Town Council Meeting TOWN OF TIBURON 1505 Tiburon Boulevard October 18,2017 s, Tiburon, CA 94920 Agenda Item: PH STAFF REPORT To: Tiburon Town Council From: Greg Chanis, Town Manager Subject: Introduction of Ordinance to Disestablish the Tiburon Tourism Business Improvement District and Public Hearing Reviewed By: - BACKGROUND The Town created the Tiburon Tourism Business Improvement District ("TTBID") in 2007 to fund a marketing program to promote tourism. The TTBID raises funds by imposing assessments on the lodging establishments in the Town, creating a revenue stream to help market the Town as an overnight destination for visitors. The state law governing the TTBID is the Parking and Business Improvement Area Law of 1989, Section 36500 et seq. of the California Streets and Highways Code (the "Act"). Between 2007 and 2013, the Town directed the TTBID funds to the Marin Convention and Visitor Bureau (MCVB) for use in a countywide program. Concluding this use of the TTBID funds was not providing sufficient benefit to their establishments, in 2013 the hotels requested the Town terminate the contract with the MCVB, and explore options for utilizing the funds in a more effective way. With the support of the hotels, the Town formed Destination Tiburon in 2014. Destination Tiburon was incorporated as a public, non-profit benefit corporation to act as a tourism bureau, with the mission to "Promote Tiburon as a world class destination." Since 2014, and in consultation with the hotels, Chamber of Commerce and other interested parties, the Town has directed TTBID funds, along with a portion of the Town's Transient Occupancy Tax, to Destination Tiburon for the development of a marketing program. Although the TTBID has provided a steady stream of revenue to fund Destination Tiburon, collecting and managing the assessments associated with the TTBID creates additional administrative burdens and costs, and limits the activities Destination Tiburon can engage in on behalf of the hotels. The hotels, with the support of the Board of Directors of Destination Tiburon (the Board), requested that pursuant to Section 36550 of the Streets and Highways Code, that Town Council begin the process for disestablishment of the TTBID, because services provided by Destination Tiburon may continue under alternative arrangements. Town Council Meeting October 18,2017 The Town Council considered the request at the meeting on September 19, 2017, and adopted a resolution of intention to disestablish the TTBID which set the required Public Hearing on this matter for October 18, 2017 at 7:30 p.m. Notice of the Public Hearing was provided pursuant to Section 36523 of the Streets and Highways Code. The Town Council may disestablish the TTBID by adopting an ordinance after holding the Public Hearing on disestablishment. DISCUSSION Streets and Highways Code section 36550 requires that the Town Council hold a public hearing on disestablishment of the TTBID. Upon conclusion of the hearing and consideration of any protest, the Town may disestablish the TTBID by adoption of an ordinance. Besides requiring a public hearing, the Streets and Highways Code, in section 36551, also requires that upon disestablishment of TTBID, "any remaining revenues derived from the levy of assessments, or any revenues derived from the sale of assets acquired with the revenues, shall be refunded to the owners of the businesses then located and operating within the area in which assessments were levied by applying the same method and basis that was used to calculate the assessments levied in the fiscal year in which the area is disestablished." Assessments collected by the Town from hotels for the TTBID have previously been transferred to Destination Tiburon in order to provide services, and the TTBID has no further assets to be liquidated. Thus there are no remaining revenues to be refunded in event of disestablishment. RECOMMENDATION Staff recommends that the Town Council: 1. Hold a public hearing and consider any testimony. 2. Pass a motion to read the ordinance by title only. Mayor will introduce the ordinance by reading its title only: "An Ordinance of the Town Council of the Town of Tiburon Repealing Ordinance Nos. 498 N.S. and 546 N.S., Repealing Chapter 7A of Title II of the Tiburon Municipal Code, and Disestablishing the Tiburon Tourism Business Improvement District", and waiving further reading. 3. Pursuant to California Streets and Highways Code Section 36550, the 44 Town Council hereby disestablishes the Tiburon Tourism Business Improvement District. 45 SECTION 3. In accordance with California Streets and Highways Code Section 36551, 46 upon the effective date of this ordinance, any remaining revenues derived from the levy of 47 assessments, if any, or any revenues derived from the sale of assets acquired with the revenues, if 48 any, shall be refunded to the owners of the businesses operating within the Tiburon Tourism 49 Business Improvement District.that are current in their annual assessment by applying the same 50 method and basis that was used to calculate the assessment levied this fiscal year. 51 SECTION 4. The recitals provided in this ordinance are true and correct and are 52 incorporated into the substantive portion of this ordinance. 53 SECTION 5. If any section, subsection, sentence, clause or phrase of this ordinance is 54 for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or 55 constitutionality of the remaining portions of this ordinance. The Town Council hereby declares 56 that it would have passed this ordinance and each section, subsection, clause or phrase hereof, 57 irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases 58 be declared unconstitutional. 59 SECTION 6. The Town Council finds the approval of this ordinance is not subject to 60 the California Environmental Quality Act ("CEQA") pursuant to Section 15060(c)(2) (the 61 activity will not result in a direct or reasonably foreseeable indirect physical change in the 62 environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the 63 CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no 64 potential to have a significant effect on the environment. 65 SECTION 7. This ordinance shall be in full force and effect thirty (30) days after the 66 date of adoption. Pursuant to the provisions of the California Government Code, a summary of 67 this ordinance shall be prepared by the Town Attorney. To: Mayor and Members of the Town Council From: Department of Public Works Subject: 31 Apollo Road: Appeal of the Public Works Director's Denial of an Encroachment Permit for a fence within the Public Street Right-of-Way; Richard Greenberg, owner; applicant and appellant; Assessor Parcel No. 034-262-31 Reviewed By: BACKGROUND On September 18, 2017,Richard Greenberg, the property owner of 31 Apollo Road, submitted an Encroachment Permit application to legalize the replacement of a fence within the public right of way along the portion of the subject property fronting Mercury Avenue. During the investigation into this matter staff was unable to determine when this fence was originally constructed and there were no permit records found to indicate its legality. Staff determined that it was impermissible in accordance with section D.1 of the Town Council Resolution No. 45- 2014, and therefore, the application was denied. Mr. Greenberg subsequently filed a Notice of Appeal of staff's determination, and that appeal is before Council this evening. Prior to the submission of the Encroachment Permit application, the Building Division received and approved plans for the subject property to perform work within its boundaries. The approved plans for this work explicitly stated the existing fence would remain unaltered during construction as shown in Exhibit 1. A photo of the fenced area prior to construction is attached as Exhibit 2. During final inspection of the project conducted on June 29, 2017 it was discovered the fence was completely reconstructed despite the plans indicating otherwise, with a portion of the work occurring outside of the property boundaries. This work was completed without the benefit of a Building Permit, or issuance of an Encroachment Permit from the Department of Public Works. A photo of the reconstructed fence is attached as Exhibit 3, with the area of construction outside of the property boundaries shown in Exhibit 4. A Correction Notice detailing these deficiencies was issued on June 29,2017, and the owner of the property was informed that a final Occupancy Permit could not be issued until all outstanding issues were resolved. At the time of the June 29 inspection referenced above, Mr. Greenberg was not the owner of the subject property, but rather, was under contract to purchase the property, with the closing scheduled for June 30. As the lack of an Occupancy Permit would delay the closing, and Mr. Greenberg was planning to move into the house immediately, one of the real estate agents TOWN OF TIBURON PAGE 1 OF 3 associated with the transaction contacted the Town Building Official and requested a Temporary Occupancy Permit be issued, allowing the closing to occur as scheduled. This request was denied. The agent subsequently contacted the Town Manager to discuss this matter, and after consultation with the Town's Building Official, the Town Manager authorized the issuance of a Temporary Occupancy Permit. This authorization was given only after clear assurances from the agent that the new owner, Mr. Greenberg, would be advised of the issues related to the fence. Specifically, Mr. Greenberg was to be informed of the following: An Encroachment Permit was required for the portion of the reconstructed fence located in the public right of way;the Encroachment Permit would be denied, and that the portion of the fence in the public right of way would very likely need to be removed. Analysis Town Policy Town Council Resolution No. 45-2014, section D.1 states, "Encroachment permits for work within, upon, or beneath Town streets, street right of ways, and other Town interests in real property (including easements) should not be issued" ... "for the purpose of, or having the practical effect of, privatizing the affected area for the exclusive use or benefit of one or a limited number of individual owners in lieu of the general public, except as may be authorized under section C.5" Section C.5 of the resolution is specific to parking and therefore does not apply to fence enclosures. Section CA of the resolution allows encroachment permits for the maintenance, repair or replacement of previously lawfully-installed encroachments. There are no records of the fence being legally installed therefore this section is also not applicable. The Appeal The Notice of Appeal submitted by the applicant is attached as Exhibit 5, with a letter from the applicant detailing the basis for the appeal attached as Exhibit 6. Staff Opinion Staff has considered the appeal and does not believe the encroachment meets the standard set forth by Town Council Resolution No. 45-2014. Since the purpose of the fence is to restrict access to the general public, it privatizes the affected area for the exclusive use or benefit of one or a limited number of individual owners in lieu of the general public. The only times this is allowed in the resolution is in the exception provided in Section CA and C.S. These sections seem to not be applicable because there are no permits on record to indicate the fence's legality and the fence is not necessary for parking Since the adoption of the Town's encroachment policy in 2010, Town staff has disallowed similar encroachments with the understanding that enclosing portions of the public right of way for the exclusive use and benefit of a single property owner is impermissible. For these reasons, staff believes that the appeal does not meet the criteria set forth in the Town's encroachment policy for permanent structures, and concludes that staff does not have the discretion to approve or recommend approval of the encroachments as proposed. RECOMMENDATION Staff recommends that the Town Council: 1) Hear the appeal pursuant to the Town's adopted procedures (Exhibit 5). 2) Indicate its intention to deny the appeal and direct staff to prepare a resolution to that effect for adoption at the next regular meeting. Any person making such an appeal must file a completed Town of Tiburon Notice of Appeal form, available on the Town's web site and at Town Hall,with the Town Clerk not more than ten(10) calendar days following the date of the decision being appealed. Shorter time frames for filing an appeal apply to certain types of permits. If the final day to appeal occurs on a day when Town Hall is closed for public business, the final day to appeal shall be extended to the next day at which Town Hall is open for public business. If, following deliberation, the Town Council is prepared to make a.decision on the appeal, it will direct Town staff to return with a draft resolution setting forth the decision,and the findings upon which it is based, for consideration at a future Town Council meeting. The decision of the Town Council is not final until the resolution is adopted. Alternatively,if the Town Council is not prepared to make a decision on the appeal, it may, (a) Continue the appeal to a future date; (b) Remand the item to the review authority from which it was appealed for further hearing,review and action,with a specific description of the outstanding and unresolved issues and appropriate direction thereon;or (c) Refer the item to another review authority for its review and recommendations prior to further Town Council consideration. 9. Following a final decision by the Town Council,Town staff will promptly mail a Notice of Decision to the applicant and appellant. RECOAIS,(DE.RA TION If, after the Town Council has voted to direct staff to prepare a resolution of decision,significant new information comes to light,which information was previously unknown or could not have been presented at the appeal hearing due to circumstances beyond the parties' control and not due to a lack of diligence,the Town Council may entertain a motion to reconsider its direction to prepare a resolution of decision. Any such motion to reconsider must be made prior to adoption of the resolution of decision, and the motion must be made by a Councihnember who voted on the prevailing side in the vote sought to be reconsidered. Any Councilmember may second the motion. The Town Council may consider and vote on the motion to reconsider at that time, and if the motion carries,the matter shall be placed on a future agenda for further notice and hearing. Tiburon Town Council Resolution No. 17-2010 03/1712010 3 SCHEDULING OFAPPEALS 1. The Town's policy is to schedule and hear appeals in an expeditious manner. Appeals will generally be heard at the first regular Town Council meeting that is at least fifteen (1 S) days after close of the appeal period. At the sole discretion of the Town Manager, the Town may schedule the appeal for a subsequent Town Council meeting based on the complexity of the matter, availability of key Town staff members and Councilmembers, agenda availability,or unusual circumstances. Town staff will make reasonable efforts to establish the hearing date for the appeal within three (3)working days of the close of the appeal period. The Town Clerk,in coordination with appropriate Town staff, will promptly advise all parties to the appeal of the selected hearing date. 2. The Town Manager will grant requests for continuances from the date established above in the event that all parties to the appeal agree in writing to a date specific for the continuance and that date is deemed acceptable by the Town Manager. 3. Attendance of parties to an appeal at the hearing is desired,but not required. The Town Council will consider written comments or representation by others in lieu of personal appearance. STORY POLES For appeals where story poles were erected for review of the original decision being appealed,a story pole representation shall be required for the Town Council's appeal review process,as follows: I. A story pole plan showing the poles to be connected,including location and elevations of poles and connections,shall be submitted,reviewed, and accepted as adequate by Planning Division Staff prior to installation of the poles and connections. 