I have been a resident of Tiburon for 11 plus years and an or at least was, a
frequent user (walking) of the multi-use path Like others, I have become concerned
about my safety on the path in the recent years, and at this time.
There appears to be a lot more bikes on the path than there were a decade ago. This
is especially true on weekends. And it seems, at least to this writer, that many of the
weekend cyclists are quite inexperienced.
The main danger is that they are silent, and are not noticed until they come
alongside. When I first came here many, if not most of the cyclists called out "On
your left" as they approached you from behind. It would be nice if something like
this form of courtesy notice could be reinstituted.
The main problem I have noticed is the tendency of bikers to not pass in a single file,
but stay abreast of each other as they pass slower moving non -cyclists, seemingly
on the rationale that such is necessary to continue their conversations.. This causes
all to be in close proximity and leaves little margin for error. On two occasions I
have had two bikes abreast on my left side and a third on my right, so as not to
interrupt their conversations and the Macedonian Phalanx positions. In one of the
two instances I was scraped by the bike or the arms of the rider on my left, and on
other occasion on both sides. (There was no hard contact, and I was not hurt,
perhaps just lucky.) Single file passing would be a great safety improvement.

I, Mrs. Pamela McConnell-Douglass have always taken part in so
many Town Meetings/ Functions/Get Together's. Deirdre and
other's from the Ark has never printed my Point of Views in
Writing!!!
It's been too many years, of fighting for Freedom/Positive Action
and dealing with HATE.
The Hilarita Apts., on Ned's Way, needs major contruction on
Tiburon Blvd., IMMEDIATE TRAFFIC CONTROL and the
proper Landscrape, like Stewart Dr., and etc. No one hardly
walks across Tiburon Blvd. in that area. Why did the Town, put
in State of the Arts Traffic Equipment there?? The Town and
the Engineer is not looking * the entire picture regarding where,
they should do the necessary work 1st. The focus should be on
Ned's way - hundreds of families use Tiburon Blvd.,
everyday, including the families from Belvedere/Mill Valley and
etc. The driver's do not care how they drop their children off. It
is extremely CRAZY/A MAD HOUSE. No Respect for the
pederstrians and cars, trying to get home to Ned's Way.
The Hilarita has the most amount of families of diverse
backgrounds in Tiburon/Belvere. We should have a well known

PLAQUE representing the Shipyard Worker's of the 1940's and
to the present time! We should count and not be invisible
anymore!The families came from many cities and lived * the
Hilarita and Marin City during WWII, to help keep America free
from the enemies during War time. I discussed this matter with a
number of Town's people, and they said that, they had up a
proper PLAQUE for Ned's Way. That is not true!! And, they
wanted me to come up with thousands of dollars. Other people
get donations from various avenues.
Also, why did the Black Jockey's disappear on Ark Row, they
represented the History of Tiburon/Belvedere. Rev. Jerry Butler
of Ned's Way, made sure of that!!!
I have put in 30+ years in my Town with many important/Great
Issues/Ideas. I have been put aside, as if I am INVISIBLE
because some people think that, I am not Important!!!! It is not
Fair. I am out to save Lives and to make a Great Difference in
this area. That is not the AMERICAN WAY we do things in this
Country. I have worn so many Great Hats, but the new people
the Ark, is not listening to me. Especially, Deirdre.
I am also Very Important as a Human Being of
Tiburon/Belvedere/Mill Valley, CA. I have risked my life many
of times. Helping the General Public cross Highway 31 in a Safe
Manner, rescued children/people/animals. And taken sick people
and children to hospitals. I have always been very Thankful
and Loyal to my Community. But, it seems that some people do
not Care for my presence - after 30+ years. I have always been a
Proud individual with lots of LOVE for ALL.
I graduated from Tamalpais high school with high honors,
Graduated from the University of Hawaii also with high honors
and made the dean's list several times. I modeled most of my
life. I worked for major corporations in the financial district as

