CC-- / TOWN COUNCIL MINUTES CALL TO ORDER Mayor Fraser called the regular meeting of the Tiburon Town Council to order at 7:30 p.m. on Wednesday, December 5, 2012, in Town Council Chambers, 1505 Tiburon Boulevard, Tiburon, California. Town of Tiburon ANNOUNCEMENT OF ACTION TAKEN IN CLOSED SESSION, IF ANY Mayor Fraser said there was no action taken in closed session. ORAL COMMUNICATIONS Doug Patterson, representing the Southern Marin LaCrosse Club, spoke abut the lack of field space in Marin and the desire of the club to obtain access to McKegney Green. Mr. Patterson said that the LaCrosse season takes in the spring which would not conflict with the soccer season. He said that many community members were in both leagues and that the club would be willing to provide financial assistance to the Town for field maintenance [similar to the Tiburon Peninsula Soccer League]. DRAFT Town cil Minutes #23 -2012 December 5, 2012 Page 1 Mr. Patterson said that he had been informed by Town staff that the POST Commission was the appropriate venue to discuss the matter. He said he wished to inform the Council of the request and, if possible, expedite the discussion since POST would not meet again until January. Remarks by Outgoing Mayor (Mayor Fraser) 2. Election of Mayor - Vice Mayor O'Donnell will take the Chair to receive nominations for the Office of Mayor and conduct the election. 3. Election of Vice Mayor - The Mayor-elect will conduct the election of Vice Mayor. 4. Town Council Comments - The Council may share any additional comments at this time. Mayor Fraser talked about what an honor it had been to serve as Mayor over the last year. He thanked the citizens of Tiburon for allowing him to serve on the Council. He commended the Town staff for always providing him with information enabling him to be well prepared. He thanked his colleagues for supporting him, noting that while they did not always agree, the Council had the ultimate respect and trust for each other. This attitude of "community first" made it a pleasure to serve, according to Fraser. The Council commended Mayor Fraser for his service, and especially for his leadership, his ability to act as a consensus-builder, and a gentleman. They noted his many accomplishments and his ability to weather controversies over the past year. Councilmember Fredericks spoke of his astute ability to review the municipal budget and ask questions that would make it more clear for the public. Mayor Sandra Donnell of Belvedere also commended Mayor Fraser and said what a pleasure it had been to work with him on project and committees over the past year. She presented him with a key to the City on behalf of the Belvedere Council. Councilmember Collins said he had served with Emmett on the Planning Commission, in addition to getting to know him over the past several years on the Council. He said he was well qualified to serve as Mayor. MOTION: To appoint Emmett O'Donnell as Mayor. Moved: Collins, Fredericks Vote: AYES: Unanimous In accepting the appointment, Mayor-elect O'Donnell thanked the Town staff, who he said received policy direction from the Council but were the ones who did "all the work". He also thanked his colleagues with whom he said he had the joy to spend time with over the last three years. He said they were all very smart and creative people and approached their job on the Council with great diligence. TOWN MANAGER'S REPORT Discussion of Meeting Recess (cancellation of December 19, 2012 regular meeting; January 2013 meeting schedule) The Council concurred with the Town Manager's recommendation to cancel the December 19 regular meeting as is tradition, as well as the January 2 meeting because, at this juncture, there were no items pending for the agenda. However, Curran noted that there are five weeks in January if the Council wished to hold a second meeting. The contributing factor to this increase was the first installment of property tax receipts that are normally received in December of each year. A notice is subsequently published in the Ark newspaper and posted at Town Hall and the Belvedere-Tiburon Library for the purpose of informing the public of these vacancies and to seek applicants to fill the positions. Commissioners whose terms are expiring in 2013 will be notified by the Town Clerk of their term expirations and asked whether they are interested in seeking reappointment. Due consideration will be given to incumbent commissioners, however, the Council is required to interview all new applicants, pursuant to Resolution No. 16-2007. An exception to this rule is for commissioners who have served terms of less than two years in duration; the Council is not required to interview new applicants for these pending vacancies, if the incumbent seeks reappointment to the position. Certain of these fees are categorized as "development fees" under Section 66000 et seq. of the California Government Code. Section 66006 of that code requires that specific data regarding