Study
Dear Mr. Watrous:
ABAG and the State Coastal Conservancy have approved your request for an additional $12,658
in order to more fully investigate bicycle and pedestrian facility options on Strawberry Drive and
Harbor Cove Way. The new total for the overall grant is $97,658.
In order to facilitate the expanded scope of work for the above referenced project, the contract
expiration date will be extended to October 1, 2012 once we receive a signed copy of this letter.

Subject: July Project Progress Update
I would like to wish a happy summer to all.
The utility undergrounding project is proceeding well. A considerable amount of work has been completed, but
there is just a bit more to do. I would like to particular thank everyone for their cooperation and patience during
this time. Iknow it has been difficult at times. However, completion and a resurfaced pavement are around the
corner. Here are some key update items for your information (timeline is subject to change):
• Currently the Town portion of the project is roughly 95 percent complete. The main joint trench and tie-
ins to your service lateral should be largely complete by the end of the month. Final restoration of all the
trenches which were temporarily patched is also anticipated by the end of the month, if not, by the
middle of August.
• We are working with some property owners to finalize their utility easements among themselves and
PG&E. It is imperative that these owners complete this process or PG&E will not provide them with
service until then.
• Town/District anticipates turning the vacant conduit over to the utilities - End of Aug.
• PG&E would start to pull their wires through their conduits -
• Town would begin resurfacing of roads -
• PG&E would complete their work -
• Town would complete the resurfacing project -
• Comcast would start to pull their Wires -
• Comcast would complete their work -

Dear Ms. Curran:
On behalf of our Board of Directors, I am writing to let you know that the Marin Association of
REALTORS*) is calling on Tiburon and the nine other local jurisdictions that conduct onsite
inspections of residential properties to adopt and enforce six basic principles that seek to ensure the
inspections are fair to homeowners.
Depending on individual housing markets, dozens - or hundreds - of residential properties may be sold
every year in these cities and towns. According to the association's housing turnover index, the
average number of annual residential property sales over the last five years in Tiburon is 123.
The resale inspection principles that were approved by our Board of Directors call for consistency, no
double jeopardy, transparency, timeliness, revenue neutrality and sensitivity to today's economic
conditions. The principles, which are enclosed, were prompted by reports from REALTORS*) about
various problems associated with resale inspections in different cities and towns in the county.
Our members and their clients have experienced issues about the conduct of inspections in some
jurisdictions more than others. But rather than rehashing old problems, we want to start fresh with a
clean slate for all local governments. After the six principles are adopted, it will be much easier to
monitor compliance and address issues.
I look forward to working with you and your colleagues to ensure these principles are adopted and
enforced as soon as possible.

Fair Principles for City and Town Resale Inspections
The Marin Association of REALTORS® recognizes that public entities have a
legitimate community interest in ensuring that local housing is safe and meets
current building codes. Cities and towns often seek to accomplish this by
conducting property inspections (resale inspections) when homes are sold and
providing written reports to the buyers prior to close of escrows. Homeowners
are charged a fee for this process.
At the same time, citizens have a right to expect transparency, consistency and
fairness when their elected governments require mandatory inspections. Resale
reports should not include arbitrary decisions, subject owners to inconsistent
standards, promulgate new rules, or generate additional revenue to close budget
gaps.
To proactively address these issues and avoid unreasonable obstacles to home
sales and frustrations for residents in the resale inspection process, the Marin
Association of REALTORS® calls on local governments in jurisdictions where
onsite inspections are conducted to adopt and enforce the following key principles
and ensure that they are communicated to the public.
➢ Consistency
Building standards should not be applied retroactively. Homeowners who
performed work on their homes in accordance with building standards in
effect at the time of the work, but without a permit, should not be required
to redo the work when they obtain a permit at the time of sale.
No Double Jeopardy
• Re-inspections to finalize resale report repairs should not raise new issues
that were not identified on the original resale reports. Different inspectors
should not mean different standards and results.
• When homes are sold, and the homeowners originally bought them with
approved city or town reports, new items for the current reports should not
be raised that were not included on the original reports if the building
standards did not change.
➢ Transparency
• Cities and towns should communicate resale inspection requirements in
advance. Rules, procedures, timelines and potential penalties should be
posted at city and town offices and on their Web sites.
• The cost analysis used to set inspection fees should be posted by cities and
towns at their offices and on their Web sites.
➢ Timely Inspection Process
• When cities or towns mandate inspections as a condition of home sales,
they have an obligation to the citizens to ensure that the process is
completed within a reasonable timeframe without obstructing the sales.
• Trained city and town staff should be available to meet posted due dates,
including adequate coverage for vacations, etc.
• Owners should be able to schedule inspections within seven working days,
and receive reports within seven working days after the inspections.
• Resale inspection timelines should be posted by cities and towns at their
offices and on their Web sites. If the cities or towns cannot meet the posted
timelines, then the inspections should be waived.
➢ No Excess Inspection Fees
Inspection fees should only recover the full cost of the inspections, and
should not be used to generate additional revenue for the cities or towns.
➢ Distressed Home Sales
In recognition of today's economic conditions, homes that are sold as short
sales should have inspection fees waived or substantially reduced.

