HomeMy WebLinkAboutTC Min 1998-06-03 ...- TOWN COUNCIL MINUTES CALL TO ORDER Mayor Matthews called the regular meeting of the Town Council of the Town of Tiburon to order at 7:48 p.m. on Wednesday, June 3, 1998, at Town Hall Council Chambers, 1505 Tiburon Boulevard, Tiburon, California. A. ROLL CALL PRESENT: COUNCILMEMBERS: Bach, Gram, Hennessy, Matthews, Thompson PRESENT: EX OFFICIO: Town Manager Kleinert, Town Attorney Danforth, Planning Director Anderson, Finance Director Stranzl, Chief of Police Herley, Town Engineer Barmand, Town Clerk Crane B. ANNOUNCEMENT OF CLOSED SESSION ACTION (If any) Mayor Matthews said there was no action taken in closed session. ,........ C. PUBLIC OUESTIONS AND COMMENTS Alvin Bonnett, representing the Ecumenical Association for Housing, presented the Town Council with a check in the amount of$81,978.57 for the first repayment of an interest-free loan made by the Town for the Cecilia Place Senior Housing Development. Mr. Bonnett gave a brief history of the project, and said it was now fully occupied. He thanked the Council for its support during a difficult period and said the project's goal, to develop a sense of community, had been realized. D. COUNCIL. COMMISSION & COMMITTEE REPORTS 1) TffiURON WATERSHED DRAINAGE MEETING - (Tiburon and Belvedere Councilmembers and BLPOA Representatives) - (Oral Report) Town Manager Kleinert said the informal workshop presented by former Tiburon Town Engineer Stan Bala was attended by four Belvedere officials, six or seven BLPOA representatives, Town of Tiburon officials and Staff. He said it was an informative and productive meeting, and that the Belvedere representatives expressed an interest for a continued dialog with Tiburon on the subject of Tiburon watershed drainage into the Belvedere Lagoon. Kleinert said the issue centered around what the solution might be to the Lagoon's flooding problem and whether Tiburon had any responsibility in it. He said that Civil Engineer Irv Schwartz was still preparing his study of the Reed watershed for the City of Belvedere. John Kern said the BLPOA was taking water samples every two weeks to determine toxicity levels and he suggested that Tiburon do the same to rule out any potential misunderstandings about the source of the water quality problems in the lagoon. ,..... Kleinert noted that Town had a responsibility to minimize toxics which flowed into the Bay under the State Stormwater Run-Off Program (MCCSTOPP), in which the Town already participated, but said he would look into taking water samples on the Tiburon watershed side as well. Councilmember Thompson suggested that the Town might be able to lend further assistance to the problems of diversion and siltation, and concurred that the biological content of the run-off should be checked. However, Thompson said, the Belvedere Lagoon was primarily a silt pond which had not been built to current standards by the developer. According to Thompson, this was the primary cause of the current problems experienced by the homeowners there. Councilmember Hennessy pointed out that sewage spills from homes on San Rafael avenue during flooding on the Belvedere Llagoon also contributed to the BLPOA's problems. Vice Mayor Bach said the BLPOA had been reluctant to deal with the overall problem, and that President Mike Jenkins had said that they were unable to "get together." Bach said he had voted against paying for a portion of the [Schwartz] study not because the Town was "washing its hands" of the problem, but that they [BLPOA] needed to come up with a solution. He also said he thought the proposed diversion pipe under the Tiburon multi-use path was not the only answer. Town Manager Kleinert said that former Town Engineer Bala had noted in the meeting that the ..-.. Town had done a good job of reducing the amount of siltation into the Belvedere Lagoon over the years. However, Kleinert said it was possible that the siltation pond could be intproved and suggested that Council direct him to take a proactive approach in finding solutions to help reduce the amount of siltation as much as possible. Council concurred with this direction. Councilmember Hennessy also suggested looking into whether the the size of the siltation pond could be increased, and perhaps linked to any future expansion projects on the Belvedere side. 2) BUILDING ADVISORY COMMITTEE - (Update on Status of Tiburon Police Station Project) - (Oral Report) Town Manager Kleinert said the bid opening date had been extended to June 16, and that the contract would be awarded at the June 17 Council meeting if the contractor met all the requirements. He also said that Project Manager Wilson had contacted Cost Estintator Adamson and Associates regarding certain revisions. E. APPOINTMENTS TO BOARDS. CONSENT CALENDAR 4) TOWN COUNCIL MINUTES - #1138, May 6, 1998 - (Approve) 5) TOWN MONTHLY INVESTMENT SUMMARY - (As of Apri130, 1998) - (Accept) 6) TOWN INVESTMENT POLICY STATEMENT - (Adopt 1998 Revised Statement) 7) AMICUSBRIEFREQUEST-De/MonteDunesv. City of Monterey, U.S. Supreme Court No. 97-1235 - (Approve) Council removed item 6 from Consent. Mayor Matthews asked for a correction to page 7 of the minutes to read that Council "supported" rather than "had taken an oath to uphold" the Town's General Plan. MOTION: Moved: Vote: To Adopt Consent Calendar, as amended above. Hennessy, Seconded by Thompson AYES: Unanimous ,-... 