CALL TO ORDER AND ROLL CALL:
Vice-Chair Corcoran called the meeting to order at 7:33 p.m.
Present: Vice-Chair Corcoran, Commissioners Kunzweiler and Tollini
Absent: Commissioners Doyle and Frymier
Staff Present: Director of Community Development Anderson, Director of Public Works
Nguyen and Minutes Clerk Levison
ORAL COMMUNICATIONS: None
COMMISSION AND STAFF BRIEFING:
Community Development Director Anderson provided an update on likely upcoming agenda
items. The Commission's first January meeting will include a presentation on the preliminary
draft Housing Element and possibly review of the use permit application recently filed by CVS.
The Commission's second January meeting is expected to include consideration of the Alta
Robles project merits and Final EIR. The Parente Vista project, who's Precise Development Plan
was approved last year, has filed its tentative map. This is expected to come before the
Commission a little later in the year. ,
Vice-Chair Corcoran questioned and confirmed with staff that if not ready for the January 12,
2011 meeting, the CVS project may come forward at the January 26 meeting.
PUBLIC HEARING
1. ONE BLACKIE'S PASTURE ROAD: CONDITIONAL USE PERMIT TO
CONSTRUCT AND OPERATE A PERMANENT PUBLIC RESTROMM
BUILDING NEAR BLACKIE'S PASTURE: FILE 911004; Town of Tiburon,
Owner and Applicant; Assessor's Parcel No. 055-041-19
Community Development Director Anderson presented the staff report, stating the Town has
initiated a use pen-nit application to construct and operate a second permanent public restroom
building near Blackie's Pasture Park. The proposed building, a prefabricated one-story RomTec
construction, would provide four additional bathroom stalls adjacent to and on the southwest side
of the existing 2-stall restroom facility, near the multi-use path.

He stated that as the site has no immediate neighboring homes, any property that could
potentially have a view of the proposed building did receive notice of the project and no
comments have been received to date. Staff finds the project to be consistent with all zoning
requirements and General Plan policies.
There were no public comments.
Vice-Chair Corcoran noted that the restroom building shown in the staff report photos had
skylights, and asked whether the proposed building would have skylights. He confirmed that any
skylights would be tinted to diffuse light pollution and asked how interior illumination would be
regulated.
Director of Public Works Nguyen stated that this building, like the current facility, would be
locked at dusk. Presumably, light pollution should not be an issue as all lighting and electrical
power is shut down at that time.
Commissioner Tollini requested more background on the funding for this project. Mr. Nguyen
stated the Town received a "per capita" recreation grant from the State a number of years ago, of
which roughly $200,000 remains. The Town intended to earmark that money for potential use on
the Ned's Way joint recreation facility; however, it recently became clear that the Ned's Way
facility could not be completed in time to utilize the grant money. Staff identified two alternative
projects, one of which was construction of a decomposed granite jogging path extending from
South of Knoll Park to the treatment plant near McKegney Green. That project required the
displacement of a number of utility boxes and facilities and essentially became infeasible within
the brief time window remaining to expend the grant money. The restroom project proved to be a
great candidate, given the tremendous growth of use Blackie's Pasture has seen over the past few
years. The soccer league increases their play there each year and the Town has ended up renting
port-o johns to accommodate the growing number of visitors. Staff saw the need, felt this would
be a good use of the funds, and quickly developed the project in-house.
Commissioner Tollini asked if it would make more sense to add on to the existing structure,
rather than constructing an additional facility. Mr. Nguyen explained the modular buildings come
as fully stand-alone kits. Staff prepared an analysis on expanding the original structure and found
the stand-alone approach to more cost effective and less complicated than attempting to add on
to the existing restroom building.
Vice-Chair Corcoran thanked Mr. Nguyen for providing background on the grant. His primary
concern was to ensure that this project is a priority, rather than an opportunity. He appreciated
staffs thorough research and that the project will eliminate need for the unsightly port-o john.
He said Blackie's Pasture and the multi-use path are some of the Town's best-used and most
cherished assets; these both contribute greatly to the Town's identity as a tourist destination and
help to sustain property values.
ACTION: It was M/S (Tollini/Kunzweiler) to adopt the draft resolution conditionally approving
the project at One Blackie's Pasture Road. Motion carried: 3-0.

Vice-Chair Corcoran requested the following correction to the Minutes:
• Page 5, 4th full paragraph - "...that the use under the conditional use permit should not
be micromanaged, but as long as issues continue..."
ACTION: It was M/S (Kunzweiler/Tollini) to approve the minutes of November 10, 2010, as
amended. Motion carried: 3-0.
ADJOURNMENT:
The Planning Commission adjourned the meeting at 7:48 p.m.
