The Town of Tiburon is in receipt of Marin LAFCO's referral documents on the
above-referenced application.
The Tiburon Town Council recently prezoned the SODA parcel, certified an
environmental impact report for its prezoning and development, and approved a
Precise Development Plan for the property. The Town of Tiburon anticipates and
supports the annexation of this property to the Town.

The attached form is for your use. An explanation of its purpose follows:
Waiver of Conducting Authority
The above proposal was recently transmitted to you for review. Government
Code Section 56663 (c & d) states protest proceedings may be waived if the
proposal has 100% property owner consent and all affected local agencies that
will gain/ lose territory as a result of the change of organization or reorganization
have consented in writing to a waiver of conducting authority proceedings. The
attached form may be used to signify your consent.
Consent for Boundary Change
As referenced in the Cortese-Knox-Hertzberg Act of 2000, Section 56857 (a), the
district gaining territory may adopt a resolution requesting termination of the
proceedings. If the resolution is transmitted to the Commission within 60 days
of the proposal appearing on the Commission's agenda [for information only],
the Commission will terminate the proceedings. Your agency may show consent
for the boundary change with the attached form to allow LAFCO to proceed with
the application before the expiration of the 60 days.
Please return the attached consent form by January 18, 2013 to allow the waiver of
public hearing and or/ consideration of the application prior to the 60 days required to
allow for possible adoption of a resolution requesting termination of proceedings.

On behalf of the Town of Tiburon, I am filing the attached claim to recover
excessive Property Tax Administrative Fees that the County assessed against the
Town and which the Town paid and supporting documentation. Please note that
pursuant to County ordinance, the attached claim references only overpayments
during the past year. However, we do not believe that the County's claiming
ordinance applies to the County's over-assessments. Accordingly, the Town
further demands repayment of all overcharges since January 1, 2006.

Floor Area Exception. The applicants propose to construct additional floor area and a
new garage. The proposal would result in lot coverage of 3,560 square feet (24.5%),
which exceeds the maximum permitted lot coverage in the RO-2 zone (15.0%). A portion
of the additions would extend to within 14 feet, 7 inches of the rear property line, which
is less than the 25 foot rear yard setback in the RO-2 zone. The proposal would result in a
gross floor area of 3,551 square feet, which exceeds the maximum floor area ratio for the

a Floor Area Exception. The applicants propose to construct a new 2,400 square foot
parking garage that would occupy a portion of an existing tennis court. The project would
increase the lot coverage on the site by 2,400 square feet to 10,837 square feet (13.9%).
The project would increase the floor area of the property by 2,400 square feet to 8,920
square feet, which would exceed the floor area ratio for a lot of this size by 920 square
