above-referenced application. The subject parcel is located within the Town of
Tiburon Sphere of Influence as determined by Marin LAFCO, but is not contiguous t
the Town of Tiburon corporate limits.
The Town has no objection to the annexation of this property to the sanitary district.

A group of citizen-volunteers recently came together to form the Tiburon
Peninsula Landscaping Task Force. Our "GreenTeam" is dedicated to keeping
the Tiburon Peninsula's roadways, medians and public areas green and
flourishing.
Our goal is to slowly, but surely, enhance the landscaping in public spaces from
the Tiburon Railroad Museum to 101. One of our first projects is - with the
cooperation of the landowner - to enhance some of the Point Tiburon Plaza
sidewalk medians which are Tiburon's all important "front door" for those
entering and leaving the Town by ferry.
We are, therefore, seeking to have the historic "Tiburon Palm" located across
from Ferry Plaza designated a protected heritage tree. This palm is integral to our
Town's history and as such, requires maintenance and oversight to flourish. We
have been advised by Scott Anderson that such a declaration is called for in the
Town of Tiburon's Master Plan (ref: Program DT-g) and that the Town Council has
jurisdiction to confer such status. Thus, we call upon you to take take the
necessary steps to confer this protected status designation to the Tiburon Palm.

TOWN OF TIBURON LATE MAIL POLICY
(Adopted and Effective 11/7/2007)
The following policy shall be used by the Town Council and its standing boards and commissions, and by
staff of the Town of Tiburon, in the identification, distribution and consideration of late mail.
DEFINITION
"Late Mail" is defined as correspondence or other materials that are received by the Town after
completion of the written staff report on an agenda item, in such a manner as to preclude such
correspondence or other materials from being addressed in or attached to the staff report as an exhibit.
IDENTIFICATION OF LATE MAIL
All late mail -received-by- Town Staff in advance-of a meeting shall be marked "Late Mail" and shall be
date-stamped or marked with the date of receipt by the Town. Late mail received at a meeting shall be
marked as "Received at Meeting" with a date-stamp or handwritten note.
POLICY
For regular meetings of the Town Council and its standing boards and commissions:
(1) All late mail that is received on an agenda item prior to distribution of the agenda packet to the
reviewing authority shall be stamped or marked as "Late Mail" and shall be distributed to the
reviewing authority with the agenda packet.
(2) All late mail received on an agenda item before 5:00 PM on the Monday prior to the meeting
shall be date-stamped and marked as "Late Mail" and distributed to the reviewing authority as
soon as practicable. Such mail shall be read and considered by the reviewing authority whenever
possible. If the Monday, or Monday and Tuesday, prior to the meeting are a Town-recognized
holiday, the deadline shall be extended to the following day at Noon.
(3) Any late mail received on an agenda item after the deadline established in paragraph (2) above
shall be date-stamped, marked as "Late Mail" and distributed to the reviewing authority as soon
as reasonably possible, but may not be read or considered by the reviewing authority. There
should be no expectation of, nor shall the reviewing authority have any obligation to, read or
consider any such late mail, and therefore such late mail may not become part of the
administrative record for the item before the reviewing authority.
These provisions shall also apply to special and adjourned meetings when sufficient lead time exists to
implement these provisions. If sufficient lead time does not exist, the Town Manager shall exercise
discretion in establishing a reasonable cut-off time for late mail. For controversial items or at any
meeting where a high volume of correspondence is anticipated, Town staff shall have the option to
require an earlier late mail deadline, provided that the written public notice for any such item clearly
communicates the specifics of the early late mail deadline, and the deadline corresponds appropriately to
any earlier availability of the agenda packet.
Pursuant to state law, copies of all late mail shall be available in a timely fashion for public
inspection at Tiburon Town Hall, 1505 Tiburon Boulevard, Tiburon.

RE: 415 Area Code Meeting
Dear Vice Mayor O'Donnell:
This letter is to invite your participation in the California Public Utilities Commission's (CPUC) decision-making
process in connection with a change to the 415 area code. The 415 area code is expected to use up all available
area code-prefix combinations by the third quarter of 2015 and the CPUC needs to begin a process to introduce a
new area code.
When the CPUC considers a change to an area code, the perspectives of local government officials and the
community are very important. On January 16, 2013, in conjunction with the North American Numbering Plan
Administrator (NANPA), the CPUC will host a meeting for the local jurisdictions within geographic area covered
by the 415 area code. At this meeting, CPUC staff and NANPA representatives will explain the options available
for adding the 628 area code to the geographic area covered by the 415 area code. We invite local officials to
participate in this process. We also will be discussing the status of numbering resources in the 415 area code that
should be useful to you in explaining this change to your own constituents.
Enclosed are two maps of the 415 area code. Because of FCC rules, the NANPA is likely to recommend
introducing a new area code to 415 as an all services overlay. An overlay retains the same area code for currently
assigned numbers, but requires customers to dial the area code plus the 7-digit number for every call made, even
calls within each area code. Additional information is available at