development fees is made available to the public within 180 days following the end of each fiscal year, with a public meeting held on the matter at the next regularly scheduled meeting following release of the data. This report sets forth the required annual data reporting for the Town's development fee accounts for Fiscal Year 2011-2012, which closed on June 30, 2012. ANALYSIS The Town of Tiburon imposes four categories of fees that could qualify as development fees. These categories are 1) traffic impact fees 2) street impact fees 3) affordable housing in-lieu fees and 4) stormwater runoff fees. Park and recreation in-lieu fees, which the Town also collects, are not defined as development fees in the statute. Reporting data for each of the Town's development fee categories is shown below. Traffic Mitigation Funds Traffic mitigation fees have been collected by Town since at least 1980; the two current fee accounts were established in 1996, each addressing different portions of the Tiburon Planning Area. In March 2007, an updated Traffic Mitigation Fee Schedule based on projections from the Town's General Plan Tiburon 2020 went into effect. The Town Council received a mandatory five-year report on these funds in January 2012 and made findings regarding the future use of unexpended funds in these accounts; the next five-year review is scheduled for January 2017. The two traffic mitigation accounts and the required data for this annual report are as follows: Circulation System Improvement Fund (CSIF): This fund contains the collected exactions for construction of public traffic improvements in the incorporated portions of the Tiburon Planning Area. The fee varies depending on the location of the project in relation to intersections identified in the General Plan Circulation Element as requiring improvement. The fee varies from $0 per PM peak trip to $5,278 per PM peak trip. TIBURON CIRCULATION SYSTEM IMPROVEMENT FUND Fund Balance, July 1, 2011 Revenues: Fees Collected $5,603 Interest Income 123 TOTAL REVENUES Expenditures: $0 TOTAL EXPENDITURES Fund Balance, June 30, 2012 $28,054 $5,726 $33,780 In the adopted Fiscal Year 2012-13 budget, there are no expenditures identified from this account. Planning Area Mitigation Fund (PAMF): This fund contains the collected exactions for public traffic improvements in portions of the Tiburon Planning Area outside of the Town's corporate limits. The fee varies depending on the location of the project in relation to intersections identified in the General Plan Circulation Element for improvement. The fee varies from $0 per PM peak trip to $361 per PM peak trip. TIBURON PLANNING AREA MITIGATION FUND Fund Balance, July 1, 2011 $179,090 Revenues: Fees Collected $412 Interest Income $676 TOTAL REVENUES $1,088 Expenditures: $0 TOTAL EXPENDITURES $(0) Fund Balance, June 30, 2012 $180,178 The FY 2012-13 Town budget does not contain any expenditures from this account. Additional future projects to which these funds would be contributed include a merge/acceleration lane at the Tiburon Boulevard/Cecilia Way intersection and capacity improvements at the Tiburon Boulevard/Redwood Highway Frontage Road intersection. These improvements are set forth in the General Plan Circulation Element, but are likely to be at least five years away. The cost of these improvements will exceed funds available at this time. No inter-fund loans or transfers occurred in this account for FY2011-12 and no refunds from this account were issued in FY 2011-12. Street Impact Fund The street impact fee initially went into effect in July 1999. This fee partially off-sets the Town's costs of public roadway maintenance by assessing a fee of 1.0% (01) on the valuation of all building permits issued by the Town. A project with a $100,000 building permit valuation would therefore be subject to a street impact fee of $1,000. These improvements are expected to be completed in FY 2012-13. The Town maintains a Pavement Management Program (PMP), which analyzes the condition of the Town's streets and suggests appropriate repair/replacement techniques based on this analysis. In 2006, the Town embarked on an aggressive program to eliminate its "failed" street segments, which will be successfully completed at the conclusion of the Del Mar work. The Town's overall Pavement Condition Index (PCI) now stands at 73, up from a PCI of 66 in 2006. The PCI is expected to rise further when several streets in the Del Mar Undergrounding District Project area are resurfaced in the current fiscal year. No refunds or transfers were issued from this account in FY 2011-2012. The Town Council received a mandatory five-year report on these funds in January 2010; the next such report will be due in January, 2015. Affordable Housing In-Lieu Fund This fee is collected either at the subdivision map or building permit stage, at the option of the developer. Its revenues are used for the design and construction of permanently affordable housing