AN ORDINANCE AMENDING THE CITY OF TIBURO~
SUBDIVISION ORDINANCE TO PROVIDE INCREASEL
LOT SIzr
The City Council of the City of Tiburon does ordain a~
follows:
Section 1. FINDINGS. The City Council of the City 0:
Tiburon does hereby find and declare that the following factE
are true.
(a) Indiscriminate, unplanned and uncoordinated
subdivision of land fails to provide for adequate design, im-
provement and circulation for streets1 fails to assure adequate
design of lots1 fails to promote an integrated land pattern1
impairs the desirability of residence and investment in the
CitY1 fails to attain the optimum use and value of the land~
results in inadequate provision for ingress to and egress from
the said property to be subdivided by failing to take into
consideration the location of the property being developed, and
the City1s unique topography and geography, thus creating
dangerous traffic conditions. That for the reasons afore-
mentioned, and others, indiscriminate, unplanned and unco-
ordinated subdivision of land causes special harm and injury
to the residential, commercial and industrial economy of the
City of Tiburon, and to the general prosperity, health, welfare
and safety of the citizens of Tiburon.
(b) The City of Tiburon just recently incorporated
and the Planning Commission is, in good faith, conducting
studies and is consulting with a professional planning firm
for the pur90se of studying and preparing plans and recommen-
dations leading to the adoption of revised and comprehensive
zoning regulations governing subdivisions.
(c) In order to prevent the destruction of the effect
and purpose of the above studies, it is necessary that the City
of Tiburon Subdivision Ordinance be ammended as herein provided.
(d) This Ordinance is of a temporary nature, to serve
for a period of six months only, unless for
good cause further extended at the end of said period of time
by the City Council.
Section 2. AMENDMENT. Section 2.5(a) of the City of
Tiburon Subdivision Ordinance (Ordinance N~~ber 7 adopting by
reference I~rin County Ordinance No. 640) is hereby amended to

at the discretion of the Planning Commission. I
Section 3. SEVERABILITY. If any section, subsectio~!
sentence, clause or phrase of this Ordinance is for any reason
held by a court of competent jurisdiction to be invalid, such
decision shall not effect the validity of the remaining portions
of this Ordinance. The City Council hereby declares it would
have passed this Ordinance and each section, subsection,
sentence, clause and phrase thereof, irrespective of the fact
that anyone or more be held invalid.
Section 4. APPLICATION. This Ordinance shall apply
prospectively, and shall apply to all applications for approval
of tentative maps presently pending before the City or any
department, commission or official body thereof, which said
tentative maps have not been approved as of the effective date
thereof.
Section 5. EFFEC'rIVE DATE AND EXPIRATION DATEo This
Ordinance shall go into effect immediately upon its adoption as
an ordinance necessary for the immediate preservation of the
public peace, ,health, and safety, and shall expire six
months after the effective date unless further extended prior
to expiration by the City Council.
The facts constituting the urgency and requiring that
this Ordinance become effective immediately are as follows~

The City has only recently been incorporated ana vari-
ous owners of large parcels of land located within the juris-
diction of the City of Tiburon are preparing, or have prepare~r
plans for the development and subdivision of said lands an~
intend to proceed with such development in the immediate fu~urc.
Unless this Ordinance is made immediately effective, tn(
purposes of the City's efforts to study,pr~pare and adop:
sound and comprehensive regulations relating to subdivisions, anc
its efforts to avoid the damages referred to in ~ection 1 (6'
above will be defeated.
~his Ordinance shall be posted in three public piace~
within tne City of Tiburon as previously designated by Counci~
Resolution.
PASSED AND ADOPTED at a meeting of the City Council of
the City of Tiburon on the 23rd day of November, 1964, by the
following vote:
