HomeMy WebLinkAboutTC Ord 1964-11-30 ORD INANCE NO. y[--- AN ORDINANCE AMENDING THE CITY OF 'rIBUROr SUBDIVISION ORDINANCE TO PROVIDE REPORT :S-:.- PLANNING COMr-lISSION OF ITS ACTIONS TO CIT-:..- COUNCIL The City Council of the City of Tiburon does ordain a: follows: Section 1. Under the authority and provisions of Sectior 11552 of the Business and Professions Code of the State 0= California, the governing body of a city may provide that thE advisory agency having jurisdiction over subdivisiom shall report its actions directly to the governing body of the city. Section 2. Section 5.3(d) of the City of Tiburon Sub- division Ordinance (Ordinance Number 7 adopting by reference Marin County Ordinance No. 640) is hereby amended to read as follows: "Planning Commission (d) Within thirty (30) days after the receipt of such map from the subdivider, unless such time is extended by agreement with the subdivider or his agent, the Planning Commission shall meet and con- sider said map, together with all reports pertaining thereto, and shall approve, conditionally approve, or disapprove the same. Said action shall be en- dorsed on the face of the tentative map. In the event that the tentative map is disapproved, the reasons for such disapproval shall be stated in clear and concise terms upon a memorandum permanently at- tached to said map, together with a clear and concise statement of what changes will render the map accept- able. The Planning Commission shall make its report to the City Council, which shall act upon the report within 10 days or at its next succeeding regular meeting after receipt of the report. If no action is taken by the Planning Commission within said thirty (30) 'days, or such longer period as may have been agreed upon, the tenative map shall be deemed approved by the Planning Commission, and shall be so attested by said Commission, and its said action reported to the City Council for action as aforesaid.1t Section 3. This Ordinance shall go into effect immedi- 1. ately upon its adoption as an ordinance necessary for th~ immediate preservation of the public peace, health, and saf~- ty. The facts constituting the urgency and requiring tha~ this Ordinance become effective immediately are as follows~ The City has only recently been incorporated and th~ Planning Commission is, in good faithr conducting studies an~ is consulting with a professional planning firm for the purposE of studying and preparing plans and recommendations leading tc the adoption of revised and comprehensive zoning regulations governing subdivisions. In order to prevent the destruction 0= the effect and purpose of the above studies, and until suer. time as sound and comprehensive regulations governing subdi- visions have been enacted, the public peace, health, and safet~. of the citizens of the City of Tiburon requires review of all subdivision applications by the City Council. This Ordinance shall be posted in three public places within toe City of Tiburon as previously designated by Council Resolution.