units or for other actions that would directly preserve, conserve, rehabilitate, or increase the supply of affordable units in the Tiburon Planning Area. The fee is calculated using a formula contained within Title IV, Chapter 16 (Zoning) of the Tiburon Municipal Code. The formula contains several variables (such as interest rates) and the amount of the fee can vary over time depending on these variables. Generally, the in-lieu fee amount ranges from $425,000 to $475,000 for each required affordable unit that is not built, dependent upon prevailing interest rates and other variables at the time of calculation. A project creating 12 or more units or lots would be responsible to provide 20% affordable units or pay the resulting in-lieu fee. Projects that create 7 through 11 units would be responsible for providing 15% affordable units. Projects that create 2 through 6 new lots or units pay a prorated share of the in-lieu fee, for example, a 6- unit project would pay 0.9 of the in-lieu fee for an affordable unit not built. It is unclear whether affordable housing in-lieu fees are a "development fee" as defined in state law; however, the following information is public record. For FY 2012-13 the Town has $24,725 in expenditures planned from the Affordable Housing In- Lieu Fund, primarily for Marin Housing Authority-related services and an annual contribution to the Homeward Bound program for homeless persons. Several affordable housing sites are identified in the Housing Element of the Tiburon General Plan, and as developers move forward with actual projects, the housing in-lieu funds collected will be expended toward affordable housing projects. The project was posted and advertised as required by the State of California's Public Contract Code. In addition to the required advertising notice, the Town sent notices inviting bids to construction trade publication plan rooms, and bids were opened on August 25, 2011. The contract was awarded to Bay Pacific Pipelines, Inc. on September 7, 2011 in the amount of $1,986,899.70, plus 15 percent for contingencies. Work consisted of the main utility joint trench construction, new facilities to replace overhead utility lines, service connection box installation within the right-of-way, minor paving, pavement re-striping, and appurtenant work. On September 19, 2012, Council had moved to amend the project budget by up to $290,065 to address unanticipated project costs, bringing the project budget including contingencies to $2,575,000. The work was substantially completed on November 1, 2012, and included 12 change orders for unforeseen items. Based on the work performed, material actually installed, and total change orders, the final construction project cost is $2,528,166.43, delivering the construction project within the amended project budget. This juncture of the project represents the completion of the Town-managed joint utility trench installation. It also represents the beginning of work for the three utility companies who have either started or have committed to start their wire installation work this January. In 2012, a central portion of the easement was slightly re-aligned to provide a more easily traversable path and the pathway was installed. During the final stages of construction, TPC identified and created a superior alignment for the final 35 feet or so of the easement that would keep trail users out of its parking lot area and connect them to Mar West Street more quickly and directly. TPC (with Town staff approval) subsequently installed the final improvements associated with the minor realignment, and is now offering that realigned portion to the Town as an easement for public access purposes. The unused portion of the earlier through the TPC parking lot would be abandoned. The Town Attorney has reviewed the draft easement documents and found them acceptable. Town staff finds the minor realignment of the easement to be superior to the original alignment. The improvements are in place and the easement is open to public use. FINANCIAL IMPACT Staff foresees no financial impact to the Town from acceptance of this minor realignment. RECOMMENDATION Staff recommends that the Town Council adopt the Resolutions. EXHIBITS 1. XX-2013 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON ACCEPTING A RELOCATED PORTION OF AN EASEMENT FOR PUBLIC RECREATIONAL ACCESS PURPOSES OVER PROPERTY LOCATED AT 1600 MAR WEST STREET (ASSESSOR PARCEL NUMBERS 058-171-17 AND 058-171-76) WHEREAS, in February 2005 the Town of Tiburon Planning Commission adopted Resolution No. 2005-02 approving a conditional use permit authorizing the expansion and renovation of the Tiburon Peninsula Club private recreational facilities located at 1600 Mar West Street. Condition No. 10 of Resolution No. 2005-02 required the conveyance of an easement for public access purposes across a portion of the Tiburon Peninsula Club property; and WHEREAS, on June 8, 2006, the Town of Tiburon and the Tiburon Peninsula