2. Critical story poles, as determined by Staff,must be connected by means of ribbons, caution tape,rope or other similar and highly visible materials clearly discernable from a distance of at least three-hundred(300) feet in clear weather,to illustrate the dimensions and configurations of the proposed construction. 3. Story poles and connecting materials must be installed at least ten(1 OLdays prior to the Late of the appeal hearing before the Town Council. 4. To allow applicants to maintain,repair or replace previously lawfully-installed encroachments. 5, To accommodate parking that would be required by the Municipal Code for a newly- constructed use of the type associated with the encroachment permit, where the Town finds that(a) the applicant cannot feasibly locate such parking on private property;(b) the public safety or welfare is better served by allowing such parking to encroach; (c)a substantial and material public safety benefit will result in that a substandard safety- related public street condition(such as inadequate width or sight distance)in the project's public street frontage will be made standard or significantly improved; and d)the physical extent of the encroachment is minimized to the extent feasible. 6. To allow applicants the opportunity to secure approval for existing encroachments that the applicant cannot prove were lawfully installed and that are consistent with this policy and Title V, Chapter 19 of the Tiburon Municipal Code. 7. To allow applicants to drain their properties of storm water in a controlled fashion acceptable to the Town Engineer. 8. To allow utility companies to perform necessary work. 9. To allow applicants to position a debris box or portable moving box for temporary construction, storage or moving purposes,where such placement will not unreasonably impede traffic circulation and pedestrian safety or otherwise be detrimental to public safety or welfare. 12. Irrivermi.ssible Purposes Encroachment permits for work within, upon,or beneath Town streets, street right-of-ways, and other Town interests in real property (including easements) should not be issued in the following instances: 1. Encroaclu-nents for the purpose of,or having the practical effect of, privatizing the affected area for the exclusive use or benefit of one or a limited number of individual owners in lieu of the general public,except as may be authorized under Section C.5 above. 2. Encroachments that would block, impede,or discourage public use or access over an area determined by the Town Engineer to be appropriate and suitable for public use or access either at present or in the foreseeable future. 3. Encroachments that in the judgment of the Town Engineer are not necessary or appropriate to serve one of the allowable purposes listed in Section C above. E. Duration. Encroachment permits shall contain conditions of approval to restrict the duration of the encroachment to a reasonable time necessary to accomplish the purpose thereof. 1. Except where the Town grants the permit pursuant to Sections C.1, C.2, C.3,CA,C.5, C.6 or C.7,above, or as provided in E.2,the Town will allow only temporary encroachments. 2. Notwithstanding Section E.1,the Town shall have discretion to issue a permit for a long- term encroaclu-nent if it finds that the encroachment is necessary for public safety reasons or that the encroaching improvement will have a long-term public benefit commensurate with the private benefit to the permit holder. 3. The conditions of approval for any permit for a long-term encroachment shall include, without limitation,the following conditions of approval: a. By acceptance of the permit and construction of the improvements or performance of the work, the permittee agrees to indemnify,defend and hold the Town harmless from any claims, losses, litigation or other liabilities that may arise from the permittee's performance of the work,construction and maintenance of said improvements and removal of the improvements. b. First, please know that we have no intention of challenging or disputing policies that the Town of Tiburon has in place. We fully respect, appreciate, and understand that policies are there to protect this great community and do what is best for Tiburon. We absolutely thank everyone on the Council and with the Town of Tiburon for your leadership and what you do for this great community. When we purchased and moved into the property, we were unaware that there was an issue with the fence location facing Mercury Ave and that it was outside of the property line in an encroached area. It wasn't until 6 weeks after moving into the home that we were made aware that the Certificate of Occupancy wasn't complete and that the home we purchased had an encroachment issue with the location of the fence facing Mercury. The new fence was placed at the same location of the old fence at the property by the builder before we purchased the home. Unfortunately, this was not completed prior to us purchasing the home and we were unaware of this situation. Please know that we inherited this situation as the new home owner. For my family, we bought a new home with a relatively small yard and are now being faced with potentially losing almost 9 feet of our yard, having the fence moved, re-doing landscaping, etc... So, I only ask that you review our situation and understand that we are asking for this encroachment approval as the new homeowners, so we can enjoy the yard and property as it was understood it to be when we moved into the home. This is a truly unfortunate situation, as we were unaware there was any issue prior to purchasing the home. Here's a quick summary of the 3-step BID disestablishment process and associated timeline. Step 1-Council passes a Resolution of Intent to disestablish the BID and sets the date for a Public Hearing. This step occurred on 9/20,with the Public Hearing set for tomorrow, Wednesday 10/18. Step 2-Council conducts a Public Hearing on the matter and passes a motion to introduce the proposed ordinance to disestablish the BID. This called the 'First Reading". This is what will occur tomorrow 10/18. Step 3-Council formally adopts the ordinance disestablishing the BID. This is scheduled for the Council meeting on November 1. The Ceremony has been a very successful community event, comprised of various activities including Gingerbread House making, hand-made ornaments, a horse drawn carriage or hay wagon, and a visit from Santa. The festival then culminates in front of the fully decorated and lighted tree that is turned on at 6pm, followed by a choral presentation from Saint Hilary School and caroling sing-along. A few years ago Destination Tiburon and the Chamber installed permanent rooftop lighting on Main Street and Ark Row. In addition the Town has arranged for the following 1) Lighting of Town Hall 2) Lighting of light poles on Tiburon Blvd (13 w/2 wreaths each 110 w/1 wreath each) 3) Median tree lighting on Tiburon Blvd (from Town Hall to round-about)-trunk wrap only. 4) December 2016 saw the addition of 10 strands of bistro lighting on Main Street. ANALYSIS Looking at the success of this event, both Town Event Coordinator, Patti Pickett, and Chamber of Commerce representative, Melanie Haddad, feel that there is a strong opportunity to build on the Festival, aiming to bring people into Tiburon as a holiday destination, strengthening the community ties to Tiburon, bringing commerce to the downtown area, and offering more family activities to an already successful late afternoon/evening event. Name of event: Tiburon Festival of Lights (Exbibit No. 1) TOWN OF TIBURON PAGE 1 OF 3 .1 o\v 11 Council MCCLing This would be achieved through the following additions to the existing activities listed above: • "Tiburon Festival of Lights" extended Town Lighting project. Council's direction to POST was to work with interested parties in researching options and best practices for the development of an ongoing and sustainable training program and community education campaign focused on bicycle, pedestrian and driver safety. At the POST meeting of September 20, 2016,the Commission appointed Vice Chair Allen and Commissioner Thier to the Bicycle Pedestrian Safety Education ad-hoc subcommittee to study the issue and make formal recommendations to the Commission. The ad-hoc subcommittee engaged in discussions with the community, acquired knowledge about similar programs in other municipalities, coordinated with local schools, town officials, and the police department to compile a report that provides recommendations for creating and maintaining a sustainable, efficient and effective public education program for roadway safety. The Tiburon Ad-Hoc Subcommittee on Bicycle, Pedestrian and Automobile Education Report (The Report) was unanimously approved by the POST Commission at the regular meeting of May 16th. The Report is attached as Exhibit 1 of this staff report. ANALYSIS The Report provides broad direction to the Town to create a public education program focused on bicycle, automobile and pedestrian safety. The following are three of the main recommendations: 1) Use the Tiburon Website, Tiburon Town Talk and Social Media. 