MINUTES
A. INTERVIEWS
Beginning at 6:45 p.m., the Town Council interviewed Bran Fanning and Diane Smith for two
vacancies on the Heritage & Arts Commission.
CALL TO ORDER
Vice Mayor Gram called the regular meeting of the Tiburon Town Council to order at 7:30 p.m.
on Wednesday, June 2, 1999, in Town Council Chambers, 1505 Tiburon Boulevard, Tiburon,
California.

C. ANNOUNCEMENT OF CLOSED SESSION ACTION (If any)
-. Vice Mayor Gram said no action was taken on one matter and the Town Attorney had a report on
another. Town Attorney Danforth said the Council had authorized a settlement in the Summers v.
PG&E et al. and the Town of Tiburon lawsuit. Danforth said the Town had agreed to contribute
$5,500 to the $22,500 settlement of the matter that arose out of the removal of two trees by a
subcontractor ofPG&E on Ms. Summers' property. She said the Town had signed an
encroachment permit allowing the removal of two trees on a utility easement.
Vice Mayor Gram also said the Council had given direction to the Town Attorney regarding
another possible lawsuit.

1) TffiURON FERRY DOCK REALIGNMENT PROJECT WORKSHOP - May 25, 1999-
(Councilmember Thompson)
Councilmember Thompson said he and Mayor Bach had attended the workshop which ended with
a surprise proposal by Blue & Gold Ferry Service to provide a new dock that would be both ADA
accessible and the same size as the current one. Thompson said that raised a question about the
disposition of the preliminary engineering and design fees the Town had already expended from
the State transportation funding. He also noted that the entire matter needed to be considered in
more detail by Staffand the Town Council.

/'-.. 2) NEW TIBURON POLICE STATION - Status Report - (project Co-Chair John Kern)
Town Manager Kleinert handed out a financial report to Council.
Project Co-Chair Kern said the off-site improvements to the project had been held up pending
issuance of permits by CALffRANS to the various utilities. He also said that Pacific Bell wanted
to charge the Town $50,000 to relocate its panel box, but through his negotiations, they had
agreed to waive $12,000 of that fee.
Kern also reported on the status of the interior and exterior work and estimated the new
completion date to be sometime between July 1-10, 1999.
In response to a question from Vice Mayor Gram concerning the remainder of the contingency fee,
Co-Chair Kern said there had been very few change orders on the project, and Finance Director
Stranzl said only $25,900 of the $124,00 had been expended to date.

G. PUBLIC HEARING
8) STEWART DRlVE/TffiURON BOULEVARD IMPROVEMENTS - Presentation by Reed
Heights/Tiburon Knolls Property Owners
Neighborhood representative John Kern, Stewart Drive, spoke on behalf of the Association. He
noted the difficulties experienced by residents attempting to exit Stewart Drive, either on foot or
in a vehicle, and asked Council to take a new look at resolving the problem. He said the number
of cars had increased dramatically on Tiburon Boulevard. Kern said a letter from Sally Spencer,
POA President, had previously been submitted to Council. That letter made reference to the fact
that a child had been killed at the intersection of Trestle Glen and Tiburon Boulevard before a
traffic light was installed, and said it was" . .. a chilling reminder of the disaster-waiting-to-
happen at the intersection of Tiburon Boulevard and Stewart Drive." Kern said the Town was
being put "on notice" about the similarities and safety problems between these two intersections.

Dan Ross, 533 Comstock Drive, Traffic Chair for the Reed Heights/Tiburon Knolls POA, also
submitted a letter to Council. Ross' letter said there had been an increase in both vehicle traffic on
Tiburon Blvd. due to build-out, as well as pedestrian traffic to McKegney Green. He said the
problem was compounded by the fact that the traffic signals at Del Mar School and Trestle Glen
were not coordinated which caused traffic to flow continuously past the Stewart Drive
intersection.
Ross said he had correspondence going back 20 years regarding the problern, between the Board
of Supervisors, CAL/TRANS, State representatives, the Town ofTiburon, and the homeowners'
associations. He said that all parties agreed that a dangerous situation occurs at the intersection.
Most recently, Ross said, Assemblywoman Mazzoni had responded to the POA's request for
funds by requesting money for the signalization from the Petroleum Violations Escrow Account.
Ross requested that the Town Council support them by demanding that CAL/TRANS install a
signal at the intersection and by assisting with funding for it.
Other residents commented about the seeming lack of police monitoring at the intersection.

