CALL TO ORDER Mayor Hennessy called the regular meeting of the Town Council of the Town ofTiburon to order at 7:38 p.m. on Wednesday, May 21,1997, in Council Chambers at 1505 Tiburon Boulevard, Tiburon, California. A. ANNOUNCEMENT OF CLOSED SESSION ACTION (If any) None. C. PRESENTATION OF HERITAGE & ARTS PRESERVATION AWARD 1) Dr. David Steinhardt, Recipient of Second Annual Preservation Award. Victoria Arnett, Chair of the Heritage & Arts Commission, presented Dr. Steinhardt with the award for his efforts in ~ saving the Lyford House and preserving the marshlands which are now known as the Richardson Bay Sanctuary. She also acknowledged several members of the audience who were involved with Dr. Steinhardt: Elizabeth Terwilliger, Martin Griffith, one of the early Audubon Society Presidents, Ellen Kipp, Herman Schwartz, and Ike Livermore (not present). Beth Hewing, Director of the Center, said the award coincided with the 40th anniversary of the founding of the Richardson Bay Audubon Center and Marin Audubon Society. She said the award represented stewardship of the unique Richardson Bay estuary which was a major stopover on the Pacific flyway. Dr. Steinhardt accepted the award and gave a brief history of his involvement with the project. He acknowledged the current staff of the Audubon Center and saluted those who had passed on. Mayor Hennessy also expressed her appreciation on behalf of the Council and presided over a brief ceremony in which the public was treated to cake and coffee. Council reconvened at 8: 16 p.m. D. PUBLIC OUESTIONS AND COMMENTS Stewart Hop.!<:ins requested that Council agendize and update a plan for the Flood Plain and Marsh behind Town Hall. /"- Town Council Minutes # 1113 May 21. 1997 ~ -- He also questioned why Lagoon View was not on the Town Engineer's list for street repairs scheduled for the summer. He said the proposed slurry seal was not enough. ~ Town Engineer Barmand said Lagoon View was on the Town's regular street maintenance list. He said there was a possibility it could be ugraded to the current repair list but that it would cost a lot to bring equipment in to that location. E. COUNCIL. COMMISSION & COMMITTEE REPORTS None. F. Thayer, Seconded by Thompson AYES: Unanimous ABSENT: Ginalski '"' G. UNFINISHED BUSINESS 7) HilIhaven Undergrounding District - Status of Construction Surplus - Continued to June 4. 1997. H. NEW BUSINESS 8) Walking Guide to Historic Tiburon Brochure - (Authorize Heritage & Arts Commission Request for Funding and Replacement of Two-Year Supply). Chair Victoria Arnett said the Commission had printed 75,000 brochures two years ago for a cost of $7, 180, and that she had gone back to the printer and negotiated a new price which would be only $300 more. Arnett asked Council to increase the Town's contribution by $790 for a total of $2,790. The rest of the funding, according to Arnett, would come from downtown businesses, the Chamber of Commerce ($2,000 as before) and the Red & White Fleet ($2,500 as before). She said the Tiburon Lodge, the largest user of the brochures, had not yet replied to the request, and that the Rotary Club and City of Belvedere were yet to be contacted. Mayor Hennessy suggested withholding brochures from the Lodge unless they contribute; Councilmemper Wolf suggested limiting the number to 1,000 and perhaps charge per case thereafter. - Town Council Minutes #1113 May 21. 1997 2 . - ~ ~ """ MOTION: To fund the balance of $2,790 to print the brochure; $790 of the balance as a loan to be made up through Heritage & Arts' fund-raising efforts. .. ~;. Moved: Vote: Wolf, Seconded by Hennessy AYES: Unanimous ABSENT: Ginalski 9) Sprint Antenna - (Consider Proposed Lease between Town and Sprint for Town Hall Antenna Site) - Continued to June 4, 1997. 10) 1995-96 Town Audit & Management Report - (Review & Accept). Town Manager Kleinert said the auditors had made some significant suggestions and recommendations which were contained in the reports distributed to Council. Finance Director Stranzl said the reconciliations were not done in a timely manner but the balance was in the Town's favor. He said the problems in reconciliation were due partly to computer problems with the old IBM System 36, and partly to the timing issue. He said the auditor's suggestions were being referred to the Finance Advisory Committee for review and implementation. Stranzl also said the Town's new computer system was more fully automated with regard to reconciliations. Mayor Hennessy asked when the new system would go into effect. Stranzl said it would come on r-. by individuals module (i.e. revenues, payroll, and accounts payable), and that the auditors had recommended running parallel for three to six months. COMMUNICA nONS 11) Request for Use of Portion of Old Town Hall Building at Ned's Way - (Letter from BelvederelTiburon Child Care Center to Town Manager, Dated May 9, 1997). Councilmember Thompson suggested holding off until the lot split issue and release of easement were resolved and obtained from the Child Care Center with regard to the Town's property and proposed police station at Ned's Way. Councilmember Wolf said it was not necessary to use leverage to come to an agreement. Mayor Hennessy concurred. Karen Nygren commented about the need for fire and liability insurance if the building were occupied. Stewart Hopkins commented against giving preferential rates. r-- Town Manager Kleinert said a letter agreement would be obtained for the four months requested Town Council Minutes #1113 May 21, 1997 3 . - ~ I"'"' by the Center, June through September, 1997. ~~ Vice Mayor Thayer said he and Mark Qinalski had met with the Child Care Center representatives and had reached closure on the lot line issue in principal which, he believed, had then been presented to the Planning Commission by Bruce Ross. Town Manager Kleinert said he would instruct Town Attorney Danforth to draw up the papers. K. STAFF & TOWN MANAGER REPORTS 12) Senior Housing Advisory Committee - (Update on Proposals for Senior Housing Development at Ned's Way). Planning Director Anderson said SHAC had met the previous day but had scheduled a subsequent meeting for more formal presentations. Mayor Hennessy expressed concern that the below market rate units had the same amenities as the market rate units. Councilmember Wolf said she thought the law had change with regard to BMR's and that they had to be the same as regular units. Hennessy said her BMR unit was 750 square feet while the market rate units in her complex were 1,250 square feet. r.. 13) Street Maintenance Program - (Tiburon Road Repairs and Improvements Scheduled for Summer 1997). Councilmember Thompson asked why Southridge West was not on the list. Town Engineer Barmand said there was a user benefit factor that went into the planning and scheduling, but he said Southridge West would be on the next fiscal year's maintenance list. 14) Parks & Open Space commission - Staffing Issues - Continued to June 4, 1997. Council instructed Town Manager Kleinert to handle the matter and to assure the Parks & Open Space Commission that the Council had decided to keep the number of commissioners at seven. L.
