B. RECOGNITION OF SERVICES FOR CYPRESS GARDEN
. JUDY M. HOBBS . CLAIRE H. RUSSELL. JOY A KUHN - Resolutions
Mayor Friedman commended Judy Hobbs, Claire' Russell and Joy Kuhn for, their
creation and implementation of the Cypress Garden in honor of Genie Thompson'
Watkins, and read the text of the Resolutions.
Motion:
To adopt three Resolutions Expressing Appreciation to Judy Hobbs, Claire
Russell and Joy Kuhn for their outstanding and devoted service in creating
the Cypress Garden,
Thompson, Seconded by Thayer

2. PINE TERRACE (Consider Offer of Open Space & Improvements Along Multi-
Use Path) ,

Councilmember Kuhn reviewed the Staff report; noted the public trespassing on private
property to get to the Multi-Use Path; proposal is to arrange a long term'lease with the
property owners and 'build a new, shorter path and fen~e the a~ea"
The Town Manager noted the cost estimates of the Town Epgineer and Superintendent
of Public Works; stated Staff supported this effort; cleans up the' area; creates easier
access to the M~lti-Use Path and adds a safety element not now present.
Vice-Mayor Nygren expressed several concerns including that the area might become a
gathering space for Del Mar students; wanted RUSD approval; questioned whether
Open Space Acquisition Funds could be,used to improve rented property; noted $7,600
estimated total expenses plus use of Public Works Department; questioned length of'
proposed lease after investing Town funds into this area; questioned adequacy of Public
Works staff to maintain this project, and felt the fence was the responsibility of the
homeowner association and not the Town,

Sol Martin, 10 Pine Terrace, stated each homeowner owns 1/12 of the existing open
space common area; people climb the fence particularly on weekends; asked Council to
visit the site,
Bill Tiedje, 30 Pine Terrace, stated it is essential the fence be 6'; the path should be 30'
away from the fence to prevent people from gathering around the fence and interfering
with their privacy; didn't want an indefinite term on the lease in the event there were
changes on Tiburon Blvd, which would increase the value of the property.
Michael Bettinger, 50 Pine Terrace, President Homeowners Association, stated their
fence was torn down by children; Town had indicated an interest in working with them
in creating more accessibility to the Multi-Use Path; homeowners are not interested in
deeded the property to the Town, but will consider a lease,

Gail Smith, 20 Pine Terrace, questioned liability issues involved. Sol Martin noted the
terrible condition of the walkway along Tiburon Blvd. Council noted that is within
CAL/TRANS right-of-way.

Discussion continued regarding handicapped access; existing circuitous route to the Path
which encourages trespassing; additional liability of the Town; length of the lease; the
need to research availability of Open Space Funds; review proposal with school district;
asked Town Attorney to research what kind of document the Town might enter into with ,
the Homeowners' Association; the majority of the Council ~ the fenee" was the
Homeowners responsibility.
Mr. Bettinger stated he would review the discussion with the other homeowners and get ,
back to Stillf. .

The Town Manager stated the Chamber of Commerce was requesting Main'Street be

closed from 4 P.M. to 11:30 P,M, on December 1, 8, 15 and 22 for a Vintage Christ!mis:
. by the Bay celebration,

Bob King, President of the Chamber of Commerce,. elaborated on the planned f~stivities
which will span the Tiburon Plaza, Ark Rowand The Boardwalk shopping areas..

Virginia Brunini stated the hours requested include set-up and clean-up times; stores will
stay open from 6 to 10 P,M,; Mr, Zelinksy has offered free parking and there will ,be
, carriage rides with historical descriptions of the Town,
The Council urged that music be kept minimal after 9 P,M, and Corinthian Island
residents be invited to the festivities,
The Council approved the closure of Main Street for the dates and times previously
outlined,
3. BLACKIE'S PASTURE IMPROVEMENTS (Program Review & Direction)
The Town Manager reviewed the Staff report and asked Council to reaffirm the policy
that Blackie's Brigade would formulate a plan; review it with the POSC and bring it to
Council for their approval.
Councilmember Kuhn stated specific projects were identified and assigned to members
of the Brigade and the Town Engineer delivered drawings to the group,

Nicky Wolf noted that irrigated grass is not one of the approved Development Plans;
that Plan listed accepted vegetation; suggested hiring a landscape architect; asked that
the vegetation palette from the Phillip Williams plan be distributed to the Brigade.

Councilmember Kuhn noted that the current design was created and implemented by' '
POSC Chair Siegel without approval of the Council.

Jan Kase, Hacienda Drive, stated she was disappointed at the look of the Multi-Use
Path with the manicured plants; nat,ive toyan has been cut do.wn; hoped the Town will
keep native grasses; restore natural area that is becoming gentrified.
Henry Siegel"140 Geldert Drive, stated this was his last appearance as Chair of the
POSC; will be leaving to serve the Peace Corps in Slovakia., Mr. Siegel read a prepared
speech urging the Council to wntinue a parking plan, good signage, develop park area
on the bayside, place benches and picnic table at the ~ater's edge,
The Council commended Mr. Siegel for his enthusiasm and good intentions, but declined
his request for funds for a planter box; asked Staff not to do any more work in the area
until Blackie's Brigade report has been approved by Council.

Councilmember Thompson urged all members to attend, Mayor Friedman, Vice-Mayor
Nygren and he will attend this meeting on September 28,
. CAL/TRANS MEDIAN MAINTENANCE CONTRACT
Councilmember Thompson will contact CAL/TRANS to determine if they would be
willing to pay the Town to do their maintenance work along Tiburon Blvd.
. HOMEOWNER ASSOCIATION ASSISTANCE - Landscaping

Councilmember Thompson asked the Council if they would approve of the Town making
loans to homeowner associations for landscaping improvements; Town Attorney to
determine if this would be a proper use of Town funds, and how the Town might pursue
repayment in case of default.

. MOSOUITO ABATEMENT DISTRICT
Vice-Mayor Nygren asked Council to make a formal request for an update and report
on cUrrent District activities; listing frequency and ~e in Tiburon; identifying expenses ,
and costs for Tibuyon. The Town Manager stated he has aireac~ontacted the District;
noted their primary emphasis in the past has been near Safeway and the Railroad Marsh.