well as Implemented many programs for the various
communities for the American National Red Cross and other
Community Services and received tons of certificates for my
work.
It is so nas and so unprofessional, that no one will hire me with
my talents and skills - so I can get benefits for my family to
survive in the United States of America. People from around the
World obtain tons of jobs and benefits every day!! How come, I
am being REJECTED. It is not FAIR in 2013. I can do any job,
if given a FAIR OPPORTUNITY.
Yes, I do communicate on a different level! I have been
Bullied/Abused/and taken advantaged of by many trust worthy
individual's. I have all of my Peace, Love, and Warmth in this
SOCIETY. My husband and my children plus great friends are
my LIFE!!!

I am writing to urge you to discuss with your respective councils the sale of
Morin County Civic Center harmful rodenticides, which are potentially hazardous to children, pets and

www.marincounty.org/bos In 2012 the Marin County Board of Supervisors adopted a resolution urging
all businesses within unincorporated Marin to voluntarily stop selling a
number of these most toxic rodenticides. Additionally, we reached out
through a mailing to businesses such as nurseries and hardware stores,
urging them to take these products off their shelves. Since most of the
businesses which sell rodenticides exist within the cities, versus
unincorporated Marin, I am writing to encourage your city to consider taking
similar actions.
I have attached a copy of the resolution, which received strong support from
environmental organizations. Many cities across California have adopted
similar resolutions. Also attached is a sample of a letter that was sent to
Marin businesses, explaining the issues, urging termination of sale of the
most dangerous rodenticides, and providing information about alternatives.
The leadership of your town/city in sending a similar letter, encouraging
businesses to stop selling these most harmful rodenticides, will be very
PG. 2 OF 2 helpful and consistent with the environmental leadership for which Marin is
recognized.
It is important to note that in addition to the resolution, in 2012 Marin County
joined many cities in sending a letter to the EPA encouraging the de-listing of
the most dangerous rodenticides. In late January of 2013, the US EPA
revised safety standards and licensing requirements, effectively implementing
our recommendations. Several companies have complied and removed their
second generation rodenticides from the market, however, Benckiser Inc., the
largest manufacturer and maker of D-Con, Fleeject, and Mimas rodent control
products, has initiated a legal challenge against the EPA. These products are
still being sold. While it is no longer necessary to send a letter to the EPA,
informing businesses and communities about the sale and use of second
generation rodenticides remains important and timely.
If your Council would like to consider a resolution and mailing, my office
would be happy assist by answering questions and providing an electronic

RESOLUTION OF THE MARIN COUNTY BOARD OF-SUPERVISORS
OPPOSING SALE AND PURCHASE OF RAT AND MOUSE POISONS DEEMED AN
UNREASONABLE RISK TO CHILDREN, PETS AND WILDLIFE
WHEREAS, in 1998, the United States Environmental Protection Agency (US EPA)
issued its Registration Eligibility Decisions (REDs) for rodenticides, and expressed concern
about accidental human exposures to rodenticides as well as risks to wildlife; and
WHEREAS, in September 2004, the US EPA released its Revised Comparative
Ecological Assessment for nine Rodenticides, which found more than 300 documented wildlife
incidents of exposure of birds and nontarget mammals, including endangered species, to
rodenticides, in particular those rodenticides that contain the ingredient brodifacoum; and
WHEREAS, brodifacoum residue has been detected in liver tissue of 27 of 32
endangered kit foxes screened for rodenticide residues from 1999 to 2003; and
WHEREAS, the Americans Association of Poison Control Centers annually receives
between 12,000 and 15,000 reports of children under the age of six being exposed to the types
of products; and
WHEREAS, in 2008, the US EPA issued its Final Risk Mitigation Decision for Ten
Rodenticides, and gave producers until June 2011 to research, develop and register new
products that would be safer for children, pets and wildlife; and
WHEREAS, several companies have recently advised US EPA that they do no intend
to adopt the new safety measure stipulated in the Final Risk Mitigation Decision, these
companies include Reckitt Benckiser Inc. (makers of D-Con, Fleeject, and Mimas rodent control
products), Spectrum Group (makers of Hot Shot .rodent control products), and Liphatech Inc.
(makers of Generation, Maki, and Rozol rodent control products; and
WHEREAS, as a result of the above companies' actions, many of the products that the
US EPA considers to pose an unacceptable risk'to children, pet and wildlife are still being sold
to Marin County residents.
. NOW THEREFORE, BE IT RESOLVED that the Marin County Board of Supervisors
urges Marin County businesses to stop the sale of rat and mouse poisons that would be
prohibited under the US EPA's Risk Mitigation Decisions for Ten Rodenticides.
BE IT FURTHER RESOLVED that the Marin County Board of Supervisors urges Marin
County residents to avoid buying the above products, and to use less-toxic rodent control
methods.
BE IT FURTHER RESOLVED that the Marin County Board of Supervisors urges that
all manufacturers of rat and mouse poison immediately stop manufacture and sale of rat and
mouse poisons that do not incorporate the safety measure specified in the US EPA's Risk
Mitigation Decisions for Ten Rodenticides.

