AN ORDINANCE OF THE CITY OF TIBURON ADDING ART ICLE IV TO CHAPTER 2 OF THE T IBURON CITY CODE, BY ESTABLISHING A PARKS AND P~CREATION COMMISSION AND SETTING FORTH ITS DUTIES AND .~urHORITY_._ .~. The City Council of the City of Tiburon does hereby ordain as follows: Section 1. Amendment. The Tiburon City Code is hereby amended by adding Article IV to Chapter 2 thereof to read as follows: "Article IV. Parks and Recreation Commission Section 2 - 19. Establishment of Commission. There is hereby established a Parks and Recreat1on--Comm1ssion for the City of Tiburon, hereinafter referred to as the "Commission". Section 2 - 20. Compos it ion i Appointment and Removal of Members. The ComiDI'S'Sion shall cons1st or seven members, all of whom shall be appointed by the Mayor with the approval of the City Council, and who may be removed for reasonable and just cause by a majority vote of the City Council. All vacancies shall be filled for the uneJtpired terms of the member t"1hose office is vacant in the same manner es such member received the original appointment. Section 2 - 21. Terms of Office of Members. The terms of office or-the members of the CO~~iss10n shall be four years, which terms are deemed to have expired on the date of the annual meeting of the Commission falling within the fourth year of the term, or until their successors shall have been nppointed. Section 2 - 22. Annual MeetinR. The annual meeting of the Commission shall be held on the date of the first regular meet- ing of the Commission in July of each year. At the ennual meeting, the Commission shall elect its officers for the ensuing year, and shall p=epare a report of the preceding year's activities of the Commission, which report shall be spread on the minutes of the Commission and thereafter trans- mitted to the City Council for approval. Section 2 - 23. Officers. Procedure. The officers of the Commission shall consist of a Chairman, Vice Chairman, Secre- tary, and such other officers as the Commission deems necessary to discharge its duties. The Secretary need not be a member of the Commission. If the appointed Secretary is not a member of the Commission, he may not cast votes on motions made by the Commission. The Secretary pro tern, if he be a member of the Commission, may, however, cast a vote as a member while acting as Secretary pro tem. The Commission shall, be resolution, adopt by-laws for the conduct of its business, which by-laws shall provide for regu- lar meetings, the time and place thereof, the maintenance of re- cords, the method whereby the by-laws may be emended, and other rules deemed necessary to the precise, equitable and efficient conduct of its business. In the performance of its duties, the Commission may call upon the City Mnnager, and through him, other employees of the City under his direction for advice and assistance; and where the City Council has so provided, upon such consultants as have been retained by the City. Section 2 - 24. Powers and Duties. The Commission shall By draft date: 10/28/70 1. have the following pC.T70.:"~G p.nd duties: (a) The Commission shall consult with and advise the City Council and other boards end commissions of the City with respect to matters which are determined to be within its jurisdiction, or which are referred to the Commission for consideration by the City Councilor other boards or commissions, or which are properly brought to it by mem- bers of the puplic or organizations, and shall make such findings and recommendations thereon as seem fitting and appropriate in the opinion of the Commission. (b) The Co~~ission shall prepare and submit to the City Council n master plan for the acquisition, develop. ment, improvement, and operation of open space, hiking trails, paths, parks, playground and recreation areas, facilities end programs in the City of Tiburon, including programs concerning public recreational and cultural ac- tivities of interest or utility to the citizens of Tiburon. (c) The Commission shall submit recommendations to, and advise, the City Council in all matters of policy per- taining to the creation, operation , maintenance, manage- ment, and control of all parks, playgrounds, community recreation progarms and activities. The Commission shall supervise such plans, programs, and activities as are ap- proved by the City Council. (d) The Co~~ission shall, at least annually, review all ~lans and programs of the City affecting the Commis- sion s jurisdiction, and shall submit proposals for the amendment, expansion or reduction of such plans and pro- grams as, in its judgment, seem appropriate. (e) The Commission shall, prior to May 1st of each year) sub:J.:tt to the City Council a proposed budget for acquisiticn, construction, maintenance, and operation of recreational programs Dnd facilities for the ensuing fiscal year. Section 2 - 25. Funds and Pr~er~. With approval of the City Council, the Comrnisslon may accept-gTfts and bequests on behalf of the City, and may covenant as to the disposition of such gifts and bequests. The Commission shall seek to obtain funds for par~ and recreation purposes from both public and private sources. The Commission may encumber or obligate the City for the expenditure of funds or the providing of services only to the extent delegated and cuth'Jrized by the City Council." Section 2. separabi~ity. If any section, sentence, clause or phrase or this ordinance--fs,~' or any reason, declared to be invalid,. such decision shall not affect the validity of the remaining sections, sentences, clauses or phrases of this ordinance, it being the intent of the City Council of the City of Tiburon that this ordinance shall stand notwithstanding the invalidity of such section, sentence, clause or phrase. Section 3. Effective Date. This ordinance shall take effect and be in-fO'rce tnirty-Gays afterthe date of passage, and before the expiration of fifteen days after its passage the same shall be published, with the names of the members voting for and against the same, at least once in a newspaper of general circulation published in the City of Tiburon.
