AN URGENCYORDIJIl\NCE OF THE CITY OF TIBURON AMENDING
ORDINANCE NO. 9 N. S., THE TIBURON ZONING ORDINANCE, BY
PROVIDiNG FOR ISSUANCE OF TEMPORARY USE PERMITS FOR
PARKING LOTS IN THE PlANNED DEVELOPMENT ZONE
Ihe City Council of the City of Tiburon does ordain as follows:
Section 1. Amendment. Section 10-10 of Ordinance No.9 N.S. is hereby
amended by adding thereto Subsect~on (J), to read as follows:
'~(J) Temporary Use Permit for Parking Lot:
Notwithstanding anything contained elsewhere hereinabove, the
City Council may, upon application duly made, authorize the issuance of
a temporary Use permit for a period not to exceed one (1) year, for the
uee .of land located in a Planned Development Zone as a parking lot, as
folloWs:
1. Application for a temporary use permit shall be. filed with
the . Development ~cbDin1strator on such form as may be provided by said
Administrator, accqmpanied by a site plan and a fee of $40.00, no part of
wh~ch may be refunded. When the applicant ,is not the owner of the property,
the written authorization of the owner shall accompany the application.
2. Within thirty (30) days after the filing of the application
with the Development Administrator, the City Council, shall hold a hearing
on the application at a regular or special meeting. Failure of the City
Council to make a decision within tbirty (30) days after tbe hearing shall
constitute a denial of the application.
3. All permits granted hereunder shall expire and become null
and void one (1) year after the date said permit is granted, unless the
permit provides that it is for a lesser Period of time. the permit shall
run with the land unless otherwise provided.
4. In considering an Application filed hereunder the City
Council shall give due regard to the necessity of encouraging use by
residents of off-street parking facilities, to the need for regul~~ing
the character and standard of off-street parking, and to, the nature aDd
condition of all adjacent uses of land and structures and shall, before
granting any such temporary permit, make a finding that approval would
not be detrimental to the health, safety, peace, morals, comfort, or
general welfare of persons or property in the City, and shall further
find that public necessity and welfare require the proposed temporary
use.
5. The City Council may impose such requirements and condi-
tions vith respe~t to location, design, landscaping, ligh~lng, siting,
maintenance and operation as may be reasonably deemed necessary for the
protection of other property in the vicinity, and for the purpose of
carrying out the provisions and standards set forth in this Subsection (.1).
Non-compliance with such terms and conditions as may be imposed shall con-
stitute good cause for the revocation of said permit after notice aDd
hearing. Revisions of the terms or conditions of the permit shall re-
quire a new permit.
6. No permit granted under ~his Subsection (J) shall authorize,
or be deemed to have authorized, the.erection, construction, or maintenance
of .any permanent ..improvement of any kind or character.
7. Permits granted hereunder may be renewed from time to time
by the City Council, upon application therefor, but no such extension
shall be for a period in excess of one (1) year at anyone time."

Section 2. Effective Date. this ordinance is hereby declared to be an
urgency measure and shall be in full force and e~fect immediately upon its
adoption. Within fifteen (15) days after adoption, this ordinance shall be
published, with the names of the ~er~ voting for and against the same, at
least once in a newspaper of general circulation published in the City of
Tiburon. the conditions constituting such urgency are as follows: The matter
of off-street parking, and the efficient, safe and proper operation thereof,
is of grave concern to the City of Tiburon,:. The number of vehicular parking
spaces available on the streets and other public areas in the downtown area
of the City are not sufficient or adequate to meet the needs of the City's
residents and visitors. The 1ncr~se and flow of vehicular traffic into the
shopping areas of the City, coupled with the increase4 use of the downtown
ferry sH.p, from which COJIIDuters travel to and from San Francisco, and the
fact that several on-street parking spaces were recently lost as ~be result of
the converSion of certain pa;rts of Tiburon Boulewrd..fram angl~ .to. paJ."allel
parking, has created an urgent need for additional parking space in the down-
town area. '!he need for adequate parking has also become acute on weekends
as the result of a sudden increase of tourist traffic visi~ing tbe many sbops,
restaurants and scenic areas of the City. For the above reasons, the City
Council finds that the immediate operation of this or4iaance 18 necessary for
the immediate preservation of the public peace, health, safety and welfare.

of Tiburon held on June 24 , 1968, by the following vote:
