BACKGROUND
At its meeting of October 18, 2017, the Town Council held a public hearing on this item and
directed Staff to prepare a resolution denying the appeal when the proposed encroachment permit
would violate section D.1 of the Town Council Resolution No. 45-2014. The draft resolution has
been prepared and is attached as Exhibit 1.
RECOMMENDATION
Staff recommends that the Town Council adopt the attached resolution denying the appeal.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TIBURON DENYING AN APPEAL OF THE DENIAL OF AN
ENCROACHMENT PERMIT FOR A PROJECT LOCATED AT
31 APOLLO ROAD
WHEREAS, on September 18, 2017, Richard Greenberg ("Owner") owner of 31 Apollo
Road in Tiburon, California, applied to the Town for Encroachment Permit No. EP 17-128 for
after-the fact legalization of the replacement of a fence portion located within the public right-of-
way of Mercury Avenue ("Project"); and
WHEREAS,the Project application included drawings which Town staff accepted for
purposes of determining if the Project complied with the Town's adopted policy governing
encroachment permits, set forth in Town Council Resolution No. 45-2014 ("Encroachment
Policy"); and
WHEREAS, on September 18, 2017, the Town's Public Works Director/Town Engineer
denied the Project application as inconsistent with Section D.l of the Encroachment Policy on
the basis that legalization of the as-built fence would privatize the affected area for the exclusive
use or benefit of one or a limited number of individual owners in lieu of the general public; and
WHEREAS, on September 18, 2017, Owner filed a timely appeal of the decision; and
WHEREAS, on October 18, 2017, the Town Council held a public hearing to consider
the appeal; and
WHEREAS, after hearing all testimony and reviewing the appeal, the Town Council
upheld the determination of the Public Works Director/Town Engineer that the Project would not
be consistent with the Encroachment Policy; and
WHEREAS,the Town Council voted 3-2 (Fraser and Kulik dissenting)to direct staff to
return with a draft resolution for consideration at the next meeting that would formalize the
denial of the appeal.
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon
does hereby deny the appeal of the application for encroachment permit at 31 Apollo Road.

BACKGROUND
The Belvedere-Tiburon Library Agency Board is made up of 3 appointees from Tiburon, 3
appointees from Belvedere, and one appointee from the Reed Union School District.
The RUSD appointee, Ann Alwyn, has retired, leaving a vacancy on the Library Agency Board.
On October 17, 2017, the RUSD Board of Trustees unanimously appointed Ms. Niran Amir to
serve as the RUSD appointee on the Belvedere-Tiburon Library Agency (Exhibit 1).
The Library's Joint Powers Agreement states that the RUSD appointment must also be approved
by the Tiburon and Belvedere Councils. Ms. Amir is able to attend meetings, but not vote, until
her appointment is confirmed. The Belvedere City Council will consider this item on November
13.
RECOMMENDATION
Staff recommends that the Town Council confirm Reed Union School District's appointment of
Ms. Niran Amir to the Belvedere Tiburon Library Agency Board by adoption of this item on the
consent calendar.

Re: RUSD appointment to the Library Agency
The Reed Union School District voted,as per the attached letter,for Tiburon resident Niran Amir as the
RUSD representative on the Belvedere Tiburon Library Agency Board. Per the Library Joint Powers
Agreement,the Tiburon Town Council is required to accept this decision by voting to confirm Niran's
appointment in that role.
Niran and her husband Daniel have three children,two of whom are in enrolled in the RUSD and one
who is now a freshman in high school. Niran is looking forward to being active in the community and
excited about representing the Library for the RUSD.
The Belvedere Tiburon Library Agency asks that the Tiburon Town Council approve this position.

