ORDINANCE NO. 60
AN ORDINANCE OF THE CITY OF TIBURON
AMENDING ORDINANCE NO. 39
The City Council of the City of Tiburon does ordain as follows:
Section 1. AMENDMENT.
Section 2 of Ordinance No. 39 of the City of Tiburon is hereby
amended to read as follows:
"Section 2. DEFINITIONS.
(a) "Instrument" means any loudspeaker, sound ampli-
fier, radio receiving set or other machine, device, apparatus
or instrument, for intensification or amplification of the
human voice, music, sound or noice, which is cast upon the
pub lic streets. "Instrument' also means any mus ical ins tru-
ment, drum or phonograph, or any apparatus, instrument, ma-
chine or device for the producing or reproducing of sound,
the sound from any of which is cast upon the public streets.
(b) "Person" shall include corporations, associations,
syndicates, partnerships, joint stock companies, clubs, trusts,
societies and individuals.
(c) The term, !lcast upon the public streets", as used
herein, is defined as noise or sound which is plainly audible
at a distance of fifty (50) feet from the exterior of the
building or structure in which an instrument is located."
Section 2. SEPARABILITY.
It is the intention of the City Council that each separate pro-
vision of this ordinance shall be deemed independent of all other
provisions herein, and it is further the intention of the City Council
that if any provision of this ordinance be declared to be invalid,
all other provisions thereof shall remain valid and enforceable.
Section 3. EFFECl'IVE DATE.
This ordinance is to take effect and be in force at the expira-
tion of thirty (30) days from and after its passage, and before the
expiration of fifteen (15) days after its passage the same shall be
published, with the names of the members voting for and against the
same, at least once in a newspaper of general circulation published
in the City of Tiburon.
PASSED and ADOPTED at a regular meeting of the City Council of
the City of Tiburon on 11 July , 1966, by the following
vote:
