AGREEMENT TO MAINTAIN TREES AT 12 CIBRIAN DRIVE
This agreement is made this 9 day of 1, 1995, by and between the Town c414
of Tiburon (hereafter "Town") and Charles and Patricia Hartmann (hereafter "Hartmann"). *M t"
RECITALS
A. On November 3, 1994, the Town issued to Hartmann a tree permit for 12 Cibrian Drive
pursuant to the provisions of Chapter 15A of the Tiburon Municipal Code.
B. As a condition of that permit Hartman is required to maintain certain trees on the property
at 12 Cibrian Drive at a specified height. This condition of approval is to be memorialized
in a recorded agreement which will run with the land.
C. Neither the permit issued to Hartmann nor this agreement are intended to supercede or
change` erighof the parties under Chapters 15 or 15A of the Tiburon Municipal Code.

D. The parties now wish to comply with the above-referenced condition of approval by 4141V
executing this agreement.
Based on the above stated recitals of fact, the parties hereby agree as follows:
1. Hartmann may maintain the eight (8) Monterey Pine trees currently at 12 Cibrian Drive.
These eight trees are marked as 1-8 on the attached Exhibit - A, which is hereby
incorporated by reference as though fully set forth herein. These trees shall not be allowed
to exceed a height of thirty-five (35) feet at any time hereafter.
2. The terms of this agreement shall be binding upon Hartmann's heirs, successors, and
assigns.

3. This agreement shall be recorded with the Marin County Recorders Office.