new area codes is governed by FCC rules, which have specific requirements for a split. The circumstances
involved in adding a new area code to the 415 are not consistent with the FCC's rules, but the CPUC could seek a
waiver of those rules if public sentiment strongly favors a split option.
In addition to the local jurisdiction meetings, the CPUC will hold public meetings on January 16 and 17, 2013.
Please share this area code meeting information with your constituents and encourage them to attend one of these
meetings. Enclosed is a flyer with more details about the meetings. Following the meetings, NANPA will submit a
petition to the CPUC for authorization to implement an area code change plan in the 415 area code.

Subject: Assembly Bill 1616, California Homemade Food Act TOWN OFTIBURON
We are writing to ensure that you are aware of AB 1616, the California Homemade Food Act. AB 1616 will
allow for the production of non-potentially hazardous foods from a home-based kitchen within the state of
California effective January 1, 2013. Local Environmental Health Agencies are responsible for the permitting
and registration of the Cottage Food Operation (CFO) under the authority of California Retail Food Code.
Frequently asked questions regarding AB1616 can be found on our website at www.marincounty.org/ehs.
AB1616 also imposes certain responsibilities on local planning jurisdictions. The section from AB1616
pertaining to local zoning requirements is printed below for your reference.
Marin County Environmental Health Services (EHS) will begin accepting permit applications on January 1,
2013. EHS will ask that the CFO obtain prior approval from the local planning/zoning agency. We understand
that some city codes mandate that prior to the issuance of a business license by the city, a sign-off or approval
of the license by the county health department is required. In such cases, EHS would issue the CFO permit
and advise the applicant to obtain local approval prior to operation. We are interested in making the permit
process as smooth as possible for all parties.
CHAPTER 6.1. Cottage Food Operations

(a) A city, county, or city and county shall not prohibit a cottage food operation, as defined in Section 113758 of the Health and Safety
Code, in' any residential dwellings, but shall do one of the following:
(1) Classify a cottage food operation as a permitted use of residential property for zoning purposes.
(2) Grant a nondiscretionary permit to use a residence as any cottage food operation that complies with local ordinances prescribing
reasonable standards, restrictions, and requirements conceming spacing and concentration, traffic control, parking, and noise control
relating to those homes. Any noise standards shall be consistent with local noise ordinances implementing the noise element of the
general plan. The permit issued pursuant to this paragraph shall be granted by the zoning administrator, or if there is no zoning
administrator, by the person or persons designated by the planning agency to grant these permits, upon the certification without a
hearing.
(3) Require any cottage food operation to apply for a permit to use a residence for its operation. The zoning administrator, or if there is
no zoning administrator, the person or persons designated by the planning agency to handle the use permits, shall review and decide
the applications. The use permit shall be granted if the cottage food operation complies with local ordinances, if any, prescribing
reasonable standards, restrictions, and requirements concerning the following factors: spacing and concentration, traffic control,
parking, and noise control relating to those homes. Any noise standards shall be consistent with local noise ordinances implementing
the noise element of the general plan. The local government shall process any required permit as economically as possible. Fees
charged for review shall not exceed the costs of the review and permit process. An applicant may request a verification of fees, and the
city, county, or city and county shall provide the applicant with a written breakdown within 45 days of the request. The application form
for cottage food operation permits shall include a statement of the applicant's right to request the written fee verification.
(b) In connection with any action taken pursuant to paragraph (2) or (3) of subdivision (a), a city, county, or city and county shall do all
of the following:
(1) Upon the request of an applicant, provide a list of the permits and fees that are required by the city, county, or city and county,
including information about other permits that may be required by other departments in the city, county, or city and county, or by other
public agencies. The city, county, or city and county shall, upon request of any applicant, also provide information about the anticipated
length of time for reviewing and processing the permit application.
(2) Upon the request of an applicant, provide information on the breakdown of any individual fees charged in connection with the
issuance of the permit.

