Subject: Right of Entryfor Work on Chazen Property, APN 039-031-29
Permission is hereby granted to the Town of Tiburon, its agents, employees, contractors or assigns,
hereinafter referred to as "Town", by Donna L. Chazen, hereinafter referred to as "Owner", to enter
upon our lands, as shown on the attached exhibit, for the purposes of applying a slurry seal to the
existing driveway on our property.
The work shall be performed on weekdays only between the hours of 8:00 a.m. and 5:00 p.m.
Any authorized agent or contractor of the Town may, at the option of the Town, exercise the rights
and privileges hereby granted to Town.
By acceptance of this Temporary Right of Entry, it is expressly understood and agreed by and
between the parties that Town agrees to indemnify and save the undersigned Owner against any and
all loss, damage, and/or liability which may be suffered or incurred by Owner and against any and all
claims, demands, and causes of action that maybe brought against Owner caused by, or arising out
of, or in any way connected with the use and/or occupancy of said lands of Owner by Town, its
agents, employees, contractors or assigns except liability arising out of the sole negligence or
intentional actions of Owner.