6) TOWN INVESTMENT POLICY STATEMENT - (Adopt 1998 Revised Statement.) Finance Director Stranzl commented that the current policy was 10 years old and very "generic," while the new policy was more explicit. Town Treasurer Osher concurred and said the revision would let the public know exactly what the Town can and cannot do. He noted that the Town's money would continue to be invested in the State Pool (LAIF). Mayor Matthews noted that the Town's goals were still safety and stability for its investments. MOTION: To adopt Resolution Adopting a Statement of Investment Policy for Calendar Year 1998 Hennessy, Seconded by Gram AYES: Unanimous Move: Vote: Council moved Item 11 up on the agenda. K. COMMUNICATIONS 11) MARIN/SONOMA MOSQUITO AND VECTOR CONTROL DISTRICT - (Letter dated May 26, 1998 Re: New Facilities in West Cotati) ,,-. Co!. Roger Smith review the proposed project with Council and explained that it would represent a $9.75 addition on the tax bill of every parcel in Marin and Sonoma Counties, which would then Town Council Minutes #1140 June 3,1998 Page 3 '""' decrease after two years until completion of the project. G. UNFINISHED BUSINESS 8) MOTOR VEHICLE LICENSE FEES - (Discussion of Town's Opposition to Proposed Repeal.) Council discussed whether it wanted to take further action in opposition to the proposed repeal. Councilmember Hennessy suggested taking out a newspaper ad with a coupon for interested residents to mail to Sacramento. Town Attorney Danforth said there were limits on lobbying by the Council but said she would look into the matter further. Town Manager Kleinert said the issues were whether the State would actually make-up the difference to the cities and/or whether the cities should oppose the legislation (AB 1776) all together. He also said a concern was whether there would be strings attached to any back-fill. Mayor Matthews said the loss of$340,000 of the Town's operating budget would be a "disaster." He said it was ironic that the Republicans wanted to cut (local) government where it is most efficient. -- Chief of Police Herley said that as President of the California Chief s Association, their position was not to support "earmarking" any possible back-fill monies for public safety. Herley said the (McClintock] bill would have an adverse effect on every city and county which, in turn, would have an adverse effect on law enforcement. However, he said the Cal Chiefs thought the "train was moving" and would therefore try to influence the Governor to guarantee a back-fill to local government with no future "tinkering." Council concurred that Council's legislative representative, Mayor Matthews, would work with his colleagues to move forward with the most effective approach. Councilmember Hennessy commended The Ark newspaper for covering the story. H. None. NEW BUSINESS L 9) PUBLIC HEARING TIBURON'S MUNICIPAL BUDGET - (Introduction and Overview of Preliminary Two- Year Budget Plan.) Finance Director Stranzl said the proposed budget anticipated an increase in property tax revenues for the upcoming fiscal years, and noted that there would be a budget surplus of approximately $200,000 at the end of the 1997-98 fiscal year. He said salaries and benefits represented 64% of the Town's proposed operating budget. Council had some questions about the Capital Improvement Budget for street repairs. /"' Councilmember Thompson wondered why some of the streets had not yet been repaired since the Town Council Minutes #1140 June 3,1998 Page 4 r-- monies had been approved for those repairs by previous Councils. Finance Director Stranz1 referred the questions to the Town Engineer, but said that the heavy rains was one reason for delays in the program. Councilmember Hennessy also said that the Town Engineer attempted to group streets together in order to make more efficient use of the funds. Counci1member Hennessy recommended renting out the Council Chambers for special events as an additional revenue source. Council continued the budget item for further discussion on June 11, 1998. 10) MARIN ANIMAL CONTROL ORDINANCE - Repeal Ordinance No. 426 N.S.lAdopt New Ordinance Representing Correction to Previous Ordinance Pertaining to an Increase in License Fees, Confinement & Quarantine, and Potentially Dangerous and Vicious Dogs- (Second Reading and Adoption) Mayor Matthews opened and closed the public hearing. There was no public comment. MOTION: Moved: Vote: To read Ordinance by Title Only. Hennessy, Seconded by Gram AYES: Unanintous -- Mayor Matthews read, "An Ordinance of the Town Council of the Town of Tiburon Repealing Ordinance No. 426 N.S. and Adopting by Reference the Amended Animal Control Regulations of Title 8 of the Marin County Code Pertaining to an Increase in License Fees, Confinement & Quarantine, and Potentially Dangerous and Vicious Dogs." MOTION: Moved: Vote: To Adopt above Amended Animal Control Ordinance. Hennessy, Seconded by Bach AYES: Bach, Gram, Hennessy, Matthews, Thompson NOES: None L. STAFF & TOWN MANAGER REPORTS Town Manager Kleinert asked for direction concerning use of the Waterfront (Shoreline) Park by people wanting to hold special events there. Council recommended charging a fee, per the Town's Filming Permit Schedule, to allow an applicant to park a NASCAR at the park on a certain date. M.