(3) If a deposit is required to cover the cost of the permit, provide information to the applicant about the estimated final cost to the
applicant of the permit, and procedures for receiving a refund from the portion of the deposit not used.
(c) Use of a residence for the purposes of a cottage food operation shall not constitute a change of occupancy for purposes of the State
Housing Law (Part 1.5 (commencing with Section 17910) of Division 13 of the Health and Safety Code), or for purposes of local building
and fire codes.
(d) Cottage food operations shall be considered residences for the purposes of the State Uniform Building Standards Code and local
building and fire codes.
SEC. 3.
Section 109947 of the Health and Safety Code is amended to read:

"Food processing facility" means any facility operated for the purposes of manufacturing, packing, or holding processed food. Food
processing facility does not include a food facility as defined in Section 113785, a cottage food operation that is registered or has a
permit pursuant to Section 114365, or any facility exclusively storing, handling, or processing dried beans.
SEC. 4.
Section 110050 of the Health and Safety Code is amended to read:

The Food Safety Fund is hereby created as a special fund in the State Treasury. All moneys collected by the department under
subdivision (c) of Section 110466 and Sections 110470, 110471, 110485, 114365, 114365.6, 111130, and 113717, and under Article 7
(commencing with Section 110810) of Chapter 5 shall be deposited in the fund, for use by the department, upon appropriation by the
Legislature, for the purposes of providing funds necessary to carry out and implement the inspection provisions of this part relating to
food, licensing, inspection, enforcement, and other provisions of Article 12 (commencing with Section 111070) relating to water, the
provisions relating to education and training in the prevention of microbial contamination pursuant to Section 110485, and the
registration provisions of Article 7 (commencing with Section 110810) of Chapter 5, and to carry out and implement the provisions of the
Califomia Retail Food Code (Part 7 (commencing with Section 113700) of Division 104).

DRAFT SUPPLEMENT TO THE 2007 COUNTYWIDE PLAN FINAL ENVIRONMENTAL IMPACT
REPORT
NOTICE IS HEREBY GIVEN that a Draft Supplement to an Environmental Impact Report (Draft SEIR) has
been completed for the project identified below, and is on file with the Marin County Community Development
Agency, 3501 Civic Center Drive, Suite 308, San Rafael, California, and available for public review between
the hours of 8:00 a.m. to 4:00 p.m., Monday through Thursday. Copies of the Draft SEIR may be obtained from
the Community Development Agency. In addition, a copy is available for review at the Marin County Civic
Center Library and other public libraries throughout Marin County. All relevant documents incorporated into
the Draft SEIR by reference are also available for public review at the Community Development Agency office.
A copy of the Draft SEIR can also be accessed on our website,
http://www.co.marin.ca.us/depts/CD/main/comdev/eir.cfm. The 2007 Countywide Plan Final EIR is available for
review at the Community Development Agency and is available for review online at
http://www.co.marin.ca.us/depts/CD/main/fm/eir.cfm.
The 2012 Draft Housing Element consists of several main sections, each of which addresses a major subject
area, including a review of constraints on housing development, an inventory of potential housing sites, and a
set of policies and programs to support housing at all income levels.
The Sites Inventory and Analysis provides a list of potential housing sites. For the purposes of this
environmental review, the list of sites includes both the 2007-2014 Available Land Inventory and Potential
Housing Sites for the 2014-2022 Housing Element planning period. Although the 2012 Draft Housing Element
is for the 2007-2014 planning period, the Draft SEIR includes an analysis of potential housing sites that may
be considered for inclusion in the future Housing Element for the 2014 to 2022 planning period, or the current
Draft Housing Element. It is anticipated that inclusion of the potential sites for the 2014-2022 cycle will
expedite the review and approval of the Housing Element for that planning period.
The Goals, Policies and Programs section contains programs that are proposed to be implemented in the
2007-2014 planning period. The programs focus on three objective areas, including efficient land use,
providing housing choice, and ensuring institutional capacity to respond to the community's housing needs.
Policy initiatives and amendments to zoning regulations are considered in this section.
The actions contemplated by this Draft SEIR include Countywide Plan land use changes, amendments to
Marin County Development Code standards, and rezoning of certain properties. The Draft SEIR also
evaluates potential zoning or Countywide Plan land use designation changes for three existing housing sites to
address conformance with the existing uses.
NOTICE IS HEREBY FURTHER GIVEN that this Notice of Availability of the Draft SEIR commences a 45-day
public review period beginning December 20, 2012. Interested persons are invited to review and comment on
the Draft SEIR. Written comments on the Draft SEIR must be submitted to the Community Development
Agency, NO LATER THAN 4 p.m., Monday, February 4, 2013. Comments can also be sent via email to
envplanning(a,marincounty.org or faxed to the Community Development Agency at (415) 473-7880 to the

conducted by the Marin County Planning Commission (PC). Oral and written comments on the Draft SEIR
may be presented to the PC at the hearing. The hearing is scheduled for the regular meeting of the Marin
County Planning Commission on Monday, January 14, 2013, in the Planning Commission Chambers (Room
#328 - Administration Building) Civic Center, San Rafael, California, at which time any and all persons