2) Provide additional funding for education outreach. 3) Perform infrastructure improvements to enhance bicycle, pedestrian,and driver safety. Staff has analyzed the report and used its recommendations to generate a Bicycle, Pedestrian and Automobile Education Implementation Plan (The Plan) that is attached to this staff report as TOWN OF TIBURON PAGE 1 OF 2 Exhibit 2. The Plan identifies specific recommendations included in the report that staff has determined can be implemented immediately, or in the very near future. This Report delineates a few recommendations that the Town can potentially implement to achieve this goal. BACKGROUND On August 17, 2016, The Tiburon Town Council, through Vice-Mayor Jim Fraser, requested that the Parks, Open Space and Trails Commission (POST) strengthen the 2016 Bicycle Pedestrian Master Plan section on Education Programs and create a Subcommittee to look at the issue of bicycle, pedestrian, and automobile safety education in Tiburon and report its findings back to the Town Council. The Tiburon Town Council directed that POST begin its efforts at strengthening the "Education Programs" Section of the 2016 Bicycle Pedestrian Master Plan by: • Re-engaging with their partners in the training programs and develop an ongoing, sustainable training program for bicycle and pedestrian safety. • Working with interested parties to research options and best practices for the development of community education campaigns focused on bicycle, pedestrian and automobile safety. At its September 20, 2016 meeting, the Parks, Open Space and Trails Commission appointed Commissioners Ms. Holli Thier and Mr. Park Allen to lead this Subcommittee and to make recommendations to POST and to the Town Council. The Subcommittee followed a process of gathering public input, which included the following elements: 1. Outreach to individual stakeholders in the Town of Tiburon 2. Outreach to organizations and groups of individuals working on these issues 3. Outreach to the schools, Town of Tiburon departments, residents, and visitors to Tiburon 4. Mass E-mail blasts to individuals who have expressed a past or current interest in these issues 5. Hosting public meetings at which individuals and organizations could share ideas on how to improve bicycle, pedestrian, and automobile safety outreach and education. A Bicycle, Pedestrian Safety Education Workshop was hosted by the Ad-Hoc Subcommittee of the Parks, Open Space and Trails Commission on November 29, 2016. This meeting was publicized in The Ark, to the schools, and a Town email address was disseminated for any member of the public to share ideas with the Subcommittee. We want to recognize Tiburon Town Mayor, Mr. Jim Fraser for his vision and dedication to the safety of all who live, work, play and visit Tiburon. Without Jim's dedication and the Town Council's support to looking at ways to enhance bicycle,pedestrian and automobile safety and education here in Tiburon, our Subcommittee would not exist. We want to especially recognize members of the Town staff who worked very hard to begin the implementation of some of the recommendations during the time period that we were doing our work. Their proactive approach and responsiveness to the community's suggestions should be recognized and commended. The Ad Hoc Subcommittee wants to acknowledge the very hard work of Town staff Members, Patrick Barnes, PE, Town of Tiburon Director of Public Works/Town Engineer, and Dmitriy Lashkevich, Associate Civil Engineer. Not only were they always available to assist the Subcommittee with everything we needed, but they even started implementing ideas (website updates) from the public prior to our report being published. During our process, the Ad Hoc Subcommittee on Bicycle, Pedestrian, and Automobile Safety Education looked at what efforts are existing in Tiburon, what are best practices recommended or implemented in other jurisdictions, and what Tiburon could do in the future. It is the Subcommittee's purpose to gather the research for the Town Council for their potential future action. Rather, the single goal of the Subcommittee is to assist the Town of Tiburon in enhancing safety for auto drivers, transit riders, and those who walk or bike in Tiburon through enhanced outreach. The Subcommittee did not receive any bad ideas and wishes to also acknowledge the wonderful participation of the residents and stakeholders here in Tiburon for their dedication to improving safety here in Tiburon. EXECUTIVE SUMMARY The Town of Tiburon has made great efforts to provide outreach to its residents and visitors regarding how bicyclists, pedestrians and automobile drivers can safely share the road and paths throughout Tiburon. The Ad-Hoc Subcommittee details many of these efforts in this Report and recommends that they all be continued. The Ad-Hoc Subcommittee looked at ways to strengthen these efforts and to provide greater outreach to Tiburon residents, visitors, workers, and travelers by recommending the most cost-effective ways to enhance outreach. Although we attempted to gather a comprehensive list of all that is currently being done, we apologize if we are unaware of any specific effort. In addition, efforts are changing every day, which means since our outreach concluded or this report was written, there might be additional bicycle, pedestrian and automobile safety education efforts which will not be identified in this report. The Town of Tiburon is currently performing the following Bicycle, Pedestrian and Automobile Safety Education efforts: A. The Town of Tiburon o Infrastructure Improvements for Bicyclists, Pedestrians and Motorists ■ The Town of Tiburon works daily to improve safety for Bicyclists, Pedestrians and Motorists. A few recent examples are Blackfield Crossing Bike Boxes and Avenida Miraflores Bike Lanes, Installation of audible pedestrian crossing signals at T iburon Boulevard and Beach Road, installation of a flashing beacon at Neds Way, utilizing the electronic changeable message sign to inform drivers of upcoming events that may impact road conditions (such as Bike to School Day). o Town of Tiburon Website ■ The Town of Tiburon publishes information on the Town Website. A recent example is the posting of National Bike to School Day (May 10, 2017) on the front page of its website, Caltrans District 4 Bicycle Plan Survey, as well as the publication on How to use the Green Bike Boxes at Blackfield Drive. A recent example is The Arks's coverage of the Green Bike Boxes at the Town of Tiburon. o Town of Tiburon Bicycle and Pedestrian Master Plan ■ The Town regularly reviews, makes recommendations for funding, and implements projects of the Tiburon Bicycle and Pedestrian Master Plan. o Transportation Authority of Marin ■ Coordination With Transportation Authority of Marin (TAM)- Town Staff and a representative of the Town Council work directly with the Transportation Authority of Marin to seek funding for transportation projects. TAM is a funding agency, which allocates all transportation dollars that come to