CALL TO ORDER AND ROLL CALL:
Chair Tollini called the meeting to order at 7:30 p.m.
Present: Chair Tollini, Commissioners Corcoran, Kunzweiler and Welner
Absent: Vice Chair Weller

COMMISSION AND STAFF BRIEFING:
Planning Manager Watrous announced that there was an item scheduled for the September 12,
2012 agenda and there will be a Planning Commission meeting held on that date.
NEW BUSINESS:
1. 1651 TIBURON BOULEVARD: CONDITIONAL USE PERMIT TO EXPAND
THE FRONT OUTDOOR SEATING AREA AND ALLOW ACOUSTIC
INDOOR/OUTDOOR MUSIC FOR THE TIBURON TAVERN RESTAURANT
AND MODIFY THE VEHICULAR CIRCULATION PATTERN FOR THE
LODGE AT TIBURON; FILE #11203; Tiburon Hotel, LLC, Owner; Adam
Hollander, Applicant; Assessor Parcel Number 058-171-87
Planning Manager Watrous said that this application proposes a variety of changes to the current
operating procedure to the Lodge at Tiburon and the Tiburon Tavern. The first is the expansion
of the front outdoor patio seating area by relocating the outdoor seating at the back of the
restaurant to the front patio area. There would be no increase in the number of seating with the
proposed expansion, and moveable planter boxes would surround the patio area as a safety
barrier. Second, there is a request to permit indoor/outdoor live music for the restaurant on a
daily basis. The music would be unamplified, without any connection to an amplifier or speaker
system. Lastly, there is a request to modify the current driveway circulation pattern for the hotel
by incorporating a new driveway approach at the front entrance and installing magnetic barrier
arms at the northwest and southwest driveway entrances. Currently a vehicle can enter and exit
the parking lot for both the hotel and restaurant at the northwest driveway and enter only at the

southwest driveway. The circulation pattern would be modified by only allowing vehicles for the
hotel and restaurant to enter at the southwest driveway and exit only at the northwest driveway.
Planning Manager Watrous said that the general approach allowing music in Downtown Tiburon
has been to not allow it to be audible beyond the area controlled by the applicant. In this
instance, that would mean music would not be audible by the Tiburon Boulevard sidewalk. He
said that there have been problems with several restaurants downtown with amplified music
being audible at residential properties and encouraged the Commission to look at that issue
carefully. He stated that the current circulation pattern for parking is confusing and the
reconfiguration would help alleviate that to some extent. He said that staff would like to hear
from the Commission as to whether the one-way direction would reduce that confusion.
Adam Hollander, project manager, said that they had had a lot of demand from customers for the
patio space and would like to extend the patio so that more customers can sit out there. He said
that this would also be more aesthetically pleasing from Tiburon Boulevard. He said that they
understood the limitations of not having music go beyond the boundaries of the property, do not
want to disturb anyone and will be very sensitive to the music. He pointed out that the closest
people that would be affected by the music are their own customers staying at the hotel. He
stated that the traffic flow would be a large improvement and reduce confusion. He said that the
magnetic barrier would allow them to prevent cars from parking all day for free in the lot so
there would be more space to allow complimentary parking for guests of the hotel and restaurant.
He said that they would charge for parking for any cars not using the hotel or restaurant.
Commissioner Welner asked how they intend to self-regulate the music to prevent any
disturbances and the style of music. Mr. Hollander said that they have not discussed the style of
music but they would definitely not have drums. He said that it would be fine with them if brass
instruments or drums were not allowed.
Chair Tollini opened the public hearing.
Bjorn Solberg said that he lives next door to the Lodge in the Point Tiburon Lagoon complex and
was concerned about the music. He said that it was reassuring to hear that the music would not
be heard beyond the boundary of the property, but he noted that there are 18 homeowners
situated close to the Lodge and in the past there have been complaints from some of them
because of noise from the property. He said that if the music is not heard at those homes then
there was no issue. However, he said that the first step if music is heard would be to contact the
Lodge.
Mr. Hollander said that it would be useful to establish a protocol in place to address concerns if
there are complaints and they would be fine with eliminating the music if there are complaints.
Chair Tollini closed the public hearing.
Commissioner Welner said that it was good to see the Lodge trying to adapt to the situation in a
way that will please the public. He was concerned about the music issue but it sounded like the
representative of the neighbors and the applicant were both amenable to reasonable restrictions.

