A. COMMISSION & COMMITTEE REPORTS 1) TOWN COUNCIL/HOMEOWNER'S ASSOCIATION WORKSHOP - April 27, 1999- (Vice Mayor Gram) Vice Mayor Gram said The Ark newspaper had done a good job covering the workshop. CONSENT CALENDAR 2) TOWN COUNCIL MINUTES - #1161 - April 7, 1999 - (Approve) 3) NATIONAL PUBLIC WORKS WEEK - May 16-22,1999 - (proclamation) 4) TOWN MONTHLY INVESTMENT SUMMARY - March 31, 1999 - (Accept) 5) AMICUS BRIEF REQUEST - Haggis v. PUBLIC HEARING 6) STREET IMPACT MITIGATION FEE (For all new Construction in Tiburon) - (Adopt Resolution) ,..-.. Town Council Minutes # 1163 May5,1999 Page I . 1-" Town Attorney Danforth said the proposed fee was to repair damage caused to the Town's streets by heavy equipment used in new construction, and that it was not a revenue raiser. Deputy Town Engineer John Huginin said a review of the Town's building permits and encroachment permits was used to establish a benchmark in order to calculate the proposed fees. Councilmember Matthews posed the question of whether it was fair to levy a fee on property owners who lived on private streets. Mayor Bach noted that everyone drove over the public streets. Vice Mayor Gram asked whether the money would go into a restricted fund for street repairs. Finance Director Stranzl affirmed this, adding that it would not be booked as general fund revenue. Councilmember Thompson noted that construction activity was up in town, simply by virtue of the increased number of trucks coming and going. Vice Mayor Gram concurred, stating that there were six major projects going on within 500 feet of his home. Mayor Bach opened and closed the public hearing. There was no public comment. Town Attorney Danforth noted that the new fee would not go into effect for 60 days. ',-" Moved: Vote: To adopt resolution establishing a Street Impact Mitigation Fee for all new Construction in Tiburon Thompson, Seconded by Gram AYES: Unanimous ABSENT: Hennessy MOTION: G. NEW BUSINESS 7) POLICE DEPARTMENT REORGANIZATION - (Eliminate Corporal Classification & Replace with Additional Sergeant Position) Town Manager Kleinert said the proposed reorganization was an administrative action and that no new personnel would be added. He said the plan would eliminate the corporal positions and replace them with one additional sergeant position, for a total of four sergeants. He estimated an increase in payroll costs of $5,000 - $6,000 per year. Kleinert noted that one corporal position was currently vacant so that it was a logical time to make the change. He also said the department was looking at instituting a 3/12 work schedule, but it was not the primary reason for the proposed reorganization. -. Vice Mayor Gram asked how other cities in Southern Marin were staffed. ChiefHerley said that in Mill Valley, the sergeants were investigators and did not work in the field. However, Herley said the proposed change in Tiburon would "flatten the department" and create better supervision. Town Council Minutes # 1163 May 5, 1999 Page 2 /-... Lt. Aiello said the City of Sausalito had eliminated the corporal positions and had gone to a 3/12 work schedule. ChiefHerley noted that good supervision reduced liability and said that the Town had experienced a very low lawsuit rate in connection with the Police Department. Councilmember Matthews said that fact represented true value to the Town. In responding to a query about whether the current corporals were going to be demoted, Chief Herley said that the position of corporal was an assignment, not a level, and that the Police Officers Association had not objected to the change. Town Manager Kleinert said the corporal assignments had been in place for 7-8 years. Councilmember Gram asked for a status report in six months. MOTION: Moved: Vote: To Adopt the Recommendations for Reorganization of the Tiburon Police Department and Position Reclassification Matthews, Seconded by Thompson AYES: Unanimous ABSENT: Hennessy 8) HERITAGE & ARTS COMMISSION - (Consider Increase in Commission Membership from Five to Seven Members) - (Resolution) -. Chair Susan Travis said there was a growing need, due to the increase in projects given to the Commission, for more members. She said three out offive of the current members worked full- time, and another member had been absent for most of the year due to illness. Travis said the Commission was working on a permanent historic display for the Town Hall Lobby which would extend into the Council Chambers and feature current local government. She also said the Commission could work on gathering the necessary data for the completion of the downtown historic study. MOTION: Moved: Vote: To adopt resolution increasing the number of Heritage & Arts Commissioners from Five to Seven Matthews, Seconded by Gram . AYES: Unanimous ABSENT: Hennessy H. UNFINISHED BUSINESS 9) DOWNTOWN TmURON HISTORIC RESOURCES STUDY - (Consider Acceptance of Study and Recommendations) Planning Director Anderson said the study recommended adoption of guidelines to preserve the ........ character of downtown rather than designating it an historical district. He also said that Staff and Town Council Minutes # 1163 May 5, 1999 Page 3 ,-.. the Heritage & Arts Commission endorsed this recommendation, along with the idea of completing a local historical inventory in order to be able to apply the appropriate Uniform Building Code sections to new projects in the downtown area. Anderson said the Planning Commission endorsed the report and suggested additional guidelines, such as emphasizing graphics and signage of an historic nature, and to maintain the "walkability" of the downtown area. Anderson recommended proceeding with an RFP to prepare the guidelines and to come back with a cost estimate to Council. Council had the following comments: Councilmember Matthews said that Beverly Bastian's article in "The Ark" suggested that there were factual errors in the report which should be addressed. Planning Director Anderson noted that one of the alleged errors was not significant, e.g. dating a building to 1870 versus 1876. Councilmember Thompson said it was a great report and helped the Town meet its goals of preserving the downtown area without have to designate an historic district. - Vice Mayor Gram thanked Heritage & Arts Commission Chair Travis for conducting the workshops on the study, and said they had been helpful and enlightening. He suggested adding language to the proposed remodeling guidelines [on page 21] to include buildings" . . . that are deserving of recreation or replication. " Moved: Vote: To accept the Downtown Tiburon Historic Resources study, and to incorporate Councilmember Matthews' and Vice Mayor Gram's suggestions; and authorize Staff to further develop the necessary documentation required. STAFF & TOWN MANAGER REPORTS 10) SHORELINE PARK LIGHTING - (Replacement oflights near Elephant Rock Fishing Pier) Superintendent of Public Works Iacopi said that three prototype replacement lights had been installed near Elephant Rock. He said he found the fixtures on the East Coast which were like the original lamps but better sealed. Town Manager Kleinert suggested that Council take a look at the fixtures. - Town Council Minutes # 1163 May 5, 1999 Page 4 ,-... 1 I) MARTHA COMPANY UPDATE - (Oral Report - Planning Director) Planning Director Anderson said that owners' representatives had made an appointment with Staff to meet on May 17 for a pre-approval of the application. He said they would follow up in June with a new application. 12) STAFF LEVEL DESIGN REVIEW PROCESS - (Oral Status Report - Planning Director) Planning Director Anderson said that in the first three months since the new process was instituted, 41 applications had been received and 30 had been reviewed and acted on by Staff, with one referral to DRB and no appeals. He said the remainder of the applications was also being processed. 13) REDWOOD mGH SCHOOL SENIOR GRAD NITE TffiURON PROJECT - (planning Director) Planning Director Anderson said that the seniors would help with the [pOSe] multi-use path survey, and that there would be adult supervision. On a separate matter, Councilmember Thompson asked for the status of his recommendations for improvements to the Reed Ranch Road intersection and to the Del Mar path. Town Manager Kleinert said the Traffic Safety Committee was waiting for the Town Engineer's report and that the items would be on an upcoming agenda -- Town Manager Kleinert also asked Council to pick a date for the Ferry Dock project workshop.