Club entered into an Easement Agreement establishing, among other things, the general alignment of the easement and timing of offer and acceptance, said Easement Agreement being recorded as serial number 2006-0036668 in the Official Records of Marin County; and WHEREAS, pursuant to the terms of the Easement Agreement, the Tiburon Peninsula Club offered the grant of public recreational access easement, executed on May 2% 2007, to the Town of Tiburon for acceptance, and said easement ("2007 Easement") was accepted June 6, 2007 by adoption of Resolution No. 24-2007 and recorded on June 21, 2007 as Serial Number 2007-0038631 of Official Records of the County of Marin; and WHEREAS, in March 2012, the Town Council concluded that a realignment of a portion of the easement would provide a more easily traversable pathway, and the property owner (Tiburon Peninsula Club) consented to the realignment and offered a new grant of easement ("2012 Easement") for the realignment, which was accepted on March 7, 2012 and recorded on March 16, 2012 as Serial Number 2012-0016714; at that same time the Town Council abandoned the prior 2007 easement alignment by Serial Number 2012-0016713; and WHEREAS, the Tiburon Peninsula Club has indicated its desire to relocate and replace a portion of the 2012 Easement (near its northern terminus at Mar West Street) with a realigned easement portion, and has prepared the necessary survey and documentation, offered the grant of easement to the Town for public acceptance, and installed the necessary improvements to make the realigned portion of the easement acceptable for public use; and 1 Tiburon Town Council Resolution No. XX-2013 --1--12013 NATO. WHEREAS, the Town Council has reviewed and found acceptable, and to the public benefit, the realigned easement portion being offered for acceptance by the Tiburon Peninsula Club for public access purposes; and WHEREAS, the Town Council has concluded that the realigned easement portion is not located in an environmentally sensitive area and that the acceptance of the relocated easement is exempt from the requirements of the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon Town of Tiburon hereby accepts the grant of easement, authorizes the Town Manager to execute the Grant of Easement and Agreement, a form of which is attached hereto as Exhibit 1, and directs the Town Clerk to record it with the Office of the Marin County Recorder together with a certified copy of this Resolution. In 2012, Grantee's staff determined realignment of the recorded easement would provide a more easily traversable pathway. Grantor and Grantee therefore entered into a Grant of Easement and Agreement to implement the easement realignment, said document being recorded on March 16, 2012 as serial number 2012-0016714 of Marin County Records. 5. Grantor is now requesting a realignment of the final segment of the easement at its northern terminus at Mar West Street in order to provide a more direct route to Mar West Street and to avoid potential pedestrian/vehicular conflicts in the Tiburon Peninsula Club parking area. Grantor would convey a new six (6) foot wide easement ("2013 Grant") to accommodate the realignment of the northernmost easement segment on the condition that the Grantee abandons the segment of the 2012 easement alignment that would be replaced by the 2013 Grant. Grantee has agreed to abandon aforementioned 2012 easement segment. NOW, THEREFORE, the parties agree as follows: 1. Grant: For valuable consideration, Grantor hereby grant to Grantee an easement as hereinafter-described ("Easement"). 2. Description and Use of Easement: The Easement is for the purpose of a pedestrian recrdational trail ("Trail") connecting Mar West Street, a public street, to the Dominant Tenement across the Servient Tenement. 3. Location: The location of the Easement is described on Exhibit "C" and graphically depicted on Exhibit "D". 4. Character of Easement; Grantor's responsibilities: The Easement shall be appurtenant to the Dominant Tenement. Notwithstanding the foregoing, the Grantor shall not be responsible for maintaining the Trail. Upon request by Grantor and with reasonable notice, Grantee will provide Grantor access through and over the easement when necessary for repairs and/or maintenance of facilities, including but not limited to tennis courts and drainage facilities. 5. Secondary Easements: The Easement includes incidental rights of maintenance, repair, and replacement of the Trail, including, without limitation, the right to go upon Grantor's property with necessary equipment to enhance, maintain and repair the Trail. 6. Indemnification: Grantee shall hold harmless, indemnify and defend Grantors from any claim, lawsuit or liability involving the construction of the Trail or its subsequent use by the public. 