From: Subject: TOWN OF TIBURON 1505 Tiburon Boulevard Tiburon, CA 94920 October 12, 2010 Mayor and Town Council Dan Watrous, Planning Manager I Lighting Complaint at Congregation Kol Shofar 171GE~` it A Last week the Town received a complaint from Samantha Winter regarding the parking lot lighting and lighted sign at Congregation Kol Shofar. Ms. Winter was concerned that the parking lot lights and the lighted sign were on all night, contrary to the requirements of the Kol Shofar conditional use permit. Condition No. 6.A. (Lighting, Parking Lot Lighting, and Landscaping) of the CKS CUP states that ``parking lot lighting shall be on timers to turn off no later than 10:00 pm on weekdays. The duration of lighting may be extended by manual override device when occasions demand, but in no event shall be kept on later than 10:30 pm except for High Holy Days, Selichot, Shauvot, the second night of Passover, or other religious observances, at which times the parking lot lighting shall remain on until no later than thirty (30) minutes after event ending time." Although there is no specific requirement for turning off the lighted sign, the Design Review Board required that a timer be installed for the light illuminating the sign, with the intent that the timer be set to match the hours for other lights on timers on the site, expecting that the Planning Commission may wish to set specific hours for the lighted sign during its next review of the CUP. Today I sent an e-mail to Kol Shofar informing them of the complaint that we had received, reminding them of the pertinent condition of approval and instructing them to comply with these requirements. Staff will continue to monitor the CKS lighting and will follow up on this issue during the Planning Commission CUP review in early 2011, or earlier if this continues to be a problem. The Town Council approved moving the wheels, from their current location on Town property by the Belvedere-Tiburon Library to the Donohue Building site, on August 17, 2005. 01 a. Dick Collins Mayor Jeff.Slavvitz Vice Mayor Jim=;Fraser Councilmember Alice Fredericks Councilmember Emmett O'Donnell Councilmember On September 16, 2010, I sent a memorandum to the Town Council addressing this issue and concluded with a recommendation that I send a letter to the Landmarks Society to place a "sunset" or end date on the approval. As discussed in the memo, it seems appropriate to give non-profit organizations attempting to create projects on public land adequate time to fundraise and complete their work. On the other hand, such time should not be indefinite, as Councils, community attitudes and priorities change over time. Accordingly, I write this letter to advise the Landmarks Society that the Town will consider the extant approval for the relocation of the Gallows Frame Wheels to be valid until its 10th anniversary on August 16, 2015. This gives Landmarks another five years to bring the project to fruition. If the wheels have not been relocated by that time, the Town will consider the approval to have lapsed. Of course, the Landmarks Society is always free to re-apply for permission to move the wheels in the future if that seems appropriate. Nothing in this letter is intended to alter or modify the 2005 approval and related conditions set forth by the Town Council in its motion except for the creation of a sunset date. In particular, the project will still be required to go through the design review process. The Town of Tiburon agrees with Mr. Garfield's assessment that the proposed deep water wharf would be an asset to the Town in the event of a disaster or significant emergency. The Tiburon Peninsula is accessible by only two roads in and out, and during an emergency vehicular traffic will be limited, potentially very seriously so. In that event access to the peninsula via the San Francisco Bay will be the best alternative for transporting resources such as water, food, medical supplies, emergency personnel and essential equipment. Due to the unusually deep water at the site, a wharf at the Romberg Center could accommodate very large watercraft, greatly facilitating the transfer of materials and personnel. The space available at the facility is also suitable for helicopter landing and storage of substantial amounts of emergency supplies and equipment. The Tiburon Town Council unanimously concurred that the proposed wharf at the Romberg Center would be a valuable resource to the Tiburon Peninsula, Marin County, and the surrounding Bay Area. The Recreation Department has a wonderful program for all ages. On Monday, Wednesday and Thursday we have a variety of Yoga classes that many frail seniors attend as well during the week events at the library. Having parking spaces so close to the front doors of both facilities was well planned. I see those spaces going in the discussion of the configuration of a new larger library. Since the population of people over sixty is growing in our community, I feel we need parking as closely situated to the front of the town hall so that frail people are close to the elevator in the town hall. If the spaces are put behind the building it will be a longer walk and may discourage frail elder from taking the exercise classes or other programs. I hope spaces can remain somehow in front of the building.
