8 Council. We have called this special meeting for
9 approval of minutes and revised resolution in order to
10 accommodate the litigation schedule in the TRAUMAS case
11 that was filed against the Council's action on July
12 31st.

We've agreed to an expedited hearing schedule with
14 the petitioner's counsel and can make that schedule
15 possible.
He has asked that we prepare the
16 administrative record by tomorrow and deliver it to him.
17 In order to prepare the administrative record, we need
18 approved minutes and the finalized resolution.

19 we bring the minutes to you tonight.
20 There's been a couple questions to what the minutes
21 need to contain. They need only be an accurate and
22 correct record of the Town Council's proceedings.

Second, the resolution. When we came to you on
5 July 31st, we had prepared a draft resolution for your
6 consideration. At that meeting you asked us to make
several additions, which we did.
f After that meeting, MERA asked for a couple of
9 clarifications, which I've outlined in your staff
10 report. And Mayor Tom Gram and a couple of other
11 members of staff also recommended a couple of
12 ambiguities that could be cleared up.

They are none of them substantive, but
18 there are a number of them.

The first change is in Section 1, Finding C. We've

1 resolution of the siting problem set forth in the June
2 19th, 2002 staff report. We've also clarified the
3 statutory basis for the urgency ordinance. We believe
4 there's been some confusion about that.
5 Next in Section 1, Finding F.2, we've included
6 Sausalito as one of the areas that would not be reached
7 in some of the sites that were rejected as unfeasible.
R Next, Section 1, Finding F5, we've amended this
9 section to note that the EMF report depicts worst case
10 emission and also to note that the facility's emissions
11 will be substantially below FCC standards.
12 Next, Section 1, Finding F.6, we've added a

13 sentence to the end of the finding noting that the

antenna would be partially shielded from view by mature

believe was the Council's intention all along.
Section 2, Condition 6, as directed at the meeting,
we've added the requirements for safety shielding and/or
relocation of the propane tank to reduce the likelihood
of an accident, protect persons and property from harm
in the event of an explosion.
Section 2, Condition 9, we've clarified that the
8 air conditioning units shall be placed on the equipment
9 shed in the location where the least noise shall be
10 heard from neighboring homes and that a high quality of
11 muffler with best sound attenuation -- excuse me, I
12 think there seems to be a typo in the staff report, but
]3 I'm pretty sure it did not carry through to the reso --
14 be provided to the generator.

Section 2, Condition 11, we've clarified that the

vehicle description applies only to HERA related

traffic.
Section 2, Condition 12, we've clarified the
lighting restriction only applies to HERA facility.
Section 2, Condition 14, we've clarified this
condition to apply to the sites redwood trees. We've
also provided that the subject tree protection,
landscape screening enhancement plan shall be
implemented as soon as practicable to ensure maximum
survivability of the trees.

Section 2, Condition 15, we've corrected this
2 condition to state that only one antenna shall remain
3 after the HERA facility is complete.
4 Section 2, Condition 18, at the July 31st meeting,
5 Council directed staff to add this condition requiring
6 HERA to relocate the antenna facility if the Town
7 located a new nonresidential site and obtained permits
8 and financing.
9 We've clarified that HERA would not literally move
10 the Sugarloaf antenna but would construct a new facility
11 at the alternate site and then deactivate and remove the
12 Sugarloaf facility.

We've also clarified that MERA will assist in
14 locating the site and obtaining permits and would be
15 responsible for any necessary FCC licenses.
16 And that, I believe, are all the changes in the
17 draft that's before you.

6 was speaking to this issue the other night right there
7 made the point, you know, you want to anchor this thing
8 in place, you know. And it just makes so much more
9 sense, you know, like do the best, anchor it down so we
10 don't have the accident. Then additionally we'll work
11 on some sort of shielding.

20 description of the meeting that 'is fair and accurate.

it just seems like a completely inappropriate time.

Number two, I object to the minutes because I don't

believe that they're a fair and accurate representation

of what actually occurred in that meeting that occurred
21 on the 31st.
22 Number three, I object to the resolution because I
23 don't believe it properly reflects the resolution that

I too object to the resolution and --
MAYOR GRAM: Hand me one of those (unintelligible)
MR. LANTIER: On behalf of TRAUMAS, I'd like to
simply read the objection and submit to the Town Council
and to the Town Clerk our response with some comments to
the resolution and the 13 pages.
TRAUMAS objects to the entire resolution below on
the grounds it is invalid, incomplete and it contains
statements and conclusions which are not supported in
the administrative record which TRAUMAS wishes to

incorporate by reference.
In italics, TRAUMAS has
17 refuted certain contents within the resolution,
18 including but not limited to the lawfulness of the"
19 resolution being adopted by the Town Council after Town
20 Ordinance Number 469 N.S. expired.
21 We therefore wish to preserve our rights
22 accordingly and offer some additional details in certain
23 segments of the resolution.

