'1' day of 19~ . -<? / ~-' ORDINANCE NO o--1L-N.S 0 AN ORDINANCE OF THE CITY OF TIBURON AMENDING SECTION 3-3(d) OF THE TIBURON CITY CODE The City Council of the City of Tiburon does ordain as follows: S ec t ion 1. Amendment. The first sentence of the second paragraph of Chapter 3, Section 3-3(d) of the Tiburon City Code is hereby amended to read as follows: "The annual salary program for the ensuing fiscal year shall be adopted by resolution of the city council no later than July 31 of that fiscal year and shall at all times be applied and operated in conformance with appro- priate personnel regulations.1I Section 2. Separability. If any section, provision, sentence, clause or phrase of this ordinance is, for any reason, declared to be invalid, such de- cision shall not affect the validity of the remaining sections, sen- tences, clauses or phrases of this ordinance, it being the intent of the City Council of the City of Tiburon that this ordinance shall stand notwithstanding the invalidity of such section, sentence, clause or phrase. Section 3. Urgency Measure. This ordinance shall go into effect immediately upon its adoption, the City Council finding that it is required for the immediate preservation of the public welfare and convenience of the City of Tiburon, its employees and residents, for the follow- ing reasons: Since the adopt-ion of the annual salary program is a principal element of the over-all budget of the City, and since budgetary procedures are at such stage of development that the annual salary program cannot meaningfully be evaluated until the budget is at a more advanced stage of development, and smce the consideration of the budget and the annual salary program are so intertwined as to the effect of one upon the other, and since the Tiburon City Code presently requires the adoption of the annual salary program no later than June 15 of the preceding fiscal year, it is necessary that this ordinance become effective immediately, so that the City Council will be able to meaningfully and effectively consider dE annual salary program. Section 4. Publication. This ordinance shall be published before the expiration of fifteen (15) days after its passage, with the names of the members voting for and against the same, at least once in a newspaper of general circulation published in the City of Tiburon.