NOTICE OF PUBLIC SCOPING MEETING AND
NOTICE OF PUBLIC WORKSHOP FOR THE
2012 DRAFT MARIN COUNTY HOUSING ELEMENT
SUPPLEMENT TO THE 2007 COUNTYWIDE PLAN ENVIRONMENTAL IMPACT REPORT
Marin County will be preparing a Draft Supplement to the Countywide Plan Environmental Impact Report (EIR)
for the 2092 Draft Marin County Housing Element, as proposed by the Marin County Community Development
Agency (CDA). The 2012 Draft Housing Element is an update of the County's State-certified Housing Element
that was adopted initially in November 1991, readopted with the Countywide Plan Update in January 1994,
updated in June 2003, and then readopted with the Countywide Plan Update in November 2007. The 2012
Draft Housing Element addresses the requirements of California Government Code 65583, for the planning
period from 2007 to 2014.
The 2012 Draft Housing Element consists of several main sections, each of which addresses a major subject
area, including a review of constraints on housing development, an inventory of potential housing sites, and a
set of policies and programs to support housing at all income levels.
The Sites Inventory and Analysis provides an inventory of potential housing sites. For the purposes of this
environmental review, the Available Land Inventory provides both the 2007-2014 and the 2014-2022 housing
element planning periods. Although the 2012 Draft Housing Element is for the 2007-2014 planning period, the
EIR Supplement analysis that will be prepared will include an analysis of potential housing sites for the 2014-
2022 planning period. It is anticipated that inclusion of the potential sites for the 2014-2022 cycle will expedite
the review and approval of the housing element for that planning period.
The Goals, Policies and Programs section contains programs that should be implemented in the 2007-2014
planning period. The programs focus on three objective areas, -including efficient land use, providing housing
choice, and ensuring institutional capacity to respond to the community's housing needs. Policy initiatives and
amendments to zoning regulations are considered in this section.
The actions contemplated by this EIR Supplement include Countywide Plan land use changes, amendments to
Marin County Development Code standards, and rezoning of certain properties. The EIR Supplement will also
evaluate potential zoning or Countywide Plan land use designation changes for three existing housing sites to
address conformance with the existing uses.
Marin County is the lead agency, pursuant to the State Guidelines for the California Environmental Quality Act
(CEQA Guidelines Section 15050) for the preparation of a Supplement to the EIR for the Countywide Plan,
certified in 2007. This EIR Supplement is being prepared by the County of Marin in accordance with CEQA,
the State of California CEQA Guidelines, and County Environmental Impact Review Guidelines. The 2007
Final EIR is available for review at the Marin County Community Development Agency. In addition, a copy is
available for review online at http://www.co.marin.ca.us/depts/CD/main/fm/eir.cfm. The EIR Supplement will
evaluate the project with respect to all of the following topical issues, but will focus on some issues more than
others.

To ensure that the EIR Supplement for this project is thorough and adequate, and meets the needs of all
agencies reviewing it, we are soliciting comments on specific issues to be included in the environmental review.
Public comments on the scope of issues to be evaluated in the EIR Supplement are also encouraged. Details
of the proposed project are on file with the office of the Marin County Community Development Agency, 3501
Civic Center Drive, Suite 308, San Rafael, CA 94903-4157, and are available for public review between the
hours of 8:00 a.m. to 4:00 p.m., Monday through Thursday.
So that the EIR Supplement will address any additional issues that may be of concern to the public for this
proposed project, the County will also conduct a public scoping meeting on Thursday, August 2, 2012 from
6:30 p.m. to 8:30 p.m., in the Planning Commission Chambers (Suite #328 - Administration Building)

Supplement. Hard copies of the scoping session materials will not be distributed in advance of the meeting.
However, the scoping session materials can be found on the Environmental Planning website at
http://www.co.marin.ca.us/depts/CD/main/comdev/eir.cfm and will be available in hard copy at the scoping
session.
In addition, a Workshop on the Draft Housing Element content will be held on Wednesday, August 29, 2012
from 6:30 p.m. to 8:30 p.m. at the Marin City Senior Center; 630 Drake Avenue, Marin City, CA 94965. At
this Workshop, staff will discuss some key aspects of the 2012 Draft, answer questions and take comments
from the public on the data, programs or sites contained in the Draft. Please be advised that the Workshop is a
separate event from the CEQA scoping session on this project and is not intended for the purpose to receive
scoping comments on the EIR Supplement.
