The City Council of the City of Tiburon does ordain as follows: Section 1. FINDINGS. The City Council of the City of Tiburo~ does hereby tInct anacrecTare that the following facts are trul2: (a) That th~ City of Tiburon was incorporated on Jun~ 23, 1964, and adequate and comprehensive zoning ordinancds and regula- tions have not yet been adopted for the necessary control and regula- tion of the use of land, buildings and structures, which said ordi- nances and regulations are necessary for th~ preservation of the public health, peace, safety and general welfare of the residents of said City. (b) That the Planning Commission is, in good faith, and as expeditiously as possible, conducting studies and holding hearings for the purpose of preparing and recon~ending to the City Council per- manent ordinances and regulations relating to zoning. The Planning Commission has retained professional consultants to assist in the preparation and study of proposed amendments to the General Plan. (e) That on September 14, 1964, and pursuant to Section 65806 of the Government Code of the State of California, the City adopted inter~ zoning ordinance No. 22; that on September 13, 1965, the City adopted interim zoning ordinance No. 40, which said ordinance amended S~ction 4 of Ordinance No. 22 and extended Ordinance No. 22 for one year fronl and after September 14, 1965. (d) That to permit sufficient time for the Planning Com- mission and the City Council to receive, examine, and act upon the reports and recommendations of consultants, and to hold public hear- ings and conduct studies for th<2 purpose of adopting permanent ordi- nanc.as and regulations pertaining to zoning, it is necessary that the effect of the aforesaid interim zoning ordinance No. 22, as amended by Ordinance No. 40, be extended for a period of one (1) year pur- suant to the provisions of Section 65858 of the Government Code of the Stat<2 of California. Section 2. JXT8NSION. Ordinance No. 22, as amended by Ordi- nance No. 40, shoula-oe-ana-is hereby immediately extended for a per- iod of one (1) year from and after September 14, 1966. Section 3. ST1\Till\1ENI' OF URGENCY. In order to provide for the imnediate preservat~on ot the pub11C peace, health and safety, which would be jeopardized were the aforesaid ordinance permitted to lapse, thereby depriving the City of any regulations of the d-;Nelopment or use of lands, and frustrating the purposes and objectives of the studies and programs now being conducted in good faith by the Planning Commission and City Council of the City of Tiburon, it is necessary that this ordinance be adopted and take effect immediately as per- mitted in Section 36937 of thl.;;! Gov\:!rnment Code. Section 4. SEPARABILITY. If any section, subsection, sentence, clause or phrase of~is ord1nance is for any reason held to be in- valid or unconstitutional by the decision of any court of competent juriSdiction, such decision shall not affect the validity of the r~- maining portions of the ordinance. The City Council of the City of Tiburon, State of California, hereby declares that it would have passed this ordinance pnd each section, subsection, sentence, clause 1. and phrase thereof, irrespective of th~ fact that any on~ or mor,,", othdr sections, subsections, clauses or phrasdS be declared invalid or unconstitutional. Section 5. PUBLlalTION. Before the expiration of fift~~n (15) days atter the-aaoptfon-Df this ordinance, the samd shall b2 published with the names of the merllbers voting for and against thE; same, at least once in a newspaper of general circulation published in the City of Tiburon.