California Department of Pesticides Regulation to cancel or refuse to renew registration of the
above products.

Subject: Removing unsafe rodenticides (rat poisons) from retail stores
Dear Sirs or Mams;
The County of Marin is calling on business owners to voluntarily discontinue potentially harmful
mouse and rat poisons to protect the public, pets and wildlife from exposure to these poisons.
The County is requesting that merchants take these products off their shelves and send them back
to the manufacturers that have not adopted EPA's new safety measures.
The US Environmental Protection Agency (EPA) has determined that many common rat and
mouse poison products pose unreasonable risks to children, pets and non-target wildlife.
Children are particularly at risk for exposure to rat and mouse poisons because the products are
typically placed on floors, and because young children sometimes place pellets in their mouths.
The American Association of Poison Control Center annually receives between 12,000 and
15,000 reports of children under the age of six being exposed to these types of products.
In 2008, EPA gave producers of rat and mouse poison until June 4, 2011 to research, develop
and register new products that would be safer for children, pets and wildlife. Over the past three
years, EPA has worked with a number of companies to achieve that goal, and there are now new
products on the market with new bait delivery systems and less toxic baits. These products are
safer to children, as well as pets and wildlife, but still provide effective rodent control for
residential consumers. A list of these reduced risk rodenticide products is included in this
packet.
While many companies that produce rat and mouse poison products have agreed to adopt the
new safety measures, a handful of companies have advised EPA that they do not plan to do so.
Consequently, EPA intends to initiate cancellation proceedings under the Federal Insecticide,
Fungicide and Rodenticide Act, the federal pesticide law, against certain non-compliant products
marketed by the following companies to remove them from the market:
Reckitt Benckiser Inc. (makers of D-Con, Fleeject, and Mimas rodent control products)
A list of rodenticide products that pose an unacceptable risk is included in this packet.
In addition to requiring more protective bait stations and prohibiting pellet formulations, EPA
intends to ban the sale and distribution of rodenticide products containing brodifacoum,
bromadiolone, difethialone and difenacoum directly to residential consumers because of their
toxicity and the secondary poisoning hazards to wildlife.
Basically we are asking businesses to not sell:
• Rodenticide products sold as pellets
• Rodenticide products containing brodifacoum, bromadiolone, difethialone and
difenacoum
• Rodenticide products that are not packaged with bait stations
The County will encourage the public to use the lower risk rodenticide products since these
products, when used as directed on the label, can help consumers control household rodent
populations while greatly reducing accidental exposure to children, pets and wildlife.
The County will also encourage the public to employ a variety of non-chemical measures to
control rodent populations, such as sealing holes in structures to prevent entry by rodents,
keeping areas clean and free of food sources, and using safely placed snap traps.
The County of Marin requests your cooperation in this community effort. As a Marin Green
Business, you are a demonstrated leader in our County for operating your business in an efficient
and less toxic manner whenever possible. This is an excellent opportunity to help educate your
customers on a less toxic way to manage pests while continuing to show your exceptional
environmental commitment to the community.