He thought that there could be restrictions allowing only certain instruments or decibel limits and
wanted to hear other Commissioners' ideas.
Commissioner Corcoran thought that it was great that the Lodge was making improvements and
he felt that the property had improved tremendously since its remodel. He supported expanded
seating in front and the larger driveway. He thought that the mechanical arm was not very
attractive and asked if there were similar parking devices elsewhere in Downtown Tiburon.
Planning Manager Watrous said that both of the larger paid parking lots have mechanical arms.
Commissioner Corcoran recommended starting smaller and allowing music only on the
weekends. He thought that the Commission could try to name categories of instruments such as
drums or brass instruments. He recommended that the Lodge could come back in the future if it
was working well and ask for expansion to allow music every day.
Commissioner Kunzweiler disagreed with Commissioner Corcoran. He said that it was great to
see things thriving in downtown Tiburon and felt that should be supported. He said that this
conditional use permit would be reviewed in 6 months. He said that the applicant expressed a
reasonable attitude and noted that this would involve unamplified music. He said that this was a
reasonable request and there would be a process if they do not operate in compliance with the
conditional use permit. He said that it was no secret that there is free parking at the Tiburon
Lodge and he thought that they were taking reasonable steps to regulate that.
Commissioner Kunzweiler noted that the outdoor seating would not be very comfortable in the
rainy season and he asked what the plan would be for that area during that season. Mr. Hollander
said that they would probably move some of the seating to the back area. He also said that the
north side parking gate would be 54 feet back from the street and on the other side would be
about 20 feet back, reducing the visibility of the mechanical arms. Commissioner Kunzweiler
supported the conditional use permit as drafted with the condition of approval in the permit that
the sound cannot leave the property.
Commissioner Welner said that the provision that says that none of the outdoor music would be
audible off the property would likely be violated because it would almost certainly be heard off
the property. Commissioner Kunzweiler agreed and questioned whether that was realistic. He
said that he was more concerned if it disturbed the neighbors.
Chair Tollini said that it was nice to see activity Downtown and if music can contribute to that,
the question was how to allow it without it bothering the neighbors. She said that if they do allow
music the Lodge should provide a phone number and contact the neighbors to tell them how to
contact them. She suggested changing the wording in the conditional use permit to limit it to a
"reasonable" level of music rather than limiting it to not being heard off the property.
Commissioner Corcoran reiterated he would like to start with allowing music only on weekends
because the tourist season was dying down now and they would probably only have music on
weekends anyway until next summer.

Commissioner Welner suggested changing the condition of approval to authorize acoustic music
outdoors but that such music must remain within reasonable limits. Planning Manager Watrous
said that the condition of approval was similar in language to what has been adopted for other
Downtown businesses and is enforceable. He said that if the Town receives complaints then the
permit would be brought to the Planning Commission for review and the Commission could
determine at that time if it should be revoked.
Chair Tollini suggested revising the language to: "Live acoustic music or entertainment shall be
permitted within the indoor or outdoor areas of the restaurant provided that no music,
entertainment, or amplified sound shall be reasonably audible beyond the area under control of
the permittee."
Commissioner Kunzweiler said that he liked the idea of sending a contact number to neighbors at
the Point Tiburon condominiums telling them how to contact the Lodge if the music is too loud.
Commissioner Welner said that he would add to the sentence clarification that amplified music is
prohibited in the outdoor area of the restaurant.
Planning Manager Watrous summarized the direction of the Commission to modify Condition of
Approval No. 2 to read as follows:
"Live acoustic music or entertainment shall be permitted within the indoor and outdoor
areas of the restaurant, provided that no music is reasonably audible beyond the area
under control of the permittee. Amplified music is not permitted in outdoor areas of the
restaurant. The applicant shall distribute a telephone contact number for noise complaints
to residents of the Point Tiburon Lagoon condominium complex."
ACTION: It was M/S (Kunzweiler/Welner) to adopt the revised draft resolution conditionally
approving the project. Motion carried: 3-1 (Corcoran opposed).
