Re: Agreement Between Marin Municipal Water District and the
Town of Tiburon Regarding Tree Maintenance on District Lands
Dear Bob:
This letter sets forth an agreement between the Town of Tiburon and MMWD
regarding tree maintenance on MMWD sites in Tiburon. Please sign below and
return one copy of this letter to me for my file.
The Town of Tiburon recognizes Marin Municipal Water District's (MMWD)
authority to maintain and operate its facilities necessary for the production
of water. In that regard, MMWD may maintain and remove as it sees fit trees
and shrubs on the sites of its water storage and distribution facilities within
the town limits of Tiburon without obtaining permits or seeking permission from
the Town, or paying any fees.
On the other hand, MMWD recognizes the right of the Town of Tiburon to
authorize tree removal through its permitting process for trees and shrubs
located at the site of MMWD facilities which are not related to the
distribution or storage of water.
MMWD agrees to provide written notification to the Town of Tiburon ten (10)
days in advance regarding removal of trees on sites where water storage and
distribution facilities are located (emergency removals excepted). The ten
(10) day advance notification provision allows MMWD to notify residents who may
live near such sites with the attached form so that they may have an.
opportunity to comment directly to the District.
MMWD further agrees to coordinate with the Town of Tiburon in the selection of
tree species for new plantings at all its sites so that the mutual interests of
the Town and the District may be realized.