EPA believes the 12 D-Con products in the table below cause unreasonable adverse effects on
the environment and the agency is canceling these products to remove them from the consumer
market. Until EPA completes the administrative cancellation procedures required by law (FIFRA
section 6(b)), these products may be legally sold and used according to the terms, conditions, and
instructions of their most recent agency approved labels. However, we encourage retailers to
stock and consumers to use only those products that meet EPA's safety standard.

New, More Protective Mouse and Rat Poison Bait Station Products
EPA encourages consumers with children and pets and those needing to use mouse and rat
poisons outdoors to use only mouse and rat poison products that have adopted the additional
safety measures the agency has determined will better protect children, pets, and non-target
wildlife from accidental exposure, and to carefully read and follow label directions and
precautions. Use a tamper-resistant bait station when applying mouse and rat poisons inside
homes with children or pets and when using these poisons outdoors.

TIBURON DESIGN REVEW BOARD
MEETING OF FEBRUARY 7, 2013
The meeting was opened at 7:00 p.m. by Chair Emberson.
A. ROLL CALL

B. PUBLIC COMMENTS - None
C. STAFF BRIEFING
Planning Manager Watrous announced that the item for 2308 Mar East Street was continued to
the March 7, 2013 meeting. He also announced that Associate Planner Laurie Tyler has accepted
a position with the city of Bellevue, Washington and will be leaving her position with the Town
of Tiburon. Greg Johnson has also indicated this was his last meeting with the DRB, and
Planning Manager Watrous thanked him for his service to the Town.
D. PUBLIC HEARINGS AND NEW BUSINESS
1. 2308 MAR EAST STREET: File No. 21220; Mar East Realty LLC, Owner; Site Plan
and Architectural Review for construction of additions to an existing single-family
dwelling, with a Variance for excess lot coverage and a Floor Area Exception. The
applicants propose to construct several additions and expand existing decks to the side
and rear of the existing building. The additions would cover 71.1 % of the dry land area of
the lot, in lieu of the maximum 35.0% lot coverage permitted in the R-2 zone. The project
would result in a total floor area of 2,809 square feet, which would exceed the floor area
ratio of 615 square feet for a lot of this size. Assessor's Parcel No. 034-271-03.

2. 1 BLACKFIELD DRIVE: File No. 712143; The Cove Shopping Center, Inc, Owner;
Site Plan and Architectural Review for construction of exterior alterations to an existing
commercial building for occupancy by a grocery store (Paradise Foods). The project
would expand the existing store by 955 square feet, modify the existing entrance and
loading docks of the building, install additional rooftop mechanical equipment for the
new grocery store and install a utility pole. Assessor's Parcel No. 034-212-18.
The applicant is requesting Design Review approval for the construction of exterior alterations to
an existing commercial building for occupancy by a new grocery store (Paradise Foods) on