Council acknowledged the problem and agreed to form a subcommittee to study possible
solutions. The committee would be comprised of the Town Engineer, Town Manager Kleinert,
Vice Mayor Gram and Councilmember Thompson.
9) UPDATE TIBURONMUNICIPAL CODE-Ordinance Amending Chapters 2,3 & 16 of
Code Pertaining to Town Administration - (I" Reading by Title Only)
Town Attorney Danforth said the ordinance was another one in a series of "clean-up"
amendments prior to republication of the Municipal Code.
There was no public comment.

10) CONTRACT FOR COUNTY DISP ATCH SERVICES - Termination of Contract with
Southern Marin Dispatch! Authorize new Contract for Services to be provided by County of
Marin
Chief of Police Peter Herley said July 11 was the kick-off date for Tiburon to begin using the
County of Marin for dispatch services. He said the action required was to authorize the Town
Manager to execute the necessary documents to terminate the old agreement and to enter into the
new contract with the County, which had previously been submitted to Council.

11) PUBLIC USE OF TOWN COUNCIL CHAMBERS - (Adoption of Policy and Fee Schedule)
Town Manager Kleinert said the proposed fee schedule was similar to the one currently in place
for weekday and weekend rentals of the Belvedere Community Center.
In its discussion of the matter, Council directed Staff to eliminate day use by the public and
proposed a slightly higher rate structure for weekend and evening rentals to be more reflective of
other comme~cial meeting space, such as the Tiburon Lodge.
The weekday evening rate structure proposed by Council would be $20/hour for local residents
and non-profit groups; $30/hr. for non-local, non-profit groups; and $50/hr. for private
meetings/business groups. The weekend rental fees would be $250; $500 and $500 (for five-hour
minimums), utilizing the same designations.

12) MULTI-USE PATH - (Status Report on Grant Funding for Repairs)

/..... Planning Director Anderson reported that he had been advised by the County to come back next
year to request funding for the multi-use path since most of the funds had been committed for this
year's grants.
Councilmember Thompson asked about the status of the Parks & Open Space multi-use path data
collection project. Anderson said the survey had yet to commence and noted that Commissioner
Fredericks was working on getting volunteers from the Lyford Cove/Old Tiburon HOA and the
Parks & Open Space Commission.
13) CONGESTION MANAGEMENT AGENCY - (Marin County Bicycle Master Plan)
Planning Director Anderson said the Town did not have a Bicycle Master Plan. Vice Mayor
Gram, Tiburon's representative to the Congestion Management Agency, said they had approved
the hiring of a consultant to prepare a county-wide master plan by the Year 2000. Planning
Director Anderson said that once the master plan was accepted, all cities would be eligible for
funding.
Gram said that five Marin cities currently had bicycle plan subcommittees and five did not. He
recommended agendizing the matter and forming such a committee.
14) TOWN DEDICATION DATES - (Confirm Dedication of new Police Building and Elephant
Rock Restoration) - (Oral Report by Town Manager)

Council approved Saturday, July 17, 1999 and Thursday, July 15, respectively, as dedication dates
for the above projects.
K. COMMUNICATIONS
15) ADOPTION OF BAY TRAIL PLAN - Tiburon Acceptance - (Letter from ABAG President
Mary King, dated May 21, 1999)
Planning Director Anderson said that previous Councils had adopted a rather non-committal
policy with regard to the Bay Trail plan. However, he said "the locomotive had left the station"
and Council concurred that it was time to "pull our heads out of the sand" with regard to the
publication of trail routes and an endorsement.
Anderson noted that the current Bay Trail followed the Town's multi-use path, up Trestle Glen
Boulevard, and out Paradise Drive to Corte Madera. Councilmember Thompson the trail should
be endorsed as part of a larger concept of creating "walkable communities."
Council directed Staff to re-agendize the matter for action.

Communication noted. Planning Director Anderson said the matter would be agendized for
Council consideration.
