ORDINANCE NO. ~N.S.
AN ORDINANCE OF THE CITY OF TIBURON ADOPTING A PD (PlANNED
DEVELOPMENT DISTRICT) MASTER PIAN FOR THE ZEU1ISKY PROPERTY
BE'lWEEN MAIN ST1-:1ET AND JUANITA lANE.
The City Council of the City of Tiburon does hereby ordain:
Section 1. AdoPtion of Plan.
The Master Plan of the Zelinsky Property between Main Street and
Juanita Lane, consisting of Assessor's Farcel Numbers 59-102-03, 04, 06,
10, 11 and 12 is adopted according to the following exhibits and conditions:
EXHIBITS
1. Proposed 11lster Plan of Zelinsky Properties, by Allan Steinau,
Architect, dated 5 June 1969; scale 1" = 50 I.
2. Accompanying text by Allan Steinau, Architect, dated July 9, 1969,
consisting of three pages. except par~2raph 1 of Page 2, which shall be
omitted.
CONDITIONS
1. Approval is general in nature, indicating general location,
sizes, and areas of all land uses. (See Exhibit "C" for
possible alternate execution.)
2. Approval of each phase of development is contingent upon provid-
ing parking as legally required by ordinance.
3. '~ommercial" designation for the structure between City Hall and
the Winery shall be changed to "Offices, II with possible expansion
of wine tasting and sales facilities.
4. A detailed scheme for landscaping and pedestrian circulation through
the parking area to and around affected buildings shall be sub-
mitted with each Precise Plan.
S. With the processing of the first Precise Plan for the pedestrian
'~lock" north of the yacht club/bank corner, a detailed pedes-
trian-plaza scheme shall be submitted indicating staging for
implementation of the proposal.
6. Approval of alteration of exist~~ traffic ingress and egress is
deferred until consideration of its respective phase.
Section 2. Seoarabi1itv.
If any section, subsection, sentence, clause or phrase of this ordi-
nance is for any reason held to be invalid or unconstitutional by the decision
of a court of competent jurisdiction, such decision shall not affect the validity
of the remaining portions of the ordinance. The City Council of the City of
Tiburon hereby declares that it would have passed this ordinance, and each section,
subsection, clause or phrase thereof, irrespective of the fact that anyone or
more other sections, subsections, sentences, clauses or phrases may be declared
invalid or unconstitutional.
Section 3. Effective Date.
This ordinance shall take effect and be in force thirty days after
the date of passage, and before the expiration of fifteen days after its passage
the same shall be published, with the names of the members voting for and
against the same, at least once in a newspaper of general circulation published
in the City of Tiburon.