property located in the Cove Shopping Center at 1 Blackfield Drive. The following
improvements would be constructed as part of this application:
• A 25 square foot addition would be constructed at the front of the building and a
130 square foot addition would be located at the rear. The store would also
expand into 800 square feet of vacant retail space to the south.
The entry would be modified with a new entrance at the center of the building,
eliminating the two existing entrances on either side of the center of the building.
A set of stairs and a new handicapped accessible ramp would lead to the new
entrance, and the two existing ramps would be removed. An existing awning
above the entrance would be removed.
• The existing loading docks and an existing refrigeration machine room on the rear
of the building would be removed and replaced with new ramps, along with a new
trash compactor and electrical transformer.
Six (6) new pieces of mechanical equipment would be installed on the rooftop.
A new 48 foot tall utility power pole would be installed along the eastern side
property line between two existing utility poles.
Timothy Shell, architect, thanked Planning Manager Watrous for his assistance throughout the
process and reviewed the project description. He described the location of the proposed addition
and entrance modifications. He showed two drawings comparing the existing and proposed
improvements on the side and rear of the building. He said that they plan to remove the existing
truck docks and construct one single raised concrete truck dock on the side and a 130 square foot
building addition and a shared delivery exit ramp on the rear.
Mr. Sheil described the proposed rooftop equipment for the building, stating that the existing
small mechanical equipment items would be removed and a new air cooling refrigeration unit,
three exhaust fans and an air conditioning unit would be installed. He said that the plan showed
a fourth exhaust fan, but they figured out a way to eliminate that fan. He said that the equipment
facing neighboring residences would be screened by raised walls. He said that they would also
add nine (9) skylights to provide natural light into the building.
He discussed the proposed power pole, stating that currently power is brought into the store by
an existing power pole and the overhead lines run all the way from Tiburon Boulevard to the
homes behind the store. He said that they propose to place an intermediate pole to run their
service from that pole underground to the electrical transformer. He said that they located the
pole to an area where they felt it would provide the least visual impact to the residential
neighbors. He said that PG&E told them that they could set a story pole to show the location of
the power pole.
He pointed out some additional items on the site plan, including additional accessible parking
stalls and four bicycle racks to provide capability for eight bicycles. He said that the color and

materials would be almost identical to the other Paradise Foods stores in Corte Madera and
Novato, and he pointed out that the colors would nicely complement the existing stores in the
shopping center.
Boardmember Chong asked about the trash compactor and decibel levels. Mr. Sheil said that
they did not include an enclosure around the trash compactor because that corner of the store
provides both truck delivery and emergency vehicle access and they need to be sure they do not
impact emergency vehicular traffic. He was unsure whether an enclosure would provide any
noise reduction.
Boardmember Chong asked if the truck circulation would be the same as it had been, and Mr.
Sheil confirmed that it would be the same.
Deborah Jue, Wilson Inrig Associates, acoustical consultant, said that the noise level from the
trash compactor would be 64 decibels. She said that the compactor would be run two to four
times a day and usually within operating hours. She said that the distance to the nearest property
line is 18-20 feet. She said that a nonnal speaking voice is about 60 decibels, and the trash
compactor would not be much louder than that.
Chair Emberson asked about the condensing unit. Ms. Jue said that the 12 fans on the roof would
have variable speed drives and the manufacturer's data indicates that the fans operate at 72
decibels at full speed. She said that the fans might operate at 50% speed when it is cooler at
night. She said that the noise levels about 35 feet from the condenser at the property line would
be about 61 decibels without the screening wall, and at nighttime, it would be about 46 decibels.
With the enclosure, she said that the noise level during the day would be about 31 decibels and at
night about 32 decibels.
Boardmember Chong asked if they looked at different trash compactors. Ms. Jue said that they
looked at a Marathon compactor and one other compactor of comparable size.
Boardmember Kricensky asked and confirmed with Ms. Sheil that the two different delivery
areas are for larger trucks and for smaller, bread delivery-type trucks. Boardmember Kricensky
said he was concerned about the color of the screening wall on the back of the building, as
lighter colors would reflect more light. He suggested making the wall the same color as the roof.
Mr. Sheil understood the concern, but showed a photograph taken on the property and pointed
out that the roof cannot be seen when standing directly behind the building. He said that their
reasoning in designing the parapets was to match the wall and not the roof, but they were open to
changing the color to match the roof. Boardmember Kricensky agreed that the closer one gets to
the structure the less of the roof can be seen. Mr. Sheil said that their objective was to try to
make the walls disappear and if the color would disappear better by painting them to match the
roof then they were willing to do that.
Vice-Chair Johnson asked whether having equipment on the roof change their noise levels
compared to having them on the ground. Ms. Jue said that sound on a hard surface would radiate
and any sound that goes down will bounce back up. She said that if the fans are up high, any
barrier would be more effective because it blocks line of sight and creates a longer distance for

