P,N URGENCY INI't:RIM ORDINJ\NCE OF THE CITY OF
TIBURON EXTENDING ORDINANCE NO. 58 FOR ONE YEAR
The City Council of the City of Tiburon does ordain as follows:
Section 1. Findings. The City Council of the City of Tiburon
does hereby t1nd and declare that the following facts are true:
(a) . The City of Tiburo~ wa~ in:orporated.only ~~eeren
months ago and the Planning Commiss1on 1S, 10 good fa1th, and as expe-
ditiously as Poss~ble, co~duc~ing.stud~es for tRe purp~se of prepar-
ing and recommend1ng to the C1ty Counc1l permanent ord1nances and,
regulations relating to zoning. The Planning Commission has r~ta1ned
professional planning consultants, and a report b~ a duly'apP01nt~d
citizens committee is in the process of presentat1.on to the Plann1ng
COIInuis s ion.
(b) On or about June 27, 1966, and pursuant to Section
65858 of the Government Code of the State of California, the City
adopted interim zoning ordinance No. 58. Said ordinance would expire
ninety (90) days from and after its effective date.
(c) To permit sufficient time for the Planning Commis-
sion and the City Council to receive, examine and act upon the recom-
mendations of said Planning Canmission and said citizens committee
relating to permanent zoning ordinances and land use regulations, it
is necessary that the effect of the aforesaid interim zoning ordinance
be extended for a period of one (1) year pursuant to the provisions
of Section 65858 of the Government Code.
Section 2. Extension. Ordinance No. 58 should be and is
hereby unmed1ately extended for a period of one (1) year from and
after September 26, 1966.
Section 3. Statement of Urgency. In order to provide for the
immediate preservat10n ot the public peace, health and safety which
would be jeopardized were the aforesaid ordinance permitted to lapse,
thereby depriVing the City of any regulation of the development or
use of lands, and frustrating the purposes and objectives of the
studies and programs now being conducted in good faith by the Planning
Commission and the City Council of the City of Tiburon, it is neces-
sary that this ordinance be adopted and take effect immediately as
permitted in Section 36937 of the Government Code.
Section 4. Separability. If any section, subsection, sentence,
cla~se or phrase of this ord1nance is for any reason held to be in-
~a11d or unconstitutional by the decision of any court of competent
Ju~isdiction? such decision shall not affect the validity of the re-
~1ning port1ons of the ordinance. The City Council of the City of
T1buron, State of California, hereby declares that it would have
paSsed this ordinance, and each section, subsection sentence
clause and phrase thereof, irrespective of the fact 'that any ~ne or
more other sections, subsections, clauses or phrases may be declared
invalid or unconstitutional.
Section 5. Publication. Before the expiration of fifteen
(15) days atter the adopt10n of this ordinance the same shall be

same, at least once in a newspaper of general circulation published
in the City of Tiburon.
PASS~D AND ADOPTED at a meating of the City Council of the
City of Tiburon on 26 September , 1966, by the following