BACKGROUND
The Marin General Services Authority (MGSA) is a Joint Powers Authority (JPA) made up of all
the cities, towns, and the County of Marin. MGSA administers a variety of government programs
that are either collaborative in nature or are more cost effective to administer collectively. The
JPA was originally formed in 1985 as the Marin Street Light Acquisition Authority to acquire
streetlights from PG&E to save jurisdictions' maintenance costs. The streetlights were acquired
through eminent domain in Marin County Superior Court and resulted in over$500,000 in annual
savings in 1986. The JPA also maintains liability insurance for the streetlights.
Since 1986, the original JPA and now MGSA has contracted for streetlight maintenance
services for the approximately 15,000 streetlights in Marin County (with the exception of the
town of Ross).
ANALYSIS
As noted above, the municipalities in Marin originally formed the JPA to save money on
streetlight maintenance. The JPA owns the streetlights and maintains them, resulting in cost
savings to the Town. The Town has benefited from this JPA. This action does not change the
JPA, it merely ensures that MGSA continues to own newer streetlights as it does the all the
streetlights that were transferred to it in 1986.
It is important that the ownership of any government property can clearly be determined.
Subsequent to the 1985 eminent domain action, some jurisdictions have added streetlights
through developer street right-of-way dedication or renovated streetscapes with additional
streetlights. Although paperwork was developed to transfer streetlights on an ongoing basis to the
JPA, it was not consistently implemented over the decades.
MGSA is requesting that all member jurisdictions' governing bodies pass a resolution to create
legal clarity and implement this administrative clean up. Passage of the Resolution will result in a
"blanket" transfer of any streetlights not originally part of the 1986 condemnation lawsuit. The
resolution also delegates authority to the Public Works Director to annually transfer any
streetlights dedicated to the jurisdiction to MGSA.

FINANCIAL IMPACT
Passing this resolution will ensure that the JPA continues to function well, resulting in continued
savings in streetlight maintenance to the Town.
RECOMMENDATION
Staff recommends that the Town Council:
1. Move to approve a Resolution transferring certain streetlights from the Town of
Tiburon to the Marin General Services Authority and delegating authority to the
Public Works Director to transfer certain streetlights to MGSA on an ongoing basis.

A RESOLUTION TRANSFERING CERTAIN STREETLIGHTS FROM THE TOWN OF
TIBRUON TO THE MARIN GENERAL SERVICES AUTHORITY(MGSA) AND
DELEGATING AUTHORITY TO THE PUBLIC WORKS DIRECTOR TO TRANSFER
CERTAIN STREETLIGHTS TO MGSA ON AN ONGOING BASIS
WHEREAS,certain local agencies within the County of Marin formed the Marin Street Light
Acquisition Authority("MSLAJPA") in 1985 to acquire certain streetlights from PG&E;
WHEREAS,the MSLAJPA did acquire those streetlights by eminent domain in 1986 and it was
decided that the MSLAJPA would retain title to the lights and provide a system of countywide
maintenance and insurance for the streetlights;
WHEREAS,the MSLAJPA on behalf of its members has always had as a policy that any new or
replaced streetlights would be owned by the MSLAJPA;
WHEREAS,the MSLAJPA subsequently became the Marin General Services Authority
("MGSA") and the streetlights were transferred to that joint powers authority which the Town of
Tiburon is a Member and MGSA continues to contract for the maintenance of the streetlights and
maintain insurance for the streetlights;
WHEREAS,it is beneficial to have one agency manage the maintenance contract and maintain
insurance for the streetlights in Marin County as has been proven in the past and such transfer of
property is permitted by law under Government Code § 6508;
WHEREAS, it is important the ownership of streetlights within Marin County be certain and not
subject to any concepts of implied ownership or control;
NOW,THEREFORE,be it resolved that the Town of Tiburon offers to transfer all streetlight
and associated facilities defined as a luminaire,mast arm, streetlight only pole and associated
wiring within the jurisdictional limits that previously have not been offered and accepted by the
Marin General Services Authority or its predecessor the Marin Street Light Acquisition Joint
Powers Authority. This offer will become effective upon acceptance by the MGSA.
IT IS FURTHER RESOLVED that the Public Works Director is delegated the authority to
transfer streetlight ownership on an ongoing basis to the MGSA.

BACKGROUND
The Heritage & Arts Commission has had one vacancy since September, when the Town Council
appointed Commissioner Daniel Amir to the Planning Commission. Mr. Amir's resignation from
the H&A became effective on September 27, after his final meeting. The person appointed to this
seat will serve for the remainder of Mr. Amir's term, until February 2020.
The vacancy has been formally announced at a Town Council meeting, advertised for in the Ark,
on the Town of Tiburon website and in posted notices at the Library and Town Hall. Staff
accepted applications until October 19.
One application was received for this vacancy from Leonor Noguez. Ms. Noguez was
interviewed by the Town Council tonight, on November 1, 2017.
RECOMMENDATION
Staff recommends that the Town Council:
1. Consider making appointment to Heritage & Arts Commission; or
2. Continue the item and direct staff to continue to accept applications and schedule
interviews for the vacancies at an upcoming Council meeting.
