Any person, firm, or corporation, whether as principal, agent, employee, or otherwise, violating or causing the violation of any of the provisions of this ordinance, shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than five hundred dollars ($500) or by imprisonment for a term not exceeding six (6) months, or by both such fine and imprisonment. Such person, firm or corporation shall be deemed guilty of a separate offense for each and every day during any portion of which any violation of this ordinance is committed, continued or permitted by such person, firm or corporation and shall be punishable as herein provided. Section 7. EFFECTIVE IMMEDIATELY. This ordinance will takE: effect immediately as an emergency ordinance, being for ths immediate preservation of the public peace, health, safety anc welfare. The facts constituting such emergency are as hereto- fore set forth in Section 2 hereof. This Ordinance was introduced at a regular meeting of the City Council on September 14, 1964, and was ordered posted in at least 3 public places in the City of Tlburon.