7. Entire Agreement: This instrument contains the entire agreement between the parties relating to the rights herein granted and the obligations herein assumed. Any oral representations or modifications concerning this instrument shall be of no force and effect excepting a subsequent modification in writing, signed by the party to be charged. 8. These programs are entirely voluntary and have resulted in thousands of guns being safely taken out of circulation. The attached press release from Supervisor Kate Sears describes a buy-back program underway in Marin County, which was spearheaded by District Attorney Ed Berberian. The County Board of Supervisors has provided $10,000 for the program, the Marin Community Foundation another $20,000, and various other donors have contributed as well. Mayor O'Donnell asked that the question of financial participation by Tiburon be placed on the Town Council agenda. FINANCIAL IMPACT If the Town Council wishes to take action to join the gun buy-back program, staff recommends a contribution of $1,000. RECOMMENDATION Staff recommends that the Town Council consider financial participation in the Marin County gun buy-back program. January 15, 2013, was selected as the primary date to mark our commitment to curbing the viol, has plagued our streets and invaded our schools. This is an opportunity for individual members community to take a positive step that demonstrates our commitment to non-violence. January day our nation honors Dr. Martin Luther King, Jr., and the act of surrendering firearms is consist( King's teachings. I hope that this is a galvanizing force for broad-based community action to reds violence. 1/10/2013 Gun Buy-Back Program individuals surrendering operable semi-automatic handguns and/or semi-automatic long guns will receive $200 for each firearm. Any individual surrendering any other category of an operable firearm will receive $100 for each firearm. This is a "no questions asked" program, however documentation showing the person surrendering the firearm is a resident of Marin, San Francisco, Contra Costa or Sonoma County will be required strictly for verification purposes only and no police investigative report will be opened or generated. The five firearm surrender locations on January 15th will be: 1) Novato: the Novato Police Department, 909 Machin Avenue; 2) San Rafael: the San Rafael Police Department, 1400 Fifth Avenue; 3) Larkspur: Central Marin Police Authority, 250 Doherty Drive; 4) Marin City: St. Andrew's Church, 101 Donahue; and 5) Pt. Reyes: the Pt. Reyes Substation of the Marin County Sheriff's Office, 101 Fourth Street The hours of operation will be from 11:00 A.M. to 8:00 P.M. No ammunition should be in any of these firearms when they are brought to the surrender locations. A second surrender date has been scheduled for January 21, 2013, at the Mill Valley Police Department, 1 Hamilton Drive, Mill Valley, and the San Rafael Police Department. Again the hours of operation will be from 11:00 A.M. to 8:00 P.M. I am particularly grateful to Pastor Veronica Goines and the Congregation of St. Andrews Presbyterian Church in Marin City for hosting this on the 15th, the Mill Valley City Council and MV Police Chief Angel Bernal for offering to host this on the 21St and to and all of the community leaders throughout Southern Marin and the County for their efforts. All funding for the program has been generated locally. The County Board of Supervisors has committed $10,000, the Marin Community Foundation from two of its administered trusts have contributed an additional $20,000, and individuals from the greater community have contributed an additional $10,000 to support this effort. At one level, this is all about guns - access to guns and the ever-increasing firepower of guns. It is also about our values. Gail Collins, in a recent column in the New York Times, had this to say: "America needs to tackle gun violence because we need to redefine who we are. We have come to regard ourselves - and the world has come to regard us - as a country that's so gun happy that the right to traffic freely in the most obscene quantities of weapons is regarded as far more precious than an American's right to health care or a good education. We have to make ourselves better." It is time to take action, to make ourselves better by taking better care of each other. But we cannot stop there. I urge our Board to support legislation that bans assault weapons and multi-bullet clips. I also hope that we will commit to support enhanced mental health training and wrap-around services for troubled youth and their families. The revisions are a mixture of fees for permit types not previously existing, updates of state and county-imposed fees, and changes to reflect new state law. The Community Development Fee Schedule was last updated in January 2012 and the Public Works Department Fee Schedule was last revised in 2008. ANALYSIS Summary of Fee Schedule Revisions The proposed revisions to the fee schedules are shown in strike-through/double-underline format in the Draft Fee Schedule Resolution, attached as Exhibits 1 and 2. Revisions