local jurisdictions in Marin. TAM meets with local staff(usually public works) for updates on funding opportunities, bundling individual grant requests (to increase chances of funding from regional or state agencies), and other related activity that tracks and gets transportation money to us. Path and bike money from TAM comes through the Measure A (local transportation sales tax) Safe Pathways Program - or regional grants subject to Federal and state priorities and their funding programs like ATP (Active Transportation Program). o Community Organization Participation ■ Staff Participates Regularly in Safe Routes to Schools Taskforce Meetings, engages with and holds discussion with proponents, stakeholders, Task Force Members, and other Community Organizations to improve bicycle, pedestrian, and automobile safety. Town of Tiburon Police Department o Distracted Driver Campaign-Crackdown on Texting and Driving and Regular Patrol/Presence During School Drop-Off and Pick-Up o Publication from the Chief to the School through A Message From the Superintendent on February 16, 2017 on texting and driving o Chief Cronin and Chief Seylor conducted safety presentation to Bel Aire Students in February, which focused on bus, walking, bicycle and motorist safety, a Bike Rodeo and Safety Days at Reed and at Bel Aire Schools. o The Tiburon Police Department utilizes the Tiburon Talk Newsletter to publicize safety campaigns, such as the distracted driver, texting and driving, stopping behind school buses, and other outreach campaigns. o The Tiburon Police Department spends time in the morning and afternoon around the schools educating drivers, bicyclists and pedestrians by stopping them and in some cases writing tickets. o The Tiburon Police Department spends time on Saturdays and Sundays at Blackie's Pasture and on Main Street and Tiburon Boulevard to ensure compliance with all signs and regulations. o Traffic Safety Committee-Chief of Police and Tiburon Public Works Director investigate complaints or accidents on an as-needed basis. o Speed Awareness Signs-The Tiburon Police Department has used speed awareness signs, which can tell passing bicyclists and motorists how fast they are travelling. The signs are moveable, and the Police Department has found them great tools to get folks to slow down. o Radar Enforcement on Old Rail Trail During Summer and Weekends-The Police Department utilizes radar enforcement on Old Rail Trail as a means of educating folks regarding their speed and ensuring compliance with traffic safety. o Traffic Stops-The Tiburon Police Department utilizes traffic stops as a method of enforcement and education. The Department estimates that they write a very low percentage of citations, citing only 1 out of every 7 people who are stopped for moving violations, focusing on educating drivers rather than punishing them as a method of outreach regarding traffic safety and a means to change behavior. Reed Unified School District o E-mail Blasts concerning Bicycle, Pedestrian and Motorist Education via the District and Individual Schools o Safe Routes to Schools(SR2S)-Reed Union School District& Safe Routes to Schools are in the process of developing suggested route maps for students to safely bike and walk to school. o Safe Routes to Schools Education Classes are taught in 2na, 4t", and 6t" grade education as part of the physical education curriculum. o The Parent Teacher Association of the Reed Unified School District has made a Safe Routes to Schools Position within the PTA to act as a liaison between the PTA and the Safe Routes to Schools organization. o Dive Deep and/or Mini-Dives-Dive Deep and Mini-Dives are a curriculum through RUSD in which children focus on specific topics for a short period of time. There has been discussion of a Dive Deep or Mini-Dive focusing on bicycle and pedestrian education. o After School Classes o Assemblies o Yellow Bus Challenge-Works to reduce congestion during peak periods by encouraging school children to use the buses, rather than have parents drive them. o Recognition of National Bike to School Day in May and International Walk to School Day in October o Redwood High School Impact Driving Program D. The Belvedere Tiburon Joint Recreation (The Ranch) a. After school classes regarding bike safety, including mountain biking and riding class for Bel Aire Students and a second grade blacktop class b. Other Organizations a. Safe Routes to School (SR2S)-The Safe Routes to School Program combines classroom education, special community events and coordination between school officials, parents, and Public Works officials to create safe environments for walking, biking, and taking transit to school. The Transportation Authority of Marin administers the Safe Routes to School Programs to promote: 1. Walking, bicycling, taking transit or carpooling to school; 2. Planning safer walking and bicycling routes to schools; 3. Funding the construction of Safe Pathways to Schools; and 4. Providing crossing guards at major intersections; and 5. Offering safety classes and providing safety curriculum for schools. Safe Routes to School provides great work in focusing on safe routes for students to bike or walk to school and ongoing safety tips. They have: i. Created Safe Routes for Children to Get to School Within the Reed Unified School District ii. Participated in Tiburon Family Bike Ride Program-October 9, 2016 iii. Assisted Tiburon in determining submissions for Safe Pathways to Schools funding, which is for engineering, environmental clearance, and construction of pathway and sidewalk improvements, including safety improvements at street crossings. iv. Offered an entire Safety Curriculum for students and currently teaches Education Classes in 2nd, 4th, and 6t" grade at the Reed Unified School District as part of the physical education curriculum b. WheelEscape-Great local Tiburon nonprofit that promotes a love for cycling and a respect for rules of the road. Events are created by volunteers, usually are grant funded, and are provided to the public for free. Notices are sent out using NextDoor, Facebook, Twitter, and to a direct email list. The organization holds clinics that include different aspects of bicycle education, including mechanical, street skills, bike handling, routes for kids doing bike trains, group riding clinics, after school bike clubs, and more. c. Marin County Bike Coalition-Marin County Bike Coalition hosted a Family Biking Clinic on October 16, 2016 that was advertised in The Ark, posted on Next Door, and put in the WheelEscape E-mail blast. The Page 8 of 24 Tiburon Ad-Hoc Subcommittee on Bicycle, Pedestrian, and Automobile Education Report to Town Council Draft 5/9/17 Topics covered included obeying stop signs and traffic lights, riding your bike in the same direction as the cars on the road, hand signals, balance, braking, steering, stopping and starting, and walking your bike in a crosswalk. The Ad-Hoc Subcommittee recommends that all of these above efforts be continued. Below are recommendations for what Tiburon can do in the future to enhance Bicycle, Pedestrian and Automobile Safety and Education. • RECOMMENDATIONS FOR BICYCLE, PEDESTRIAN AND AUTOMOBILE SAFETY EDUCATION EFFORTS IN TIBURON Throughout our meetings, we received many recommendations for outreach efforts that the Town of Tiburon should consider. We determined that we wanted to pass all of these recommendations on to the full POST Commission, and eventually to the Town Council for its review and evaluation in consideration of the Town's other budget and staffing priorities. The Appendix to this Report contains all of the ideas, plans, proposals, and suggestions the Subcommittee received. This report is a first step to improve Tiburon's Bicycle, Pedestrian, and Automobile safety education efforts. We have no doubt that many more suggestions will be advanced or implemented after the Subcommittee has finished its work. Although there were many wonderful ideas presented to the Ad Hoc Subcommittee, we chose to focus immediately on those ideas that we think are most suited to Tiburon and are the most cost-effective and will provide