A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON
APPROVING AN AMENDMENT TO THE FRAIGE PRECISE PLAIN (PD #31) TO
ADJUST A BUILDING ENVELOPE AND CREATE A LANDSCAPE ENVELOPE ON
PROPERTY AT 5 STEVENS COURT
ASSESSOR PARCEL NO. 058-111-26
WHEREAS, on March 24, 2010 the Planning Commission held a public hearing
to consider the approval of amendment to the Fraige Precise Plan (PD #31) to adjust the
building envelope and create a landscape envelope at 5 Stevens Court; and
WHEREAS, after receiving public testimony and considering the application at
that hearing, the Planning Commission adopted Resolution No. 2010-06 recommending
to the Town Council that the Precise Plan Amendment be approved; and
WHEREAS, on May 5, 2010, the Town Council held a public hearing on this
application and after hearing all testimony and reviewing all documents on the record, the

that the proposed precise plan amendment to amend the building envelope for the
property at 5 Stevens Court would be consistent with the overall intention of the Fraige
Precise Plan and the policies contained within the Tiburon General Plan.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon does hereby approve the requested amendment to the Fraige Precise Plan,
subject to the following conditions:
1. The adjusted building envelope and new landscape envelope for the
property at 5 Stevens Court shall be amended as reflected on the drawing
labeled partial Site Plan - Sheet 1 of 4, prepared by Jeff Gustafson, dated
February 9, 2010.
2. The landscape envelope is for landscape improvements, decks and
stairways. No other structures, other than fences and walls, are permitted
within the landscape envelope (i.e. additions to the dwelling, sheds, etc).
3. This approval shall in no way alter other provisions of the Fraige Precise
Plan not specifically modified herein.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON
