In January 2006, with the completion of engineering design documents for the Del
Mar Valley utility undergrounding project, DIstrict EngIneers Harris & Associates
prepared a revised construction eost estimate which was presented to the Town
Council on February 1, 2006. The revised Engineer's Estimate reflected the
significant escalation in construction costs that the industry has seen since the
preliminary estimate was prepared in Spring 2005. Existing funds are inagequate to
fund the construction coStS identified by the revised estimate.
Anticipating a shortfall in available funding for the project, Staff recommended that
the Council direct Harris & Associates to prepare a Supplemental Engineer's Report
to identify the additional costs required to complete construction of this project, and
spread thoSe costs among the parcels within the district according to the 8SS$SSment
spread methoclology for the district, and to express the Councirs intention to form a
supplemental. assessment d"lStrict to finance these additiQnal project costs. In
previous meetings, Council has indicated a preference to allow the property oWners
in a District to vote on whether or not they wanted a supplemental assessment to
futld the project.. Council cannot unilaterally approve a Sllpplemental assessment
without prior approval of the property owners.
At the February 1 meeting, Council also authorized Staff to solicit construction bids in
order to identify actual, rather than estimated, costs. Invitations to Bid were
published in the Marin Independent Journal, complete plan sets were provided to
nine Builders Exchanges throughout the greater Bay Area, and 27 contractors were
directly notifled of the project. Eight COl !tractors were present at the pre-bid
conference held at Town Hall on February 15; attendance W8$ mandatory for
contractors to qualify to bid the project. We received 6 bids on Thursdey, March 9
(Exhibit E). .

5. Costs directly associated with the bond issue include:
. Bond Underwriter fees are calculated by formula and are based on the
amount of bonds sold. Wulff Hansen has agreed to provide underwriting
services for a supplemental bond at a discount. The bond underwriter fee
for a supplemental bond is $ 57,000
. Bond Counsel fees are calculated by formula and are based upon the
amount of bonds sold. In this case, Bond Counsel has agreed to a
reduced fee calculated as if the amount of the supplemental bond had
been included in the original bond issue, resulting in a lower incremental
cost of the supplemental issue. The bond counsel fee increases
$ 18,475
. Additional costs associated with the supplemental issue include Paying
Agent, printing, registration, servicing, and filing fees,: $ 30,500
6. The contingency associated with the increased incidental expenses: $ 56,537
7. Bond Reserve and funded interest requirements

In an effort to limit the increased costs associated with this project where possible,
no additional fees incurred by the Town and by Harris & Associates have been
included in the Supplemental Engineer's Report.
It should be noted that any funds not used by this project will be returned to the
Property Owners at the completion of the project.
Options for Further Cost Reductions and Alternate Sources of Funding
At the February 1 Council meeting, Staff presented a number of potential costs
savings and alternate sources of funding. What follows is a discussion of those
options:
1. One of the utilities that share the "joint trench" is Comcast. The existing
franchise agreement with Comcast states that they are responsible for
undergrounding their facilities when requested by the Town. It is the Town's
position that Comcast should bear their share of the financial burden of the
cost of the joint trench, and installation of their facilities. Comcast, thus far,
has refused to adequately respond to the Town's clear interpretation of the
franchise agreement. The Town is currently continuing discussions with
Comcast, and no agreement has been reached. When and if funds become
available, they will be returned to the District.

2. Pacific Gas & Electric's franchise with the State of California requires it to
provide undergrounding to certain qualifying areas within the franchise
boundaries. However, Town Policy identifies Tiburon Boulevard as the
priority for use of Rule 20A funding, and Trestle Glen as next in-line for 20A
funds once Tiburon Blvd has been completed.
3. Use of pad mounted equipment rather than the use of underground vaults.
The supplemental Engineer's Report assumes all equipment shall be placed
underground. An alternate bid was obtained from contractors for placing
equipment above ground. Savings are equal to $67,500 plus PG&E fee
premiums.
Canceling the Project
The Town Council can also opt to cancel the project at its sole discretion citing lack
of adequate funding to carry out the work associated. As discussed in February, the
bonds would be called for redemption and paid off with the unspent amount on hand
in the project fund. If the Council abandons the project, or if the property owners
vote against the supplemental assessment, it should be noted that there would be
sufficient funds to redeem and payoff most, but not all of the bonds, because of the
expenses already incurred by the District. Those expenses are estimated as follows:

However, it should be noted that there are still bond related expenses that, at this
time, we cannot accurately calculate. These would include costs related to bond
reserves, capitalized interest and prepayment premiums. While not extensive, these
costs would be calculated by the bond underwriter.
If the district were canceled, we have conservatively calculated the ongoing
indebtedness for each property. The chart below reflects these calculations (by
neighborhood) :

Therefore, a portion of the bonds would remain outstanding, and the total remaining
assessment that would be levied in order to pay debt service on the remaining bonds
would continue to appear on property tax bills for the life of the bonds. Those
property owners who chose to pre-pay their assessments would be refunded their
prepayment less their share of the expenses already incurred; the refund is currently
estimated at about 85% of the original assessment paid.
Schedule
If Council chooses to preliminarily approve the Supplemental Engineer's Report,
1. A Notice of the proposed assessment will be mailed to all property owners
this week, along with a ballot. (Thursday, March 23) The package sent to
property owners will include the date of the public hearing and deadline for
submitting ballots, as well as the supplemental assessment amount for each
property. '
2. A property owner advisory meeting shall be held during the 45 day ballot
period to help property owners understand the proposed assessment, and
consequences of either approving, or denying the supplemental assessment.
3. No less than 45 days following the mailing of the notice of proposed
assessments and the ballots, the Town Council shall hold a Public Hearing,
after which the ballots will be tallied. A majority vote of property owners
allows the Town Council to consider approving the supplemental
assessments. The proposed date for this public hearing is Monday, May 8.
4. If the ballot is successful and the Town Council agrees, then following the 30
day challenge period, and cash payment period, the Town Council could
authorize the sale of the supplemental bonds. (June 7) and award a
construction contract.
RECOMMENDATION
It is recommended that the Town Council take the following actions:
a) Receive public comment;
b) Adopt a Resolution of the Town Council of the Town of Tiburon preliminarily
approving the Supplemental Engineer's Report and directing related actions.

ASSESSMENT
WHEREAS, on February 1,2006, the Town Council of the Town ofTiburon, County of Marin,
State of California, under the Municipal Improvement Act of 1913 (the Act) adopted its Resolution
of Intention No. 08-2006. The proceedings include financing for the acquisition and/or construction
of the public improvements more particularly therein described, in and for the Town's Del Mar
Valley Utility Undergrounding Supplemental Assessment District (the "Assessment District").
WHEREAS, said Resolution directed the undersigned to make and file a report presenting:
a) Maps and descriptions of the lands and easements to be acquired if any;
b) Plans and specifications of the proposed improvements if the improvements are not already
installed, including the class and types of improvements for each zone of the Assessment District,
if these zones exist;
c) A general description of the works or appliances already installed and any other property
necessary or convenient for the operation of the improvements, if the works, appliances or
property are to be acquired as part of the improvements;
d) An estimate of the cost of the improvements and the cost of/ands, rights-of-way, easements and
incidental expenses in connection with the improvements including any cost of registering bonds;
e) A diagram showing all of the following:
I. The exterior boundaries of the assessment district
2. The boundaries of any zone within the district
3. The lines and dimensions of each parcel of/and within the district with each subdivision
given a separate number upon the diagram;
f) A proposed assessment of the total amount of the cost and expense of the proposed improvements
upon the subdivisions of land in the district in proportion to the estimated benefits to be received
by each subdivision respectively. The assessment shall refer to the subdivisions by their
respective numbers;
g) A proposed maximum annual assessment upon each of the subdivisions of land in the district to
pay costs incurred by the Town of Tiburon and not otherwise reimbursed which result from the
administration and collection of assessments or from the administration or registration of any
associated bonds and reserve or other related funds.
The particulars of which are described in the Resolution, incorporated herein by reference;
NOW, THEREFORE, the undersigned, by virtue of the power vested in me under said Act and the
order of the Town Council of the Town of Tiburon hereby make the following assessment to cover
the portion of the estimated cost of said acquisitions, work and improvements, and the costs and
expenses incidental thereto which specifically benefit the Assessment District and are to be paid by
the Assessment District.
The amount to be paid for said acquisitions, work and improvements, and the expenses incidental
thereto, is generally as follows:

Under the Resolution of Intention, the requirement of Division 4 of the California Streets and
Highway Code shall be satisfied with Part 7.5 of said Division 4, for which the following is
presented:
I. The total amount, as near as can be determined, of the total principal amount of all unpaid special
assessment and special assessments required or proposed to be levied under any completed or
pending assessment proceedings, other than contemplated in the instant proceeding is:

I do hereby assess and apportion the Balance to Assessment of the Total Cost of said acquisitions,
work and improvements upon the several lots, pieces or parcels or portions of lots or subdivisions of
land specifically benefited thereby and liable therefore, severally and respectively, in accordance
with the special benefits to be received by such subdivision, respectively, from the acquisitions and
improvements. These pieces, parcels or portion of lots or subdivisions of land are hereinafter
numbered to correspond with the numbers upon the attached Assessment Diagram. The portions of
land and apportioned assessments are more particularly set forth in Tables I and 2, attached herein,
and incorporated by reference.
In addition, an annual assessment for costs incurred by the Town ofTiburon and not otherwise
reimbursed for administration and collection of assessment of bonds shall be levied in a maximum
annual amount of $20,000 and subject to an annual increase based on the Consumer Price Index
(CPI), during the preceding year ending in January, for all Urban Consumers in the San Francisco-
Oakland-San Jose areas. Said annual administration amount shall be apportioned to each parcel in
the Assessment District on an equal share basis.
As required by said Act, an Assessment Diagram is hereto attached showing the Assessment District
and also the boundaries and dimensions of the respective subdivisions ofland within said Assessment
District as the same existed at the time of the passage of said Resolution, each of which subdivisions
having been given a separate number upon said Diagram.
Said assessment is made upon the several subdivisions of land within said Assessment District in
proportion to the estimated special benefits to be received by each of said subdivisions from said
improvement. The diagram and assessment numbers appearing herein are the diagram numbers
appearing on said diagram, to which reference is hereby made for a more particular description of
said property.
Each subdivision of land assessed is described in the Assessment Roll by reference to its parcel
number as shown on the Assessor's Maps of the County of Marin for the Fiscal Year 2004-2005 and
includes all of such parcels excepting those portions thereof within existing public roads or right of
way to be acquired in these proceedings for public road purposes. For a more particular description
of said property, reference is hereby made to the deeds and maps on file and of record in the office of
the County Recorder of said County.
Notice is hereby given that bonds will be issued in accordance with Division 10 of the Streets and
Highways Code ofthe State of Cali fomi a (the "Improvement Bond Act of 1915"), to represent all
unpaid assessments, which bonds shall be issued not to exceed the legal maximum term as authorized
by law, thirty-nine (39) years from the 2nd day of September next succeeding twelve (12) months
from their date. Said bonds shall bear interest at a rate not to exceed the current legal maximum rate

In addition, an annual assessment for costs incurred by the Town of Tiburon and not otherwise
reimbursed for administration and collection of assessment of bonds shall be levied in a maximum
annual amount of $20,000 and subject to an annual increase based on the Consumer Price Index
(CPI), during the preceding year ending in January, for all Urban Consumers in the San Francisco-
Oakland-San Jose areas. Said annual administration amount shall be apportioned to each parcel in

METHOD OF ASSESSMENT
BACKGROUND
The Assessment District is formed under the authority of the Act and Article )OUD of the California
State Constitution, which require that local agencies levy assessments according to special benefit. In
addition, Article XUID, Section 4, of the State Constitution requires that a parcel's assessment may not
exceed the reasonable cost of the proportional special benefit conferred on that parceL Section 4
provides that only special benefits are assessable and the local agency levying the assessment must
separate the general benefits from the special benefits. It also requires that publicly owned property that
benefits from the improvements be assessed. Neither the Act nor the State Constitution specifies the
method or formula that should be used to apportion the costs to properties in any special assessment
district proceedings. The responsibility for recommending an apportionment of the costs to properties
which specially benefit from the improvements rests with the Assessment Engineer, who is appointed for
the purpose of making an analysis of the facts and determining the correct apportionment of the
assessment obligation. Therefore, costs and expenses of proposed improvement(s) will be apportioned
against the properties by a formula or method that distributes the costs in direct proportion to the
estimated special benefits these parcels receive from the improvements.
The approval of the assessments rests with the Town CounciL The Council renders its decision after
hearing testimony and evidence presented at a public hearing and tabulating the assessment ballots,
which are mailed to all record owners of property within the Assessment District. Only ballots delivered
to the Town prior to the close of the public hearing are tabulated. The Council's findings must include
whether or not the assessment spread has been made in direct proportion to the estimated special benefits
received by each parceL
SPECIAL BENEFIT
The purpose of this Assessment District is to provide the financing to underground existing overhead
electrical, telephone and cable facilities. These facilities are the direct source of service to the properties
within the Assessment District.
The proposed replacement of existing overhead utility facilities (power, telephone and cable facilities)
with underground facilities will provide a special benefit to the parcels who will be served by the new
distribution facilities as a result of enhanced service, reliability and capacity, as well as improved safety.
All new wires and equipment will be installed underground, which eliminates the threat of interrupted
service by downed power lines due to wind and rain. Removal of the existing wood poles and the
overhead wires will also aesthetically enhance all parcels that are directly adjacent to these facilities. By
virtue of such benefits, the proposed improvements will increase the desirability and will specifically
enhance the values of the properties within the Assessment District. Therefore, 100% of the proposed
improvements are of direct and special benefit to the properties within the boundaries ofthis Assessment
District.
All general benefits, if any, to the surrounding community and public in general from undergrounding of
these local overhead utilities are intangible and are not quantifiable.

ExemDtions
The following types of parcels are considered to be exempt from the assessment due to their having no
benefit from the improvements because they have virtually no potential for development. These
properties are assigned 0 Benefit Points:
. Parcels that are unbuildable because they are too small or are part oftidallands
. Parcels that are too small for a dwelling unit but have ancillary uses to other residential properties,
such as garages or carports.
. Parcels that are designated as Open Space.
ASSESSMENT APPORTIONMENT
Based on the findings above, it is our conclusion that the improvements specially benefit all
developable properties in the Assessment District in proportion to the number of Benefit Points
calculated for each property.
Benefit Zones
The Assessment District is split into three zones of benefit: the Del Mar Valley Area, the West
Hawthorne Drive Area and the Hacienda Drive Area.
. The Del Mar Valley Area construction costs are apportioned to all properties in the Del Mar
Valley Area in proportion to the number of Benefit Points assigned to each property.
. The West Hawthorne Drive Area is a separate system of overhead utility lines. The West
Hawthorne Drive Area's improvements are separately documented and are apportioned only to
properties within the West Hawthorne Drive Area in proportion to the number of Benefit Points
assigned to each property.
. The Hacienda Drive Area is directly north and adjacent to the Del Mar Valley Area and consists
of overhead utility lines along Hacienda Drive. This area consists of properties taking service off
of the poles in Hacienda Drive and having direct access on Hacienda Drive. The costs of the
Hacienda Drive Area's improvements are separately documented and are apportioned only to
properties within the Hacienda Drive Area in proportion to the number of Benefit Points assigned
to each property.
The utility lines and poles in Tanfield Road are not being underground at this time, and the utility
lines and poles in Acacia Court have already been underground. Therefore, properties taking
service and access from either of these two roads are not included in this Assessment District.
Incidental Expenses and Financial Costs have been assessed to the entire Assessment District on a
prorata basis relative to the total construction cost allocations.
Complete calculations for each assessment, providing the Benefit Points, the construction portion of
the assessment and incidental and [mancial components of the assessment are included in the
Appendix.

METHODOLOGY
To establish the benefit to the individual parcels within the Assessment District, a Benefit Point system is
used. Each parcel ofland is assigned Benefit Points (BP's) in proportion to the estimated special benefit
the parcel receives relative to the other parcels within the Assessment District from the Utility
Undergrounding Improvements. The highest and best use of each property is the basis on which the
Benefit Points are assigned. For example, an R-I zoned residential property with two dwelling units is
considered as having 2 dwelling units even though its current zoning only allows one dwelling unit, and a
vacant property is considered developed to its highest potential and connected to the system.
The special benefits from undergrounding the overhead utilities are segregated into three (3) categories,
which are discussed below:
. Improved Property Aesthetics Benefit. This benefit relates to the improved aesthetics due to the
removal of overhead wires and utility poles from view. Per the Tiburon Municipal Code, Section 15.2,
view is defined as follows: "The term 'view' includes both upslope and downslope scenes...." The
aesthetic benefit of removing poles and overhead lines adjacent to properties is deemed to be the same
for all properties, whether or not one property is thought to have a better view than another, because
the increase in property value from the improvements is considered the same on a percentage basis.
Also, there is no way to judge the view from a vacant property and developed properties can
reconstruct buildings to change view characteristics. Parcels that are directly adjacent to the facilities
to be underground and that view wires or poles from any part of the property are considered to receive
special benefit from the undergrounding project. Therefore, these properties are assigned one (I)
Aesthetic Benefit Point (ABP) per parcel for Improved Property Aesthetics.
. Improved Safety Benefit. This benefit relates to the improved safety of having the overhead wires
placed underground and having the power poles removed, which eliminates the threat of downed
power lines and poles due to wind, rain and other unforeseeable events. All parcels that are connected
to and are directly adjacent to the utilities being placed underground are considered to receive the
same special benefit from the undergrounding project. Therefore, these properties are assigned one (I)
Safety Benefit Point (SBP) for Improved Safety.
. Improved Service Reliability Benefit. This benefit relates to the enhanced reliability of service from
the utilities being placed underground due to having all new wires and equipment and having that
equipment underground, which reduces the threat of service interruption from downed power lines.
All properties that receive service from the facilities to be underground are considered to receive
special benefit based on the relative energy usage associated with the type of use on the property.
In order to allocate this benefit fairly between the parcels, a methodology is proposed which equates
different residential and non-residential land uses to each other, thereby allowing a uniform method of
comparison.
The single-family residential (SFR) parcel is used as the basic unit of comparison. A SFR parcel
equals one (I) Reliability Benefit Point (RBP). Every other land use is converted to RBP's as
described below.
Other residential properties are compared to a SFR parcel based on the number of potential or actual
dwelling units on them, whichever is higher. These other residential properties consist of two parcels
with 2 dwelling units on them. Based on the Marin County Assessor's data, the building areas per
dwelling unit for these parcels are between 1,000 square feet (sf) and 1,499 sf. The median SFR

dwelling in this Assessment District is approximately 2,600 sf. Looking at the PG&E Design
Electrical Manual for the North Bay Area, which includes Tiburon, dwelling units between 1,000 sf
and 1,499 sfuse approximately 70% of the energy that dwelling units between 1,500 sf and 3,000 sf
do. Therefore, multiple residential properties are assigned 0.70 RBP's for each potential or actual
dwelling unit on them based on the current zoning on the property.
Non-residential properties are converted to RBP's based on the estimated amount of usage for the type
of property as compared with a SFR per the PG&E Design Electrical Manual for the North Bay. There
is one non-residential use within the Assessment District boundaries: a School. The following table
shows how the RBP equivalencies are calculated:

The school property consists of 10 individual Assessor's Parcel Numbers (APN's) and the Benefit
Points are apportioned equally to each.
Exceptions
There are two areas within the assessment district boundaries that appear to have all of the overhead
utility lines directly adjacent to the properties already underground:
. Geldert Court, a public street within the Del Mar Valley Area, and
. Noche Vista Lane, a private drive within the Hacienda Drive Area.
The properties taking service and access from these roads are exceptions to the above outlined
Benefit Point assignments.

These properties are considered to receive half the benefit from service reliability, as their small
systems are completely surrounded by and dependent on the larger overall system that is to be
undergrounded, and half the benefit from improved safety, as ingress and egress from their property
is directly affected by overhead lines and poles.
The properties that have no frontage along roadways that have poles and wires along them do not

DESCRIPTION OF IMPROVEMENTS
The following provides a description of the improvements proposed to be constructed, installed or
acquired under the provisions of the Act.
Within the County of Marin, State of California, located in the central part of the Town ofTiburon called
Del Mar Valley, the construction of the following public improvements, including all planning, design,
construction administration and general administration services, the acquisition of all necessary rights of
way, the acquisition of licenses, franchises and permits and the construction of all auxililll)' work
necesslll)' and/or convenient to the accomplishment thereof, in accordance with the plans and
specifications to be approved by the County of Marin and the Town of Tiburon. Public improvement
construction may be phased as necesslll)' and convenient for the Town of Tiburon and the County of
Marin. Phasing will be undertaken in a manner that results in a complete and functional portion of each
system described below.
The following improvements are proposed to be constructed and installed in the general location referred
to as Del Mar Valley Utility Undergrounding Supplemental Assessment District.
I . Removal of existing overhead power, telephone and cable wires and poles.
2. Removal of overhead resident service drops.
3. Construction of mainline underground power, telephone and cable conduit, with appurtenant
manholes and pullboxes.
4. Construction of service conduit and appurtenances to property line.
5. Installation of new conductor within said conduit and underground structures by the utility
companies.
The improvements will be designed by PG&E, SBC Communications and Comcast. The Town of
Tiburon will inspect the work to ensure conformance to Town and County standards and specifications
where applicable.
Note: The foregoing improvements do not include any individual service connections on private
properties. Each owner of property located within the Assessment District will be responsible for
arranging for and paying for work on his or her property necesslll)' to connect facilities
constructed hy the public utilities in the public streets and alleys to the points of connection on the
private property.

As required by the Act, the Assessment Diagram shows the exterior boundaries of the Assessment

appears in the Assessment Roll contained in Table I herein.
Reference is hereby made to the Assessor's Parcel Maps of the County of Marin for the boundaries and

PLANS AND SPECIFICATIONS
Reference is hereby made to the Plans and Specifications in and for said assessment proceedings on
file in the office of the Town Clerk of the Town of Tiburon, County of Marin. The Plans and
Specifications are by reference included with this Engineer's Report.
ANNUAL ADMINISTRATIVE ASSESSMENT
A proposed maximum annual administrative assessment shall be levied on each parcel ofland and
subdivision of land within the Assessment District to pay for necessary costs and expenses incurred
by the Town ofTiburon, and not otherwise reimbursed, resulting from the administration and
collection of assessments, from the administration or registration of any bonds and reserve or other
related funds, or both. The maximum assessment is authorized pursuant to the provisions of Section
10204(1) of the Act and shall not exceed twenty thousand dollars ($20,000) per year, subject to an
annual increase based on the Consumer Price Index (Cpr), during the preceding year ending in
January, for all Urban Consumers in the San Francisco-Oakland-San Jose areas. The exact amount of
the administration charge will be established each year by the Superintendent of Streets. Each parcel
within the Assessment District shall be allocated an equal share of such costs.
The annual administrative assessment will be collected in the same manner and in the same
installments as the assessment levied to pay for the cost of the works of improvement

Undergrounding Supplemental Assessment District
Dear Council Members:
As your know, 56, 66, 76 and 86 Hacienda parcel owners filed a petition objecting to the Del
Mar Utility Underground Assessment District, and parcel owners at 17, 18, 19,20,24,30,34
Noche Vista and 111,118,130,132,144 and 180 Hacienda Drive signed a declaration of support
for the Bonander law suit (see copy of attached declaration).
Thest:: parcel owners comprise over 50% of the total parcels in the Hacienda zone (sub-district),
and for a Supplemental District to be initiated, over 50% parcel approval and over 60%
parcel approval pursuant to Tiburon's own policy must be obtained. It is apparent that this
parcel approval requirement has not been met in the Hacienda zone/sub-district. In addition,
there has been no attempt by the Town to secure any type of approval consisting of over
500/0/60% parcel approval from all parcels in the District.
The Town, in order to comply with Streets and Highways Code ~ 1 0426 to initiatt:: a
Supplemental District by Resolution of Intention must either satisy (i) Streets & Highways Code
~5896.5 and ~5896.8, or (ii) ~5896.6 (bywayofinitiating petition). The Town has satisfied
neither section of the law, nor has it satisfied its own over 60"10 initiative policy on a zone/sub-
district basis or total District basis. By the Council having passed a Resolution of Intention for
a Supplemental Assessment (without initiating petitions) it must agree to be held responsible for
50"10 of the total Supplemental District costs pursuant to ~5896.5.
Based upon the Council's failure to comply with the law, the Resolution of Intention for the
Supplemental District must be immediately withdrawn by this Council.

EXHIBIT C
Supplemental Engineer's Report by such mailing by name to those persons whose names and
addresses appaar on the last equalized assessment roll of the County or the State Board of
Equalization asssssment roll, as the case may be. The notice herein provided shall be mailed
not less than 45 days before the date of the public hearing ordered under Section 4 hereof.
The amount of the proposed assessment for each parcel shall be calculated and the
record owner of each parcel shall be given written notice by mall of the propossd assessment,
the total amount thereof chargeable to the entire Supplemental Assessment District, the
amount chargeable to the owner's particular parcel, the anticipated duration of payments for the
assessment if bonded, the reason for such assessment and the basis upon which the amount
of the propossd assessment was calculated. Each such mailed notice to owners shall contain a
ballot which inciudes the property owner's name, identification of the parcel and support or
opposition to the proposed assessment.
Each notice shall include, in a conspicuous place, a summary of the procedures
applicable to the completiori, retum and tabulation of ballots, including a disclosure that the
existence of a majority protest (Whereby ballots submitted in opposition exceed those submitted
in favor of the assessment, with ballots weighed according to proportional financial obligation of
the affected proparty) will result in the assessment not being imposed. Each mailed ballot shall
include a sealable retum envelope with the Town's address for receipt of the completed ballot.
S. Ballots. The Town Clerk is hereby designated as the impartial ~n. without a
vested interest in the outcome of the assessment, rasponsible for the tabulation of the ballots.
The Town Clerk: shall maintain a separate and secure file for the safekeeping of the
asssssment ballots as they are received and pending tabulation. Ballots shall be received up to
the time of the closing of the public hearing. Ballots shall rem!lin sealed until the close of the
public hearing and the beginning of the tabulation, provided thet ballots may be submitted, or
changed, or withdrawn by the person submitting the ballot prior to the conclusion of the public
hearing. During and after tabulation, the ballots shall be cIiscIoseble public records under
Section 6252 of the California Government Code.
7. Boundary Map. The proposed boundarias of the proposed Supplemental
Assessment District are hereby described as shown on a map thereof on file in the office of the
Town Clerk (the "Boundary Mapj, which indicates by a boundery line the extent of the territory
to be included in the proposed Supplemental Assessment District and which BoUndary Map
shall govem for all details for further purposes of the proceedings for the Supplemental
Assessment District and to which reference is hereby made for further particulars. The Town
Clerk is hereby authorized and directed to endorse upon the original and at least one copy of
the Boundary Map the date of the filing thereof and date and adoption of this resolution and to
cause a copy of the Boundary Map to be filed with the County Recorder of the County within 15
days of the adoption of this resolution, but in no event Ieter than 15 deys before the date of the
public hearing ordered under Section 4 hereof. The County Recorder shall endorse upon the
Boundary Map the time and date of filing and shall fasten the same securely in a book of maps
of assessment and community facilities districts which the County Recorder shall keep in his or
her office. The County Recorder shall index the Boundary Map by the name of the Town and by
the distinctive designation of the propossd Supplemental Assessment District.
8. Effective. This resolution shall be effective upon its adoption.

Since January 2003. Del Mat area reSidents. led by June Strunk and Henry J. (Hank)
Broderi~ have PurllUed the und~rgrounding of overtlead uti.lities in their
neighbortlood. In May 2003. theprojectpl!OJ:lOnents sUbmitted' petiticns arid
sUbsCriptiOn cIepoSits from over 60% of thepropertles within ~e PropQSed district. In
Jun~ 2QQ3. the Town Council adoptecfa resolution oflntentlon to form the Del Mar
Valley Utility UndergrIJUfiding Assessment DIStrict. The Engii'leer'eReport, dattJd
May 12, 2005, sumrnarized the estirnated project c.:O$l$ .and theratio~ for
assessing each propartyaccordifig to the specialbenefiHhat each property recel\Ies.
In May 2005, property owners voted on the propoSed district, and approved the
district by a Vote of 71%. The Town Coun<:il _tad theresolutiQll ~hingthe
DistrICt on May 18, 2005, and authorged the sale of bonds on JulY 13.2001$ .after .
resolVingadisagreernent.betWeen .the Town and.the Reed. Union SChoOl District,

Those documents.are now complete and ready to go out to bid (Exhibit 1).
However. since the summer.of 2005, constrUction. costs have significantly escalated;
in fact. the price of asphl;lltlllol'1e jumped n% .in t.he 3 monthlll from JulY to O.ctober.
Further, the bids for the LYford CoVe utility Ufidergrouilding project l'8Ceived in
N()vember of 2005 came. In at 152% of our engineer's t;lstlrnate. Our engineer's
current estimate for the Del Mar VallElY project, 't\Ihk)h.. has beinadjUEltEldfrorn that
found in the engineer's Report to reflect final design and the changas we have seen
in construction co!llls over the past six monthS, is $4,271.769, (cqmpared to an
estimate in the Engineer's Report of. ~,454,100). Withadl.\.Istrt'I$nts for
con.tingencles, there is a shortfall for construction costs Of $ 2.121 ,924. Add"rtional

DISCUSSION
The Town has a policy of encouraging the formation of assessment districts for the
purpose of undergroundii1g utilities. In April 200a, the Town Council revlsltad its
policy of district formation and the cost associated with the ability of neighborhoods
to form districts. Aside from the incredible grassroots efforts to create a district, the
cost to do 80 can be prohlb~. By law, before a distllct Is formed, an engineer
neads to be retainad to act as "Engineer.of*Record" who brings experience and skiD
to the dlstrict formation and execution process. Funds need to be raised by the
district proponents in the form of "subsoriptions". The Town Council requires at least
60% of the district member subscriptions in a fledgling district before moving forward
with. the formation process.
As a result of a lawsuit filed.by a member in the Stewart Drive DIstrict in 2001, the
Town is now required to provide independent legal advice.to district members; this
resulted In additional costs tocreata a disti'ict (thus increaslng the cost of the
Indlvldual subscriptions). Tt:ti$, as well as Other cost pressuI'$S, caused the Town
Council to ask for a policy on District Formation. .
In order to oontrol costs for the District formation process, the Councrl agreed to
include In the Engineer's Report a consIn.IcIIon cost estimate based on preliminary
design information rather than on a completed anglneering design. The cost to
produce a fmal engineering design is l!lbout four timas the cost of the preliminary
design information. Clearly, with a construclion cost estimate bssBd an pI8Ilmlnary
dBsign Information, there Is a limit to the amount of detaD to be found and therefore,
greater rISks associated with using theln. One such risk Is that, despite providing for
contlngencias, costs can escalate. In the cases of Lyford Cove and Del Mar Valley,
this was the result. At the time this policy was being considered. It was
acknowledged by the Town Council thet !he figure found in the ~ Report
might require adjustment after construction bids were received.
The substantial overrun occurred for a number of reasons; there is no single cause.
Through the Lyford Cove process, this situation was described as a "Perfect storm#.
The Town's decision to ballot and bond based soJely on an engineer's estimate
prepared prior to detll1Jed final project design led to !he underestimation. Also,.
materials costs fluctuated tremendously in 2005 due a number of factors including,
but not limited to, Hurricane Katrina, as well as the current buildlng boom in China. It
has also been reported that contractors in this area are busy, and less "hungry" for
work, rasulting in the Town receiving few bid proposals and high prices.

Alternate Sources of Funding
There are a limited number of funding sources from which to draw to make up the
shortfall.
1. Town Funds: The cost for undergrounding utilities is typieally borne by the
residents who will benefit from these efforts. The Town does not have the
financial resources available to underground existing utilities in all neighborhoods
within Town boundaries.
2. The Utilities
a. Rule 20A: PG&E's franchise with the State of Califomia requires it to provide
a limited amount of funding for the purpose of undergrounding utilities to
certain qualifying areas within the franchise boundaries. The Town of
Tiburon policy identifies Tiburon Boulevard as the priority for use of these
funds, and Trestle Glen as next in-line for funding once the undergrounding of
all overhead wires along Tiburon Boulevard has been completed.
b. Comcast: One of the utilities that share the "joint trench" in the
undergrounding district is the eable provider, Comeas!. There is a dispute
between the Town and Comeast as to the financial extent to which Comcast
is required to pay its share of the trench. The Town is currently in
discussions with Comcast, and no agreement has been reached. When, and
if, funds from Comcast become available, they will be returned to the District
members.
3. Property Owners: During the meetings addressing the cost overrun for the
Lyford Cove district, the Town Council identified a preference to allow the
property owners in that District to decide on whether or not they want a
supplemental assessment to fund the shortfall between available funds and the
cost of construction.
Staff and the District Engineers have also reviewed the design for opportunities to
achieve cost savings. One suggestion for reducing costs to the project has been to
utilize pad mounted transformers instead of subsurface transformers; which would
result in approximately $200,000 in PG&E fees savings. This option has been
incorporated into the bid documents as a bid altemate.
Canceling the Project
The Town Council can also opt to cancel the project at its sole discretion citing lack
of adequate funding to carry out the work associated. Bonds would be recalled and
paid off with the existing funds. If the Council abandons the project, or if the property
owners vote against the supplemental assessment, it should be noted that expenses
already incurred by the District would still need to be paid. As of the end of

December 2005, the Town has paid out nearly $700,000 in expenses. Additionally,
the costs associated with the early call on the bond must also include a prepayment
premium on the early call, and interest earnings will be applied.
These costs to property owners would continue to appear on property tax bills for the
life of the bonds. Those property owners who chose to pre-pay their assessments
would be refunded their prepayment less their share of the expenses already
incurred.
Process for proceeding with a Supplemental District
In order to bring the supplemental assessment to a vote of the property owners, the
Town Council must first adopt a resolution of intention (Exhibit 2) directing a
Supplemental Engineer's Report to be made and filed, to include the additional costs
of improvements and incidental expenses required to complete construction of this
. project, and identifying the additional assessments. It should be noted that a Public
Hearing is not required at this stage, although Staff does recommend taking public
comments. It should also be noted that the adoption of the Resolution of Intention
does not bind the Town to any further action; but it is required prior to a Council
decision for a vote of property owners regarding any proposed assessments.
Contractor bids will be obtained, and if additional funds are needed, included in an
Engineer's Report. The Engineer's Report will reflect the actual bid amount, and a
ballot would be based on an actual, not an estimated, cost which would include the
actual construction costs plus contingencies and the incidental costs associated with
the sale of the supplemental bonds.
The next step in the process is the preliminary approval of the Supplemental
Engineer's Report, at which time the Town Council can set a Public Hearing, and
direct the mailing of the Notices of proposed assessments and the ballots to property
owners. Notices and ballots must be mailed to all property owners at least 45 days
prior to a public hearing and ballot tabulation.