the sound to travel. She summarized that having the equipment on the roof is more efficient to
minimize sound.
The public hearing was opened.
Murray Dunn said that everyone in the community of Bel Aire is excited about Paradise Foods
coming to town. He requested a story pole for the new utility pole since it would be right behind
his back fence.
Daren Wein agreed that the neighborhood is excited about the new market. He said that he could
not tell from the two loading docks which type of delivery goes to which delivery bay and asked
if all deliveries would include trucks backing into a bay. He asked if anything could be done
about the noise of backup beepers since the noise levels for such beepers are over 100 decibels.
Mr. Sheil responded to the neighbors' concerns. He said that PG&E could put up a story pole to
show the location of the utility pole. He said that they were very flexible about the location of the
pole anywhere along the property line. He described deliveries to the store, stating that large
deliveries of produce would take the same delivery route as previous trucks and would utilize the
new dock. He said that these trucks need to pull out in front of the dock and back up, but the
length the trucks have to back would be minimal. He said that he cannot address the issue of the
beepers because it is a safety issue and required by the NTSB, so nothing can be done to restrict
that type of noise. He said that the second type of delivery would be local delivery that would
use the same delivery patterns but would not need to back up into the smaller dock.
The public hearing was closed.
Boardmember Kricensky said he is happy to see Paradise Foods coming to town. He said that the
applicants addressed many concerns raised by the Fresh & Easy application. He liked the design
and thought that it would look more pleasing from the entry. He said that opening the entry area
to the outside would be a real plus and provide a transition point to the front doors.
Boardmember Chong agreed and said that this was a nice design. He liked the front entry change
and thought that the windows and brick in front would tie into the rest of the shopping center. He
was concerned about the noise created by the store for the residents. He said that the truck docks
had been well thought-out in terms of their positions. He suggested that the trash compactor be
included in the condition of approval requiring a noise analysis. He asked about requiring a story
pole for the utility pole. Planning Manager Watrous suggested that the utility pole be reviewed
under a separate staff-level design review application, with a requirement that a story pole be
installed.
Vice-Chair Johnson agreed with the other boardmembers and stated that the applicant had done a
lot of work and commended the level of professionalism in the application. He suggested
discussions with the landlords of the shopping center to try to give the rest of the center more
life.

Chair Emberson agreed. She was concerned that the backup beepers are annoying, but said that
that would be addressed by the Planning Commission as part of the discussion about delivery
hours.
Chair Emberson thought that the parapet walls should be painted darker. Boardmember
Kricensky said that the applicant brought up a good point that the visibility depends on how
close one is to the wall. Vice-Chair Johnson said that he would rather see the wall be the same
color as the structure.
Chair Emberson said that she liked the colors better than the ones proposed by Fresh and Easy,
and that she likes the look of the other Paradise Foods stores in Marin. She added that she liked
the proposed landscaping and planters.
Boardmember Kricensky pointed out that the noise of the backup beepers cannot be changed
without it becoming a liability issue and did not see a solution.
ACTION: It was M/S (Chong/Johnson) that the request for 1 Blackfield Drive is exempt from
the California Environmental Quality and approving the request subject to the attached
conditions of approval, with the additional conditions of approval requiring that the utility pole
be reviewed as staff-level design review application with a story pole to be installed, including
the standard conditions for skylights, and requiring that the noise levels of the trash compacter be
included in Condition No. 11. Vote: 4-0.
3. 5 ROLLING HILLS ROAD: File No. 21223; Vacpro, Inc., Owner; Site Plan and
Architectural Review for construction of additions to an existing single-family dwelling,
with a Variance for excess lot coverage and a Floor Area Exception. The applicants
propose to construct a new second story, expand the existing first story and basement
area and add 5 new skylights. The proposal would result in lot coverage of 2,616 square
feet (18.0%), which exceeds the maximum permitted lot coverage in the RO-2 zone
(15.0%). The proposal would result in a gross floor area of 3,525 square feet, which
exceeds the maximum floor area ratio for the property by 75 square feet. Assessor's
Parcel No. 058-141-21.
The applicant is requesting Design Review approval for the construction of additions to an
existing one-story single-family dwelling on property located at 5 Rolling Hills Road. A new
second story would be constructed, including a master bedroom suite, study, two more bedrooms
and one bathroom, with decks extending off several rooms. A new dining room and expansion to
the entry foyer would occur on the first floor of the house. The existing garage at a basement
level would be widened and a new wine cellar and storage area would be added to that level.
Five new skylights would be installed.
The floor area of the proposed house would be increased by 1,522 square feet to a total of 3,525
square feet, which is greater than the 3,450 square foot floor area ratio for this site. A floor area
exception is therefore required. The project would increase the lot coverage on the site by 253
square feet to a total of 2,616 square feet (18.0%), which is greater than the 15.0% maximum lot
coverage permitted in the RO-2 zone. A variance for excess lot coverage is therefore requested.