the greatest outreach per dollar spent. Due to limited resources for this funding year, we had to make some tough choices. We want to make it clear that we did not receive any bad recommendations, and that many of the items could be implemented in future years. However, we have listed our top three (3) items that can be implemented immediately to improve bicycle, pedestrian and automobile safety education here in Tiburon. Below you will find our immediate recommendations in each category followed by other recommendations that need additional study, funding, or more time for consideration. The top priorities we wish to recommend for this fiscal year are the following: 1. Town of Tiburon Website, Tiburon Town Talk, and Social Media a. Town of Tiburon Website-We recommend that the Town of Tiburon create a Safety Corner on its website where bicycle, pedestrian and automobile safety and education materials are posted. We recommend that the Town of Tiburon Website provide a monthly look at different bicycle, pedestrian and automobile safety and education and highlight one item. There are many sources of free information that can simply be used Page 9 of 24 Tiburon Ad-Hoc Subcommittee on Bicycle, Pedestrian, and Automobile Education Report to Town Council Draft 5/9/17 by the Town of Tiburon to post on its own site (please see the links below in the text of this Report). We recommend that the one safety item that the Town highlights per month become part of an integrated outreach campaign utilizing earned or free media, social media, Tiburon Talk e-mail blasts, all Departments, and work with the Reed Unified School District to get e-mail blasts to parents and curriculum/training to students, to highlight the same safety issue. b. We recommend that the Town create a Town of Tiburon Safety Day in coordination with the City of Belvedere, the Belvedere-Tiburon Joint Recreation Committee (The Ranch), the Police Department, the Reed Union School District, Safe Routes to School, and other local organizations/individuals, through which to highly publicize Pedestrian, Automobile and Bicycle Safety Education. We recommend that this Safety Day occur in the beginning of the year in order to assist students and get drivers, riders, and pedestrians focused on safety. Tiburon could have its Safety Day in September during Pedestrian Safety Month in California, which would also serve to greater highlight pedestrian safety in Tiburon, and achieve greater awareness during the beginning of the school year. c. On the Town of Tiburon's current website, there is a Bicycle and Pedestrian Safety Tab under the Resident's Section. The Town of Tiburon heavily publicized the Bike Boxes at Blackfield Drive under this Section, in the Tiburon Talk Newsletter, and worked with The Ark Newspaper to develop comprehensive coverage of the Bike Boxes. We would like to see the website expanded to cover bicycle, pedestrian, and automobile safety and education, and have tabs linking to the proposed Safety Corner in both the Residents Section, in the Visitors Section, and highlighted prominently on the front page. Currently, the Town of Tiburon's website has four buttons on the front page highlighting Agenda and Minutes, Destination Tiburon,Notify Me, and Tiburon Newsletter. We would like to see a fifth button (or perhaps place the Notify Me button lower on the site if you want to keep just four buttons) called Safety Corner or similar name to prominently highlight the Town's commitment to Bicycle, Pedestrian and Automobile Safety and Education. The City of Mill Valley website is a good resource to review prior to setting up the Bicycle, Pedestrian, and Automobile Safety and Education Section on Tiburon's Website. Mill Valley has a prominent button on the front page of the website that says Traffic, Transit, Walk, and Bike. In this Section, there are references to Safe Routes to School; Street Closures; Steps, Lanes, and Paths Maps; the School Bus Program; Traffic Calming; Walk and Bike; and other related resources. We recommend that the Town link to the information and posted to the Town of Tiburon website and also in the Tiburon Talk v. Post road rules, path rules and open space rules and safety information on the website vi. Have a tab on the website where bicyclists, pedestrians, and motorists can report overgrown vegetation that might be obscuring paths, lanes, signs and roads or publicize existing tabs vii. Ensure approved maps from SR2S are posted to the Town's website and encourage partners to post as well viii. Ensure The Ark publishes the Town of Tiburon website in its articles in order to drive traffic to the Town's site ix. Work with The Ark, the Marin Independent Journal, and other traditional media outlets to publicize general pedestrian, bicycle and automobile safety information related to Tiburon, as well as, maps x. Town Wide Celebration on National Bike (walk, bus or carpool) to school day. This is an incredible opportunity not only for the schools but also for the<Town of Tiburon to highlight its pedestrian, automobile, bicycle safety and education outreach plan and resources available. xi. Encourage Destination Tiburon to post similar safety information, maps, lanes, paths, and rules of the road. xii. Partner with the Reed Unified School District to ensure information shared on the Town of Tiburon Website is also shared on the Reed Union School District Website, the Page 12 of 24 Tiburon Ad-Hoc Subcommittee on Bicycle, Pedestrian, and Automobile Education Report to Town Council Draft 5/9/17 Foundation Website, and also communicated to the parents through the District and school email blasts. e. Tiburon Town Talk-Tiburon Town Talk has featured the Green Bike Boxes and other issues related to safety in the past. i. Tiburon Town Talk should have a Safety Corner (similar to the recommendations for the website) in which different safety tips and automobile, pedestrian, and bicycle safety items are highlighted each time an online version is disseminated. There should be a link to these resources on the Town of Tiburon's webpage and an integrated outreach campaign. The monthly website highlights regarding automobile, pedestrian and bicycle safety should also be highlighted in the Tiburon Town Talk Newsletter. f. Social Media-Social media is a very inexpensive method to provide greater outreach to the Town, visitors, workers and travelers. We recommend that Tiburon set up, at minimum, Facebook and Instagram accounts. i. Add to an existing staff position social media responsibilities or, fund if, need be, a part-time Town of Tiburon Social Media Coordinator. a. Utilize social media to disseminate information regularly on Pedestrian, Automobile, and Bicycle Safety b. Create links to maps or use app/website like mapmyride, which gives maps for bicycle riders specific to Tiburon http://www.mapmyride.com/us/tiburon-ca/ 2. Greater Funding for Local Tiburon Outreach and Education Programs- We were very impressed with the community members and organizations already providing education and outreach regarding bicycle, pedestrian, safety and education. More grants should be written to fund local programs like Wheel Escapes, which is a Tiburon-based non-profit that promotes a love for cycling and respect for the rules of the road. a. Greater Funding for Local Tiburon Programs-Tiburon and Marin County have some great organizations conducting local programs that we believe should be expanded to promote more classes, clinics and workshops. A list of possible organizations that could provide these classes, clinics, and educational programs are, including, but not limited to, Marin County Bike Coalition, WheelEscapes, Safe Routes Page 13 of 24 Tiburon Ad-Hoc Subcommittee on Bicycle, Pedestrian, and Automobile Education Report to Town Council Draft 5/9/17 to Schools, Street Smart Marin, The Belvedere Tiburon Joint Recreation (The Ranch) i. Biking-Biking programs specifically related to safety, sharing the path, safe speeds, how to avoid an accident with an automobile, would greatly benefit the community. ii. Bicycle, Pedestrian and Automobile Education-Organizations, including but not limited