25 to some of the characterizations, if you will, in the

2 respect to some of the findings here, specifically for
3 example, the minutes seem to indicate, Mr. Mayor, that
4 you're expecting the Sugarloaf residents to finance the
5 alternative site and

9 MR. LANTIER: Well, in reading the minutes today,
10 that's at least what I've read, at least the first
11 draft.
12 And I see that Section 2, Condition 18 is silent on

13 whose cost, at whose cost might this so-called temporary
14 site be if HERA does move it. So I'd like some
15 clarification with respect to that, at least the
16 difference between the minutes and the fact that this is
17 silent on this.
18 Secondly, I notice that the six-foot fence wil~ be
19 located around the water tank. We had previously
20 submitted to the Town prior to July 31st some
21 suggestions with respect to how we might mitigate a
22 number of things with the design that was finally
23 transitioned into the location about 12 feet from the

25 And one of the items that we also indicated was

1 that we'd like not to see a six-foot fence erected on
2 the top of the berm but security obviously would have to
3 go around the site should the antenna come there, but
4 all that would do is just increase the visual adversity
5 as far as we're concerned.
6 We also suggested not only to staff but also to
i Executive Director Nichols what might be an ideal
8 solution, take the dish off the antenna, move it across
9 the road, not monkey with the EIR but put it on MWD's
10 site which they own across the road, provided that the
11 line of sight would shoot around the Zimmerman house as
12 opposed to shooting over the house.
r--, 13 That would allow the antenna to be moved forward,
14 get it out of our FCC problem that we have right now, at
- o. least what was discussed in the public meeting as being
~6 125 percent of FCC standard by virtue of moving in the
17 same line of 270 true, we might well be able to drop the
18 monopole with respect to height, still provide the 'same
19 coverage, maybe even better coverage, but by moving it
20 forward, reduce the plane, if you will, and therefore
21 grasping the RFR at the property line of my house as
22 well as the Cades' house.
23 None of that seems to have gotten into the record

24 with respect to comments or rejections, if you will, as

25 to why none of that might be feasible.

We obviously are very disappointed about that.
So
3 we clearly have an awful lot of trouble with the most
4 recent staff report. Thank you for your attention.

MR. LEVKOF: Allan Levkof, 131 Sugarloaf.
6 First of all, thank you very much for your
7 clarification on the radiation with respect to both
8 antennas running at maximum that we talked about last
9 night.
10 I object to the minutes with the various radiation
cl conclusions, because, of course, they were described
12 without any firm engineering specifications and without

c3 any source document for engineering analysis.
As a
14 result, I think any engineer would tell you that the
15 conclusions described in the minutes are invalid from a
16 technical and engineering point of view.
17 I also object to the lack of consistency on behalf
18 of the Town Council. As was pointed out several times,
19 three to five Town Councilmembers were in fact on the
20 Planning Commission in June of 2'000. And those three
21 members did not believe the engineering conclusions put
22 forward in June of 2000 with respect to Mount Tiburon.
23 I don't believe those either. And now for some apparent

24 reason we do believe these better.

1 June 14th of 2000, where it was pointed out by our
2 consultant, Mr. Hamit (phonetic) that if the pole on
3 Mount Tiburon were moved to the front of the cul-de-sac,
4 there would be no significant EMF exposure for any of
5 the homes on or near Mount Tiburon.
6 So obviously, as we've said before, we applaud the
7 Planning Commission for having turned down the Mount
8 Tiburon HERA application at that point in time. And I
9 strongly believe that the engineering analysis on
10 Sugarloaf is far less comprehensive, and therefore far
11 less valid to go ahead and approve the resolution
12 tonight.

MR. LANDAU: Good evening, I'm George Landau. Just
15 a clarification, on page 15 of the minutes, Item 12, I
16 suggested that you all abstain from approving HERA to
17 give us time in order to contact and put into action the
18 campaign for Angel Island, using the political process
19 mentioned to Senators and House of Representatives
20 people. That was the main reason for that statement.
21 And I think the record should show my concerns were
22 that although Angel Is~and may be considered in the past
23 and rejected, but it was not rejected after our attempts

24 to go into the real heavy-duty pristine political people
25 that we have available to us.

4 as of today I have received a phone call that Gray
5 Davis' Intergovernment Affairs person, Dave Rosenberg,
6 is very interested in putting this antenna on Angel
7 Island, much to the contrary of what you said about our
8 Governor Gray Davis.

4 that point, as far as Angel Island becoming an approved
5 site, the leverage would be on industrial sites, plural,