are summarized below, with page references in parentheses following each revision. The revisions would: ➢ Create separate line items for "Temporary Use Permit" (p. 2), "Reasonable Accommodation Request" (p. 2), and "Flood Regulations Variance" (DPW Schedule). The first two are new permit types and the third has never been applied for in the past and no fee has ever been established. ➢ Reflect increased State Department of Fish & Game fees or County Clerk processing fees for review and processing of CEQA documents; these are state- or county-imposed pass- through fees over which the Town has no control (p. 4). ➢ Reflect the addition to the schedule of the $25 posting fee for banners that are hung by the Public Works Department at the Blackie's Pasture and Blackfield Drive signs (p. 5). This is not a new fee. ➢ Correct an error in the prior fee schedule regarding RBR inspection fees. The prior schedule inadvertently omitted the standard $75 additional unit charge when more than a single-family residence is being inspected. The fee for the first unit remains $250 (p. 8). ➢ Relocates the "Other Inspections" section from pp. 12-13 to p. 9. No new fees or increased fees result (p. 9 and pp. 12-13). ➢ Reflects the state-imposed Seismic Tax, also known as the strong motion fee. These fees are required to be collected by the Town and forwarded to the State of California (p. 9). ➢ Modifies roof-top solar system building permit fees to comply with provisions of SB 1222, which essentially capped fees for these systems to $500 for residential and $1,000 for commercial. The Town would continue to waive these fees for roof-mounted systems that met the Town's criteria set forth by Resolution No. 13-2011. Staff believes that all of the above are minor changes and/or corrections to the fee schedule. There are no increases in building permit fees based on project valuation and no increases to hourly rate schedules. RECOMMENDATION Staff recommends that the Town Council: 1. XX-2013 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON ADOPTING A REVISED FEE SCHEDULE FOR THE COMMUNITY DEVELOPMENT DEPARTMENT AND MICELLANEOUS SERVICES PROVIDED BY OTHER TOWN DEPARTMENTS WHEREAS, the Tiburon Municipal Code requires that any changes to the Community Development Department's filing and processing fees be set forth by Resolution of the Town Council, and WHEREAS, it is the intent of the Town Council that such fees be used to reimburse the Town for the costs of providing the services for which the fees are assessed, thereby maintaining productive and efficient service levels commensurate with the work demands within the Community Development Department, and WHEREAS, from time to time it is necessary to revise fees to reflect actual costs incurred by the Community Development Department and/or other Departments in the normal course of its operation and according to its obligations to administer State statutory requirements under the authority of Town ordinances, and WHEREAS, the Town of Tiburon has provided required notice and held a public hearing pursuant to state law and local ordinances. Fees shall be submitted in full at the time of application submittal to the Town. A penalty fine equal to 100% of the regular filing fee is assessed for after-the-fact permit applications. B. Pursuant to a written request, the Town Council may grant a full or partial waiver of fees pursuant to applicable fee waiver policies adopted by Resolution of the Town Council. C. Portions of fees may be refunded upon withdrawal of an application; the amount of the refund shall be determined by the Director based upon the amount of work performed and costs incurred by the Town prior to withdrawal. D. Full fee credits may be granted by the Director toward resubmitted applications if withdrawn and resubmitted within 60 days from the date of withdrawal. E. Where work requires more than one permit, the full fee shall be collected for each and every permit required. F. XX-2013 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON ADOPTING A REVISED FEE SCHEDULE FOR THE TOWN ENGINEER AND PUBLIC WORKS DEPARTMENT WHEREAS, the Tiburon Municipal Code requires that any changes to the Town's filing and processing fees be set forth by Resolution of the Town Council, and WHEREAS, it is the intent of the Town Council that such fees be used to reimburse the Town for the costs of providing the services for which the fees are assessed, thereby maintaining productive and efficient service levels commensurate with the work demands within the Town's various departments, and WHEREAS, from time to time it is necessary to revise these fees to reflect actual costs incurred by the various departments in the normal course of its operation and according to its obligations to administer State statutory requirements under the authority of Town ordinances, and WHEREAS, the Town of Tiburon has provided required notice and held a public hearing pursuant to state law and local ordinances.