to, Safe Routes to Schools and Street Smart Marin offer some very good training and classes for bicyclists, pedestrians, and automobiles to share the road or path. These Marin-based programs have been great at providing local information. iii. Pedestrian Programs-We find a lack of resources currently in promoting general pedestrian awareness and safety in Tiburon. We find that the Safe Routes to Schools promotes pedestrian safety as it relates to the schools and Tiburon could benefit from more pedestrian outreach to the general public. We recommend that Tiburon post pedestrian safety tips on its website as detailed above and that we look for more pedestrian safety programs that could be created and highlighted within the next year. We recommend that these programs be delivered to the general Tiburon population and also that tips be posted on the website for travelers, visitors, and workers within Tiburon and disseminated through social media. iv. Seniors-We find a lack of local driving programs directed towards seniors. AARP does host programs for seniors in Corte Madera. We recommend that Tiburon request that the AARP host programs locally at the Tiburon Library or other Tiburon venue. Please see the attached program flier in the Appendix to this Report. Other Recommendations: b. Grant Writer-We recommend that Tiburon look into the cost and feasibility of an as-needed grant writer who could increase the number of grants written, identify additional potential funding sources, and expand the resources for Tiburon's bicycle, pedestrian and automobile safety and education. We recommend that the Town of Tiburon investigate funding sources that would allow the Town to fund a study of all similar jurisdictions to Tiburon and incorporate the best practices into a future outreach and education plan. This Report is a great start at enhancing the Town of Tiburon's Bicycle, Pedestrian and Automobile Safety and Education, but in the future it would be great Page 14 of 24 Tiburon Ad-Hoc Subcommittee on Bicycle, Pedestrian, and Automobile Education Report to Town Council Draft 5/9/17 to look at similar jurisdictions to develop a list of best practices that could be implemented in Tiburon. 3. Infrastructure Improvements to Enhance Bicycle, Pedestrian, and Automobile Safety and Education a. Ensure that there is adequate signage to promote safety for bicyclists, pedestrians, and automobile drivers. Some proposed examples are below: i. Welcome signs/maps at Blackie's Pasture and Downtown Tiburon for pedestrians and bicyclists with route and safety information and Town of Tiburon website highlighted for further information. Work with the Tiburon Chamber of Commerce, Tiburon Peninsula Foundation, Blazing Saddles, and explore grant funding for the cost of signs and maps. ii. Implementation of and fundraising for infrastructure improvements already approved (i.e. signage at Greenwood Beach Road) iii. Continuing studies to determine signage priority b. Continue to work with Safe Routes to School, POST, and the Town Council to prioritize safety-related projects for the Town of Tiburon through the Bicycle Pedestrian Master Plan and local existing processes c. Utilize Changeable Message Signs for Traffic Safety and Awareness Messages-Tiburon currently uses the changeable message signs to highlight events and construction. We have determined that the changeable message signs are a great method of reaching automobile drivers in Tiburon, pedestrians, and bicyclists. For some members of the public who are not residents, do not receive the Tiburon Town Talk, and do not look at Tiburon's website, this might be their only information. Utilizing the changeable message signs to promote safety-related topics and drive folks to Tiburon's website would greatly enhance safety. It would be great to see a list of topics per year that are coordinated with messaging on the Town of Tiburon's website in order to reinforce safety messages to Tiburon residents and also to get folks to check the website. d. Consider purchasing more Speed Awareness Signs to ensure automobile drivers and bicyclists know how fast they are travelling. The Speed Awareness Signs are currently in use, are solar-powered and can be moved. The Police Department has found them very Page 15 of 24 Tiburon Ad-Hoc Subcommittee on Bicycle, Pedestrian, and Automobile Education Report to Town Council Draft 5/9/17 effective in getting people to slow down, especially if they are placed 2-300 feet before a speed limit sign. e. Town of Tiburon should work with the Ferry companies, Marin Transit buses, and bicycle rental agencies (including the new electric bike store Pedago in Tiburon) to disseminate bicycle and pedestrian safety information on the ferries, at the rental shops, and on the transit buses and also seek to utilize their respective email and social media lists to disseminate Tiburon-specific safety-related information. Other Recommendations: £ We recommend that the Town of Tiburon and the Town of Belvedere work with the community, and possibly a consultant to create Town- Wide maps that include trails, paths, lanes, and walkways, and develop corresponding signage. g. Vision Zero and Complete Streets-Look at Vision Zero and Complete Streets when considering infrastructure improvements as a means to comply. Please see the attachment on the Appendix of this Report for an example of work being performed to eliminate all traffic deaths in the City and County of San Francisco. Bike Storage and Bike Swap/Recycling Program-We recommend that the Town of Tiburon look into the need, feasibility and cost for a Bike Storage and Bike Swap/Recycling Program. i. Self-Service Bike Repair (possibly a bike station vending machine) and Pedestrian Information Station at an appropriate location-We recommend that the Town of Tiburon look at the need, feasibility and cost for a Bike/Pedestrian Station where people can pick up information, learn bike skills, use bike pumps/tools, and have maps/brochures for bicyclists and pedestrians. j. League of American Bicyclists-We recommend that the Town of Tiburon look into the benefits to the Town of applying for membership at The League of American Bicyclists to become a Bicycle and pedestrian friendly community (http://www.bikelea ug_e.org/bfa k. On August 17, 2016, The Tiburon Town Council, through Vice-Mayor Jim Fraser, and directed the Parks, Open Space and Trails Commission (POST)to strengthen the 2016 Bicycle Pedestrian Master Plan section on Education Programs. At the September 20, 2016 POST meeting, Commissioners Ms. Holli Thier and Mr. Park Allen were appointed to lead this Subcommittee and to make recommendations to POST and to the Town Council. The Subcommittee followed a process of gathering public input and generated a compilation of recommendation to promote the education program. The following is an implementation plan, prepared by Staff, which uses the recommendations of the report and specifies tasks to be performed to creating and maintain the education program. The Bicycle, Pedestrian and Automobile Education Program Implementation Plan is as follows: 1. Energy Efficiency Measures — Consider options to reduce greenhouse gas emissions including Electric Vehicle Charging Stations, LED streetlights, adding solar panels to Police Station and conversion of municipal accounts to Marin Clean Energy's Deep Green program(Department of Public Works) Town Manager Chanis said the Town of Tiburon's Climate Action Plan included several ideas and strategies for the Town to utilize to reduce energy consumption,and said staff had prepared a report on several proposed projects for the Town Council to consider. Director of Public Works/Town Engineer Barnes reviewed four proposed projects to reduce greenhouse gas emissions: Electric Vehicle Charging Stations at Lyford Drive Parking Lot Barnes said adding a charging station at this location would cost the Town approximately$31,000. He said this project was of concern to staff because the annual subsidy depends greatly on how much the station gets used and how much the Town charges for use,and because 5 parking spaces will be lost for only