TOWN COUNCIL MINUTES ,-.., CALL TO ORDER Mayor Matthews called the special adjourned meeting of the Tiburon Town Council to order at on Monday, November 16, 1998, at 7:38 p.m. in Town Council Chambers, 1505 Tiburon Boulevard, Tiburon, California. A. ROLL CALL PRESENT: COUNCILMEMBERS: Bach, Gram, Hennessy, Matthews, Thompson PRESENT: EX OFFICIO: Town Manager Kleinert, Town Attorney Danforth, Planning Director Anderson, Finance Director Stranzl, Chief of Police HerJey, Town Engineer Barmand, Town Clerk Crane B. ANNOUNCEMENT OF CLOSED SESSION ACTION Uf anv) Mayor Matthews said the Council had met in closed session because the Town had been added as a named defendant in a lawsuit which challenges the Town's denial of ramps for disabled access on downtown Main Street. -. Mayor Matthews stated, "Our settlement position is unchanged. We have violated no State or Federal accessibility requirements. We are willing to allow resolution of the downtown property owners' accessibility problems by implementing Alternative B, as adopted by the Council on September 16, 1998. We are willing to contribute financially to assist those businesses. The Council's subcommittee has recommended a $60,000 contribution to match Belvedere's commitment. But we must have a financial commitment from the property owners. To date this has not been forthcoming." C. PUBLIC OUESTIONS AND COMMENTS None. D. CONSENT CALENDAR 1) CYPRESS HOLLOW AREA ANNEXATION - Transfer of Landscape & Lighting District from County of Marin - (Adopt Resolution) 2) VISTA TffiURON LOT 16 - (55 Vista Tiburon Drive): Accept Offer of Dedication for Public Pedestrian and Public Utilities Easement - (Resolution) 3) AMICUS BRIEF REQUESTS: A) California Housing Council v. City of Malibu, Case No. B 119503; B) Sierra Club v. San Joaquin LAFCO (California Supreme Court Review Granted September 23, 1998) relating to Exhaustion of Administrative Remedies- (Approve) -~ MOTION: Moved: Vote: To approve Consent Calendar Items 1-3. Bach, Seconded by Thompson AYES: Unanimous r"' Town Council Minutes # 1153 November 16. 1998 Page 1 ,/ -- E. 4) NEW BUSINESS AWARD OF TOWN CONTRACTS - A) ELEPHANT ROCK REHABILITATION PROJECT (Continuedfrom November 4, 1998) Town Engineer Barmand said Supervisor Annette Rose had secured an increase in the amount of the HUD funds for the project, raising it to $125,000. Town Manager Kleinert said the amount of private donations was at $20,000. MOTION: To authorize the Town Manager to sign the Contract with Maggiora & Ghilotti of San Rafael in the amount of $145,316 for the rehabilitation of Elephant Rock. Thompson, Seconded by Hennessy AYES: Unanimous Moved: Vote: In response to a question from Councilmember Thompson, Town Engineer Barmand said the work could start within two weeks and would proceed during the winter. Council thanked the Town Engineer and Supervisor Rose for their efforts to secure grant funding for the project. B) TffiURON POLICE STATION CONSTRUCTION PROJECT - Off-Site Street Improvements ,........ Town Engineer Barmand said Ghilotti Bros. Construction of San Rafael had won the lowest bid out of seven (7) bidders on the November 12 bid opening. Because the Engineer's estimate was $100,000, Councilmember Gram asked if the excess money would come out of the contingency for the [police Station] project. Finance Director Stranz1 said the Town had budgeted $140,000 for the off-site improvements which would come out of its unallocated reserves. Town Engineer Barmand said the Town was still waiting for the CAUTRANS permit and recommended awarding the contract pending receipt of the permit. MOTION: To award Contract in the amount of$124,830 to Ghilotti Bros. Construction of San Rafael for off-site street improvements for the Tiburon Police Station Thompson, Seconded by Bach AYES: Unanimous Moved: Vote: Town Engineer Barmand said the work was to be performed within a 30-day time period. Town Manager Kleinert said the goal was to make substantial progress during the school holiday break. I~ F. ELECTION OF MAYOR Councilmember Hennessy said she had known Mogens Bach since 1974 and it was her pleasure to serve on the Town Council with him. MOTION: Moved: Vote: To nominate Mogens Bach for Mayor. Hennessy, Seconded by Gram AYES: Unanimous H. ELECTION OF VICE MAYOR Councilmember Thompson said he had not known Tom Gram well prior to his election but commented that he was a fantastic addition to the Council. MOTION: Moved: Vote: To Nominate Tom Gram for Vice Mayor. Thompson, Seconded by Matthews AYES: Unanimous I. NEW TOWN COUNCIL COMMENTS/OUESTIONS Mayor-elect Bach said it had been a great first year on the Council and that it was wonderful to have five people who could get along and get things done. He said he was very proud and honored to be elected Mayor of this wonderful Town. ,~. Bach introduced his family members who were present in the audience. He said his two priorities for the coming year were to do his best to "settle the whole Main Street issue" for the better enjoyment of the residents and business community, and to complete Zelinsky Plaza to thank the family for its generous donation ofland for the site of the new Town Hall and Library. Outgoing Mayor Matthews said the high point of his year as Mayor had been the Jonny Moseley Parade and celebration which he said reflected the spirit of what the Tiburon community was all about. Councilmember Gram commended Matthews for a "great job" during his tenure as Mayor. J. ADJO~ENT There being no further business before the Town Council of the Town of Tiburon, Mayor Bach adjourned the meeting at 8:00 p.rn, to a celebration at his home. ~.<?
