ORDINANCE NO. 2c AN ORDINANCE AMENDING SUBDIVISION ORDINANCE TO PROVIDE 40 DAYS IN WHICH TO CONSIDER SUB- DIVISION MAP The City Council of the City of Tiburon does ordain aE followe: Section l. Section 5.3(d) of the City of Tiburon Sub- division Ordinance (Ordinance No. 7 adopting by reference Mari~ County Ordinance No. 640, as amended) and Ordinance No. 25 are hereby amended to read as follows: "Planning Commission (d) Within forty (40) days after the receipt of such map from the subdivider, unless such time is extended by agree- ment with the subdivider or his agent, the Planning Commis- sion shall meet and consider said map, together with all reports pertaining thereto, and shall approve, conditionally approve, or disapprove the same. Said action shall be en- dorsed on the face of the tentative map. In the event that the tentative map is disapproved, the reasons for such disap- proval shall be stated in clear and concise terms upon a memorandum permanently attached to said map, together with a clear and concise statement of what changes will render the 1__P acceptable. The Plannina Commission shall make its report to the City Council, which shall act upon the report within 10 days or at its next succeeding regular meeting after receipt of the report. If no action is taken by the Planning Commission within said forty (40) days, or such longer period as may have been aireed upon, the tentative map shall be deemed approved by the Planning Coumission, and shall be so attested by said Commission, and its said action reported to the City Council for action as aforesaid. II Section 2. This Ordinance shall go into effect tmmediately upon its adoption as an ordinance necessary for the immediate pre- servation of the public peace, health and safety. The facts constituting the urgency and requiring that this Ordinance become effective immediately are as follows: The City has only recently been incorporated and the Planning ~ission is, in good faith, conducting studies and is consulting with a professional planning firm for the purpose of studying and preparing plans and recommendations leading to the adoption of revised and comprehensive zoning regulations govern- ing subdivisions. In order to properly evaluate proposed 1. subdivision of land within the City it is necessary that thE Planning Commission have additional t~e within which to con- sider proposed subdivisions. This Ordinance shall be posted in three public place~ within the City of Tiburon as previously designated by the Cou~- cil Resolution.