two restricted EV charging spots. He said staff is recommending against this project. Solar Panels on Police Station Barnes said the shingles on the Police Station roof were problematic for adding solar panels to the roof, and for that reason, staff is recommending the Town Council instead consider a carport solar array in the front of the Police Station. He showed a diagram of what this project might look like, and said this will cover 91% of the annual cost of electricity at the Police Station. LED Streetlights Barnes reviewed the cost savings associated with retrofitting streetlight fixtures to LED bulbs. He proposed a "trial" of at least 4 LED lights on Mar West and/or Blackfield Drive, testing different colors, brightness, shields, and giving residents an opportunity for feedback. Town Council Minutes#20-2017 DRAFT October 4, 2017 Page 3 Marin Clean Energy Deep Green Barnes said the Town is currently"Light Green", or using 50%renewable energy, but opting up to "Deep Green" would take the Town to 100% renewable energy. He said this would have a great environmental impact, and would cost the Town an additional $3,200 per year. He added that this cost may be further reduced if the Council authorizes the LED streetlight and solar panel projects. Director Barnes reviewed the staff's recommendations: approve $30,000 to convert streetlights to LED bulbs, approve $260,000 for carport solar array at Tiburon Police Station and authorize switching the municipal accounts to Deep Green. He again recommended against the EV Charging Station project. Councilmember Fredericks asked if the new LED bulbs will be down lights. Barnes said the new bulbs would be mostly downlight, and more so than the current streetlight bulbs. Vice Mayor O'Donnell asked about handicap access to the EV charging station in this particular lot. Barnes said one of the charging spaces would need to be accessible, but handicap van accessibility may be able to be accommodated in another way if the station is curbside, rather than in a parking lot. Councilmember Thier asked if other locations in Town were considered for a charging station. Barnes said other locations had been considered, but this location was the most inexpensive. O'Donnell asked if the Town could partner with the owners of the private parking lots in Town for a station. Town Manager Chanis said the staff can expand their search and try to find an arrangement. Thier commented that perhaps there is an opportunity with the large library expansion,and suggested that a charging station be installed closer to downtown so citizens using the station will have a way to pass the time. Mayor Fraser asked for clarification about the parking space configuration in the Lyford parking lot. Director Barnes explained there are handicapped spaces available in the lot now,and due to changing ADA standards, installing this station there would require a handicap accessible charging space. Overall,installing this station at that location would remove five existing spaces,and leave only two reserved spaces for charging. Fraser believed it is incumbent upon the Town to have an EV charging station available in Town soon.He said he would like to see this project accelerated to discuss an EV charging station plan for the community. Mayor Fraser opened the floor for public comment. Lucy Pazcowski spoke about the importance of reducing greenhouse gas emissions and the implications of climate change for young generations. Killigrew, of Marin Clean Energy, offered to answer any questions from the Council about Marin Clean Energy's deep green program. Betsy Rosenberg said there had been admirable climate leadership shown in Marin County. An unnamed citizen spoke in support of the projects,and praised the fact that the community and our local children will be able to see that the Town is supportive of energy reduction initiatives. Another unnamed citizen spoke in support of the projects. Nancy Gamble urged the Town Council to authorize the switch to deep green, and to demonstrate leadership and encouragement for local residents and businesses to do the same. Chance Cutrano,of the Sierra Club of Marin,said the Sierra Club was pleased to see Tiburon move forward with these projects, and urged the Town Council to follow the staff's recommendations. Sana Thomas urged the Council to adopt the staff s recommendations. Sara Lochran said she was hopeful Tiburon would join the other municipalities in Marin that have converted to deep green. In capturing the District 3 titles for both the IOU and 12U leagues, the players from tiny Tiburon vanquished foes from much larger teams and cities in Marin and San Francisco Counties. In addition, the 12U ,d All-Stars prevailed as champions of Section 1, and finished the season as 3 best Little League in all of Northern California, an amazing feat. XX-2017 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON COMMENDING STEVE SEARS UPON HIS SELECTION AS THE TIBURON PENINSULA CHAMBER OF COMMERCE 2017 BUSINESS CITIZEN OF THE YEAR WHEREAS, Steve Sears, a San Luis Obispo native, discovered his calling at a young age when his uncle gave him a job at his local hamburger joint; and WHEREAS, Steve graduated from college with a degree in economics from the University of California Santa Barbara, and began graduate school at the University of California Berkeley, but soon left to pursue his dream of becoming a restauranteur; and WHEREAS, Steve went on to open and manage restaurants in Ohio, Arizona, Oregon, Sausalito, and Maui, where he met his future wife Dorinda, and the two were married in 1992; and WHEREAS, in 1978, Steve and Brian Wilson purchased Sam's Anchor Cafe, and deemed their first order of business to clean the kitchen and ready the establishment for business themselves before finally opening their doors five weeks later; and WHEREAS, for almost 40 years, Sam's has been a destination spot for Tiburon locals, Bay Area day-trippers, international tourists, and the likes of Robert Redford and Arnold Palmer; and WHEREAS, Sam's has even been a destination for United States political dignitaries, whom no doubt felt lucky to enjoy Sam's glorious outdoor deck and San Francisco Bay views, even if Steve refused their requests to rent out the entirety of the deck for their entourages; and WHEREAS, Steve Sears has become a staple in the Tiburon community, with a passion for his business only matched by his desire to give back to the community; and WHEREAS, Steve has dedicated countless hours of volunteerism to Tiburon, having served as co-founder of the Tiburon Wine Festival and the Holiday Festival and as the unofficial coordinator of Friday Nights on Main for over a decade; and WHEREAS, Steve has served as a guardian of Tiburon heritage and safety, having served on the boards of the Tiburon Peninsula Foundation and the Tiburon Fire Protection District; and WHERAS, Steve's dedication to the local Chamber of Commerce is unrivaled, but he intends to make his third term as President his last to spend more time with his grandchildren and to work on his golf game. Councilmember Kulik said the proposed projects were undeniably beneficial. He praised the initiative to involve the community in the LED streetlight conversion proj ect and the Town taking a leadership role in going deep green. Kulik also agreed that the EV charging station project in its current form would not be in the community's best interest, and said good recommendations had been brought forward for finding other locations for a charging station. Councilmember Thier said the Town and the Council should be proud of the vision to consider several energy reduction initiatives,and said she was in support of the proposed projects. She agreed that finding a good location for an EV charging station in Tiburon was important, and requested Town staff report back by February 2018 on the progress of this project. Mayor Fraser agreed with the rest of the Council,and thanked the Vice Mayor for his vision to look at this issue with a larger perspective.He again requested the staff accelerate the EV charging station project, and find a good place in Town for a station.