Albert Delama, representing Hank Bruce Architects, said that the project was essentially the
same as had been previously approved. He said that since then, the front deck was constructed
and the carport was enclosed. He said that they sought approval again because the Town does not
have an extension mechanism for DRB approvals. He said that they worked with all of the
neighbors. He said that a privacy issue was raised by the neighbors at 3 Rolling Hills, who did
not reside there when the project was previously approved. He said that they have tried to be
sensitive in their design and would like to work with the neighbors to address this concern but
have not yet reached a resolution between the two properties. He stated that the applicant is also
sensitive about privacy and they agree that a hedge along the property line would suffice in
solving any privacy issues between the two properties.
Boardmember Chong asked if the plan was the same as what was approved previously. Mr.
Delama said the same floor area was actually approved twice in the past.
The public hearing was opened.
Chris Hansen said that they did not live on the property when the last approval went through. He
said that they would like to see the plans include an agreement to maintain a privacy screen to
give both lots their privacy. He said that they are working together with the applicant on this and
hope to have it resolved within another week.
Planning Manager Watrous said that the Town did not want to hold up the application and
suggested a condition of approval for a revised landscaping plan requiring staff approval for
additional screening landscaping.
Mr. Hansen distributed photos of the story poles taken from his backyard. He said that there is an
approximate 25 foot elevation change between the properties. He was concerned that the addition
would look into their family room. He said that they would like some mutually acceptable plants
to go between the properties to provide privacy.
Alan Rappaport, owner, said that he met with Mr. Hansen a couple of hours ago and they have
reached a tentative agreement. He said that he also desires privacy and the additional
landscaping would not be an impediment.

Vice-Chair Johnson asked if there was ever a limitation on the number of times a proposal can
come back to the DRB for approval. Planning Manager Watrous said that such situations are rare
but there are no limits.
Vice-Chair Johnson stated that he was glad that the history of the project was explained, as the
Board has recently been more opposed to such combinations of excess lot coverage and floor
area. He voiced support, given the fact that this project had been previously approved and that
the overall impact would be very minor.

Boardmember Chong said that he read his comments on the previous approval, and he was
supportive of some type of screening between this house and 3 Rolling Hills Road.
Boardmember Kricensky said that the other lots and houses in the area are similar in size, the
project fits into the hillside, and he supported the project.
Chair Emberson said that the project did not fit into the hillside and she was not fond of the
design. She thought that the light colored siding on such a large house would make it stand out.
She felt that this was a massive project, but noted that no one was concerned in the
neighborhood.
Boardmember Chong said that the mature landscaping would mitigate the mass of the project
and when the additional landscaping is filled in, it would not seem so massive.
ACTION: It was M/S (Johnson/Chong) that the request for 5 Rolling Hills Road is exempt from
the California Environmental Quality Act and approving the request, subject to the attached
conditions of approval and the additional condition of approval that a landscape plan with a
possible screening hedge be prepared and reviewed by staff to screen the project from 3 Rolling
Hills Road. Vote: 4-0.
