Code § 27383] NOTICE OF PRIVATE EASEMENT THIS NOTICE OF PRIVATE EASEMENT, is made and executed at Tiburon, California, this day of f5-5 , 2011, by Margarita Perry ("Owner"). RECITALS A. Owner is the owner of 549 Silverado Drive, in Tiburon, CA, which is more precisely described on Exhibit A, attached hereto and incorporated herein by reference ("Project Site"). The Project Site includes a drainage easement ("Easement") that was never offered to nor accepted by the Town of Tiburon or any other public agency. B. The Easement contains a drainage pipe ("Pipe") that receives water runoff from adjacent private properties and the Town-owned street. In 2008, the Pipe began showing signs of disrepair. Owner has requested that the owners of the nearby properties and the Town contribute to the repair of the Pipe, estimated to cost approximately $30,000. C. The Easement and Pipe benefit properties other than the Project Site. Compelling these properties to contribute towards repair of the Pipe would be time-consuming and potentially costly. To avoid such delay, the Town is prepared to contribute $15,000 towards the Project, in addition to funds already expended, provided that Owner acknowledge that the easement is privately owned and that the Town's contribution does not indicate acceptance of any present or future responsibility for the Pipe or Easement. NOW, THEREFORE, OWNER ACKNOWLEDGES THE FOLLOWING: 1. The Town has no legal property interest in the Easement or the Pipe, which are privately owned. 2. The Town's contribution towards repair of the Pipe shall not be construed as 1/ 2 accepting liability or responsibility for the Easement or Pipe. 3. This Memorandum includes Exhibits A, which are attached hereto and incorporated herein by reference.
